If a bankruptcy trustee—
- fraudulently misapplies or retains or accounts for any money or property comprised in the estate of the bankrupt; or
- wilfully acts in a manner that results in loss to the estate of the bankrupt; or
- fails to comply with or contravenes the provisions of this Code,
he shall be punishable with imprisonment for a term which shall not be less than three years but which may extend to five years, or with fine which shall not be less than three times the amount of the loss caused, or the excess of the amount retained, as the case may be, or with both.
