U.P. Real Estate Regulatory Authority, Regional Office, Gautam Buddh Nagar. Order under Section 34, Bench-2 Judgment and Order under Section 34 read with Section 37 Present: Shri T. Venkatesh, Member Complaint No.: NCR44/I0/733762/2025 Nikhil Jain vs. Rise Projects Pvt. Ltd. The present complaint application has been instituted by the complainant against the opposite party seeking possession of the unit and interest for the delayed period. In brief, the complainant states that on 26.05.2022 they booked unit no. [?], Villa 9, Street 8, in the opposite party's project Rise Resort Residences Phase-I [?], against a total price of Rs. 4,97,62,000/-, and paid Rs. 2,07,7,750/- from time to time in installments.
In the detailed complaint filed, the complainant has stated that they booked a unit/villa in the opposite party's project, but to date the opposite party has not obtained the occupancy/completion certificate from the competent development authority. Further, as per clause 7.4 of the flat buyer agreement executed between the parties, an assurance was given to complete construction and hand over possession by December, 2024. However, even after a considerable lapse of time, construction at the project site is still incomplete and the villa structure has also not been completed, from which it is clear that the opposite party will not be able to hand over possession within the stipulated period. Moreover, the opposite party is orally making an illegal demand of 500 per square foot as transfer fee if the villa is transferred to another buyer. The complainant apprehends that the complainant's allotment may be cancelled on the ground of non-payment of the demands raised for completion of construction and the fit-out offer, while the construction of the opposite party's project is incomplete. The complainant is not willing to pay any additional amount or delay interest until the opposite party fulfils its obligations under the flat buyer agreement and the RERA Act.
The complainant seeks relief from any demand of penal interest and other charges by the opposite party while the present complaint is pending. As interim relief, the complainant seeks an immediate stay on payment demands, interest accrual or threats of cancellation of the agreement. It has further been requested that all outstanding payments be deferred until the builder obtains OC/CC from the competent development authority and registers the project in question with the RERA Authority, and that the unit be maintained in its present status. For this reason the complainant has requested possession and interest for the delayed period from the Real Estate Regulatory Authority under [?] of the Act. In support of the statement the complainant has filed photocopies of records including vakalatnama, e-mail correspondence, the allotment / agreement dated 45.04.2024, receipts of the amounts deposited with the opposite party, the detailed complaint and other records.
The opposite party, filing its written arguments dated 26.05.2026, has recorded that the complainant booked unit / villa no. Villa 9, Street 8 in the opposite party's project Rise Resort Residences Phase-I, the total price of which was Rs. ,97,62,000/-. As per clause 7.4.4 of the flat buyer agreement between the parties, the fixed date for handing over possession of the unit / villa was 34.06.2027. Thereafter, a supplementary agreement was executed between the parties on 48.04.2022, according to which the revised period for handing over possession was fixed as 34.2.2028. The complainant is attempting to mislead the Hon'ble Bench; the complaint in question was filed before the due date and, for that reason, does not fall within the RERA Act and is liable to be dismissed at the preliminary stage. The opposite party has neither defaulted in handing over possession of the concerned unit / villa for any reason, nor is there any likelihood of its failing in future. It has further been stated that the amount paid by the complainant against the unit in question has been shown as Rs. 2,07,47,750/-, whereas the complainant has not produced any receipt of such payment. On the basis of this statement, the present complaint is liable to be dismissed at the preliminary stage, and no relief can be granted at present under the RERA Act, because the contractual date fixed for handing over possession has not yet expired.
In support of its statement, the opposite party has filed photocopies of records including its written arguments, the allotment / agreement letter dated 45.04.2024, the supplementary agreement dated 48.05.2024, the order dated 44.03.2020 passed by the Hon'ble RERA Bench-2, and other records. The arguments of both parties were heard and the file perused, on the basis of which the following point is framed: 1. Whether at present the complainant can be granted possession of the unit / [?] in question and interest for the delayed period, or not? Point for determination No. II: Point No. [I] is framed to the effect of whether the complainant should be granted possession and interest for the delayed period and, if so, at what rate. This point is framed on the basis of the complainant's averments, and the burden of proving it lies on the complainant.
