U.P. Real Estate Regulatory Authority, Regional Office, Gautam Buddha Nagar. Order under Section 31 / धारा-34, Bench-II Presence — Shri T. Venkatesh, Member Serial No. | Complaint Number | Complainants | Unit Number 1. | NCRI45/I/02579/2022 | Smt. Rama | Unit-T8-907 2. | NCRI45/4/02634/2022 | Prem Singh Rawat | Unit-T6-806 3. | NCRI45/I/02370/2022 | Nutan Singh | Unit-T5-504 4. | NCRI45//02546/2022 | Amit Vashishta | Unit- T5-402 Versus M/s Rise Projects Pvt. Ltd. Complaints have been instituted against the respondent by complainant Smt. Rama along with 03 other complainants. The facts and evidence of all these complaints are identical. All these complaints relate to the respondent's project "RISE ORGANIC GHAR PHASE 1 / PHASE i". Therefore, the complaints in question are being disposed of by a single decision. Complaint No.-NCRI45/I4/02579/2022 Smt. Rama shall be the lead case. The present complaint applications have been instituted by the complainants against the respondent for grant of possession along with interest for the delayed period.
In brief, the lead complainant states that unit number Unit-907 / Unit-T8-907 was booked by them in the respondent's project "RISE ORGANIC GHAR PHASE i", whose total price was Rs. 27,99,720/-, against which an amount of Rs. 27,85,800/- has been paid by the complainant on an installment basis from time to time. The complainant also states that the respondent's project is delayed and construction work is also proceeding at a slow pace, and possession of the unit along with OC/CC has not been made available by the respondent till now. The respondent has not obtained necessary certificates related to the project from the competent authority either, and despite having received 85 percent / 65 percent of the amount against the unit, possession of the unit has not been given by the respondent. Therefore, request has been made by the complainant for refund of deposited money along with interest. In support of their statement, photocopies of documents like vakalatnama, allotment letter dated 30.0:20:6 / 30.0:.20I6, receipts of deposited money, etc., have been filed by the complainant.
The respondent, filing reply in support of their statement, stated that unit number 907 in Tower-T8 was booked by the complainant, whose total price was Rs. 27,99,720/-. Builder buyer agreement was executed between both parties on date 30.0:.20I6. According to the agreement letter, possession of the unit was to be given to the respondent with 42 months and 6 months grace period. The respondent informed that application has been made before the competent authority for necessary NOC. Fit-out possession will be given to the complainant by December 2023 and physical possession of the unit will be provided by March 2024. The respondent also stated that due to environmental pollution, the National Green Tribunal completely banned any construction activity in Delhi NCR, adversely affecting progress of the project. It was also stated that the Government of India resorted to some of the strictest measures in the world to prevent spread of COVID-19 / कोविड-49 virus and declared nationwide lockdown from 24 March, 2020 throughout the country, which was extended by various notifications, due to which construction activities remained completely disrupted owing to non-availability of construction materials, causing delay in completing the project. In addition, the respondent stated that physical possession of their unit along with necessary no objection certificates related to the project will be handed over to the complainant by March, 2024.
On the other hand, the complainant, filing a rejoinder, stated that the allotment letter was executed between complainant and respondent on date 30.0:.20I6, according to which possession of the unit was to be given by the respondent by January 2020 with grace period. Unit number 907 in Tower-T8 was booked by the complainant in the respondent's project, whose total price was Rs. 27,74,970/-, against which an amount of Rs. 27,85,800/- has been paid by them. The complainant states that complaint was registered before the Authority on date 23.44.2022. Arguments of both parties were heard and the record was perused, on the basis of which the following issue is framed: - 1. Whether the complainant should be granted possession and interest for the delayed period? If yes, what will be the rate of interest? Point of Determination No. 1: This point has been framed to the effect whether possession and delay period interest should be granted to the complainant? If yes, what will be the rate of interest?
The complainant also states that the respondent's project is delayed and construction work is proceeding at a slow pace, and possession of the unit along with OC/CC has not been made available by the respondent till now. The respondent has not obtained necessary certificates related to the project from the competent authority either, and despite receiving 85 percent of the amount against the unit, possession of the unit has not been given by the respondent. Therefore, request has been made by the complainant for refund of deposited money along with interest. On the other hand, it has been stated by the respondent in their reply that physical possession of their unit along with necessary no objection certificates related to the project will be handed over to the complainant by March, 2024. Photocopy of allotment letter dated 30.0.20I6 has been filed on record by the complainant, according to Clause 6(b) of which possession of the unit was to be made available in 48 months with 42 months and 6 months grace period. In this manner, the date of giving possession becomes 29.0:.2020 / 30.04.2020, but possession of the unit was not given by the respondent within the stipulated period. As to the question up to which period interest should be granted, in Civil Appeal No. 6649-50/20i8 "Supertech Limited versus Rajni Goyal", the Hon'ble Supreme Court held that: -
"the period of Interest should close on April 20l6 when the Full Occupancy Certificate was obtained as per the admission of the Respondent — Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant —Builder had obtained the Completion Certificate as late as April 20l6. The Respondent — Purchaser could not have any further grievance after April 206 with respect to delay in handing over possession. The Respondent — Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession. " According to the above legal proposition, the complainant will be entitled to delay interest up to the date of OC/CC or offer of possession, whichever is later. In such situation, the complainant is entitled to receive interest for the delayed period from date 30.07.2020 / 30.04.2020 up to the date of OC/CC or the date of offer of possession, whichever is later. So far as the question of liability of interest is concerned, the Hon'ble Bombay High Court in the case of "Neelkamal Realtors Suburban Pvt. Ltd. etc. versus Union of India" held that: -
"Section 18(1)(b) / ]8(l)(b) lays down that if the promoter fails to complete or is unable to give possession of an aprtment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. If the allottee does not intent to withdraw from the project he shall be paid by the promoter interest for every month's delay till handing over of the possession,. The requirement to pay interest is not a penalty as the payment of interest is compensatory in nature in the light of the delay suffered by the allottee who has paid for his apartment but has not received possession of it. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable." Therefore, in light of the above judgment, it is clear that under the provisions of UP RERA, interest will be payable on the delayed period and principal amount as per the agreement between promoter and buyer, because the said funds were utilized by the promoters.
