(1) A notice under section 160 shall not be given except with the leave of the Adjudicating Authority, if the property has been claimed for the estate of the bankrupt or if any person is in possession of the property.

(2) The notice may be given notwithstanding that the bankruptcy trustee has taken possession of the property, endeavoured to sell it, or otherwise exercised rights of ownership in relation to it.