In the detailed complaint, the complainant has recorded that they booked a unit/villa in the opposite party's project, but to date the opposite party has not obtained the occupancy/completion certificate from the competent development authority. Further, as per clause 7.4.[II] of the flat buyer agreement executed between the parties, an assurance was given to complete construction and hand over possession by December, 2024. Although a considerable time has passed, construction at the project site is still incomplete and the villa structure has also not been completed, from which it is clear that the opposite party will not be able to hand over possession within the stipulated period. Moreover, the opposite party is orally making an illegal demand of 500 per square foot as transfer fee if the villa is transferred to another buyer.
The complainant apprehends that the complainant's allotment may be cancelled on the ground of non-payment of the demands raised for completion of construction and the fit-out offer, while the opposite party's project is incomplete. It has further been requested that all outstanding payments be deferred until the builder obtains OC/CC from the competent development authority and registers the project with the RERA Authority, and that the unit be maintained in its present status. For this reason the complainant has requested possession and interest for the delayed period before the Real Estate Regulatory Authority under [?] of the Act.
On the other hand, the opposite party, by its written arguments dated 26.05.2026, has recorded that the complainant booked unit / villa no. Villa 9, Street 8 in the opposite party's project Rise Resort Residences Phase-I, the total price of which was Rs. ,97,62,000/-. As per clause 7 of the flat buyer agreement between the parties, the fixed date for handing over possession of the unit / villa was 34.06.2027. Thereafter a supplementary agreement was executed between the parties on 48.04.2022, according to which the revised period for handing over possession was fixed as 34. .42.2028. 2,07,7,750/-, whereas the complainant has not produced any receipt of such payment. On the basis of this statement, the present complaint is liable to be dismissed at the preliminary stage, and no relief can be granted at present under Section 48 of the RERA Act, because the contractual date fixed for handing over possession has not yet expired. Section [?](4) of the RERA Act provides:
"Section 8 (1): If the promoter fails to complete or is unable to give possession of an apartment, plot or building,- (a) in accordance with the terms of the agreement for sale or, as the case may be, duly completed by the date specified therein; or (b) due to discontinuance of his business as a developer on account of suspension or revocation of the registration under this Act or for any other reason, he shall be liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice to any other remedy available, to return the amount received by him in respect of that apartment, plot, building, as the case may be, with interest at such rate as may be prescribed in this behalf including compensation in the manner as provided under this Act: Provided that where an allottee does not intend to withdraw from the project, he shall be paid, by the promoter, interest for every month of delay, till the handing over of the possession, at such rate as may be prescribed." Accordingly, the buyer has the right that if possession is not given in accordance with the agreement, they may demand return of the amount deposited with interest, or remain in the project receiving interest for each month of delay. However, in the present case the complainant has requested possession of the unit / villa in question and interest for the delayed period.
A photocopy of the allotment / agreement letter dated 45.04.2024 filed on file by the complainant, which has been signed by both parties, shows at clause 7 [?] of its page that possession of the unit / villa in question was to be given on 34.42.2026. Accordingly, as stated above, the complainant is entitled to possession of the unit / villa by 04.04.2027. Further, a Supplementary Agreement was signed between the parties on 48.05.2024. From it, it is evident that by mutual consent of the parties the date for handing over possession of the unit / villa has been revised from 34.42.2026 to 34.42.2028, which is a future date. Thus it is clear that the present complaint was filed before this Hon'ble Authority before the date of handing over possession, as per the Supplementary Agreement dated 48.05.2024 signed by the complainant. In such a situation, the opposite party's project cannot be treated as being in the category of delay. It is also clear that the present complaint is premature. In such a case the complainant's suit is not maintainable, and the present complaint of the complainant is liable to be dismissed. Accordingly, Point No. 04 is disposed of. Order The complaint in question of the complainant is dismissed as above. Order to be uploaded on the portal. File to be consigned to record accordingly. T. Venkatesh (Member) U.P.
