(1)

Without the written permission of the Commissioner no building, wall or other structure shall be newly erected, and no street or railway shall be constructed, over any municipal water main.

If any building, wall or other structure be so erected, or any street or railway be so constructed, the Commissioner may, with the approval of [the Standing Committee] [These words were substituted for the words 'the Mayor-in-Council' by Maharashtra 27 of 1999, Section 104, (w.e.f. 23-4-1999).], cause the same to be removed or otherwise dealt with as to him shall appear fit, and the expenses thereby incurred shall be paid by the person offending.
