(1) Before making an application under section 54C, the corporate debtor shall obtain a declaration from the proposed resolution professional in such form as may be specified, confirming that—

1. there are no disciplinary proceedings pending against him;
2. he is independent of the corporate debtor; and
3. he has given his written consent to act as a resolution professional for the pre-packaged insolvency resolution process of the corporate debtor.

(2) The proposed resolution professional shall, before making the declaration referred to in sub-section (1), examine the books of account and other documents and records of the corporate debtor available with an information utility and conduct such other examinations as may be specified.