As far as the rate of interest payable is concerned, the State Government notified the Real Estate (Regulation and Development) (Agreement for Sale/Lease) Rules, 20i8 under the Real Estate (Regulation and Development) Act, 2046 / 20:6 on date 47.40.2048. In Clause 9 of the draft Agreement for Sale/Lease given as an annexure therein, Events of default of promoters are defined, wherein in Clause 9.2(ii) in case of promoter being in default, it is provided for the allottee that: - "The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +l% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:" The same rate is prescribed in Clause 9.3(i) in case of default by allottees. Keeping the said provision in view, it appears justified to grant interest for the delayed period to the allottee at the interest rate of MCLR+1 percent. It is also clarified that if any amount of the complainant is overdue, the respondent can also receive interest thereon only at the rate of MCLR+1 percent. The same definition of interest is given in Section 2(za)(i) of RERA. Accordingly, Point No. 1 is disposed of. Disposing of the above issues, the following orders are passed: -
Order:
1. The respondent is directed to complete all amenities of the complainants' units as per the allotment letter / agreement and ensure handing over possession along with OC/CC by date 30.44.2023, and after obtaining payable stamp duty, execute registry as per rules. 2. The respondent shall ensure payment of interest at MCLR+1% percent on the amount deposited by the complainant themselves from date 30.04.2020 / 30.07.2020 up to the date of obtaining OC/CC or offer of possession. This amount of interest shall be adjusted against the amount in final payment. In case the interest amount is more than the payable amount, it shall be refunded to the complainant. Keeping in view the force majeure period, between date 25.03.2020 and date 25.09.2020, if there are any overdues against the complainant, no interest shall be payable for this period on the same. In the cases of other complainants, calculation shall be done as aforesaid in accordance with the allotment letter/agreement. 3. The respondent is directed that as per Section 2(za)(i) of the RERA Act, 2046, if any rate of interest is charged by the promoter for default of the allottee after the coming into force of RERA, interest at the same rate shall also be paid to the allottee in case of default by the promoter. Therefore, on delayed payment, interest will be payable by the complainant also at the rate of MCLR+1% percent. If any amount has been taken from the allottee for delay at a higher rate after RERA came into force, the amount of interest for the delayed period shall also be calculated at that same rate. 4. Violation of this order shall be punishable under Section 63 of the Real Estate (Regulation and Development) Act, 20i6 and other relevant provisions. The order shall be uploaded on the portal. 5. One copy each of this order shall be placed on the concerned files and calculation of amount and interest in each case shall be done in accordance with the principles laid down in this order. 6. If this order is not complied with by the respondent, the complainant shall have the right to get their order executed through the RERA Authority.

इस सम्बन्ध में सिविल अपील Wo 6649-50/20i8 "सुपरटेक लिमिटेड बनाम रजनी गोयल"में माननीय उच्चतम न्यायालय द्वारा अभिनिर्धारित किया गया है कि:- "the period of Interest should close on April 20l6 when the Full Occupancy Certificate was obtained as per the admission of the Respondent — Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant —Builder had obtained the Completion Certificate as late as April 20l6. The Respondent — Purchaser could not have any further grievance after April 206 with respect to delay in handing over possession. The Respondent — Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession.
आदि बनाम यूनियन ऑफ इंडिया”के वाद में अभिनिर्धारित किया गया है कि :- "Section ]8(l)(b) lays down that if the promoter fails to complete or is unable to give possession of an aprtment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable. "
अतः उपरोक्त निर्णय के आलोक में यह स्पष्ट है कि उ0प्र0 रेरा के प्राविधानों के अन्तर्गत प्रमोटर व SoH बीच किये गये अनुबंध के अनुरूप विलम्ब तथा मूल धनराशि पर ब्याज देय होगा, क्योंकि प्रमोटर्स द्वारा उक्त धनराशि का उपभोग किया गया है। जहाँ तक देय ब्याज दर का प्रश्न है, तो राज्य सरकार द्वारा भू-सम्पदा (विनियमन एवं विकास) अधिनियम 20:6 के अधीन दिनांक 47.40.2048 को भू-सम्पदा (विनियमन और विकास) (विकय,पटटा के लिए करार) नियमावली 20i8 अधिसूचित की गयी हैं। इसमें संलग्नक के रूप में दिये गये विकय /पटटा विलेख के प्रारूप के प्रस्तर 9 में प्रमोटर्स के डिफाल्ट प्रकरण (Events of default) परिभाषित है, जिसमें प्रस्तर 9.2() में प्रमोटर के डिफाल्टर होने की स्थिति में आवंटी हेतु प्राविधानित है कि:- "The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +l% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:" यही दर आवंटियों के द्वारा डिफॉल्ट की स्थिति में भी प्रस्तर 9.30) में
