U.P. Real Estate Regulatory Authority, Regional Office, Gautam Budh Nagar | Order under Section 34, Bench-2 (formerly Bench-4) Presiding Officer: Shri T. Venkatesh, Member Complaint No. WT—NCRI45/04/I8674/2024 Anupama Jain Versus M/s Rise Projects Pvt. Ltd. The complaint petition has been filed by the complainant against the respondent seeking possession of the unit [?] and interest for the delayed period. In brief, the complainant states that on 07.06.2024 she booked Unit No. 73-60 [?] in the respondent's project RISE ORGANIC HOMES PHASE II. The total sale value of the unit was Rs. 64,73,775/-, against which she has paid Rs. 32,47,337/- to the respondent from time to time in instalments according to the payment schedule. The complainant states that the respondent has not obtained the necessary certificates and No Objection Certificates from the competent development authority, has not completed construction of the project according to the sanctioned plan, and is not handing over the unit in question although the complainant is not at fault in any way. For this reason the complainant has filed this complaint against the respondent under Section 34 of the Real Estate (Regulation and Development) Act, seeking possession of the unit along with interest for the delayed period.
In addition, by a detailed written complaint dated 04.04.20204 filed under [?], the complainant has stated that she had booked Unit WN-T3-60[?] in the respondent's project ORGANIC HOMES, having an area of t074 sq. ft. An Agreement for Sale was executed between the parties on 34.08.2024, under which the total price of the unit, including all charges, was Rs. 64,73,775/-, against which she paid Rs. 32,47,337/-. The respondent was to hand over possession of the unit by 28.03.2022, but the project is still incomplete, and the brochure and the arrangements and amenities stated in the agreement between the parties have not been provided. The technical team of the RERA Authority inspected the project on 06.06.2022, which was after the fixed date for handing over possession of the unit. This shows that the respondent's project was still incomplete on 06 June 2022, and a copy of the inspection record is attached. The respondent had declared on the Authority's website that the completion date of the project was 30.09.2020, but after the COVID-19 pandemic it was extended twice to 28.03.2022. The registration of the project under the RERA Act, 2046 has also now expired, and no fresh registration has been obtained, which violates Sections 3 and 4 of the RERA Act, 2046.
The respondent issued a reminder notice to the complainant on 24.50.2024, demanding Rs. 43,54,223/-, but the complainant has still not received that notice. The respondent also issued an illegal and invalid cancellation notice of the unit to the complainant on 37.03.2022. That notice referred to the reminder letter dated 42.03.2022 and the reminder letter dated 24.::.2022, but the complainant did not receive any reminder letter dated 42.40.2024. Once the registration of the project was cancelled, the respondent cannot recover any amount from the complainant under Section 3 of the RERA Act, 2046. The complainant visited the respondent's office on 40.04.2022 and raised the matter of cancellation of the unit. The respondent violated the date for possession of the unit that it had given, because the project was not completed within the time stated in the agreement between the parties, and construction had not even started, yet the respondent issued a demand letter for the unit. The respondent had assured early completion of the project and had said that a decision would be taken to demand the balance outstanding of Rs. 42,50,000/- from the complainant and to cancel the unit. However, despite that assurance, the complainant paid Rs. 42,50,000/- to the respondent, and the details are attached. The respondent did not withdraw the cancellation of the unit, so the complainant has filed the present complaint before the RERA Authority.
The complainant says that the respondent has issued an invalid and illegal cancellation notice for her unit, because the provisions of the RERA Act, 2046 were not followed, nor was the due process under the Uttar Pradesh Real Estate (Registration and Development) (Rent / Lease Agreement) Rules, 2046 followed. The registration of the project expired on 02.032022, so the cancellation notice of the unit is invalid and illegal. According to the agreement executed between the parties, the unit was to be handed over with possession by 28.03.2022, which has still not been done. On this basis the complainant requests that the respondent be directed to withdraw the cancellation letter of her unit, to hand over the unit with possession along with interest for the delayed period in accordance with the provisions of the RERA Act, 2046, to execute the sale deed, and not to demand any tax from her, because all taxes are included in the price of the unit. Accordingly, the complainant has requested possession of the unit and interest for the delayed period. In support of her statement the complainant has filed copies of the welcome letter dated 29.07.2024, the Agreement for Sale dated 34.08.2024 signed by the complainant, the receipts of the amounts deposited with the respondent, the cancellation letter dated 34.03.2022, the reply letter, the application form and other records.
In its written reply, the respondent stated that after RERA came into force it registered the project "Rise Organic Homes" with RERA, under registration No. WeT-UPRERAPRI4ZO86. For Towers 2, 3, 4, 5, 6 and 9 of the project, the Ghaziabad Development Authority issued a completion certificate on 9.08.2023. The project is being developed on the land numbered Plot No. 6प्त-03 [?], Block-& [?], Jaipuria Sunrise Greens, NH-24, Ghaziabad. The respondent says that the complainant booked Unit WI-T3-l60Igh [?] through her application dated 26.07.2024, having an area of i995 sq. ft., and a total price of Rs. 64,73,775/-. In compliance with Section 43 of the RERA Act, 2076 [?], an Agreement for Sale was executed between the parties on 34.08.2024. The respondent states that both parties, after mutual consent and after finalising the terms and conditions, signed the said agreement, and that the complainant herself chose the 50:50 payment plan. In accordance with the terms, the respondent sent two original copies of the agreement to the complainant for signature, so that the agreement could be duly executed. However, the respondent says it was extremely disappointing and surprising for the company that the complainant kept both original agreements with her and never returned them to the company for its signature, which shows her malicious intention, although she herself had selected the 50:50 payment plan.
The respondent states that the complainant has paid Rs. 26,46,550/- (excluding taxes) as partial sale value, but the remaining Rs. 38,57,225/- is still payable as the total cost of the unit. Because the complainant did not pay the instalments on the scheduled dates, she is liable to pay Rs. 94,640/- as delayed interest. The respondent further states that under the payment plan stated in the Agreement for Sale executed between the parties, 50 per cent of the total sale value was to be paid within 45 days of booking (10 per cent at the time of booking plus 40 per cent within 45 days of the booking), and the remaining 50 per cent was to be paid on the offer of fit-out. The complainant has paid Rs. 26,46,550/- (excluding taxes) and has not paid the first instalment in full, and she has completely disregarded the terms and conditions of the selected payment plan. The complainant signed the application form dated 26.07.2024, under which she was bound to pay 50 per cent within 45 days of booking. The complainant has paid only Rs. 49,02,264/- up to 07.09.2024, which is much less than the first instalment due within 45 days of booking.
The respondent states that the complainant was duly informed of the late fee and delayed interest, which were payable by her if instalments were not paid on time under the payment plan. The respondent has also issued an interest letter, which shows the delayed interest for the late payment, and the total outstanding amount is Rs. 43,79,482/-. The complainant was aware of the reminder letters and the delayed-interest letters sent to her, yet for a long time she has completely failed to pay the outstanding amount for the unit. A copy of the interest letter sent by the respondent to the complainant is attached. The complainant had assured payment of the outstanding amount within one month, but she did not pay. Thereafter the respondent sent reminder notices dated 22-40.2024 and 24.44.2024, giving the complainant an opportunity to pay the outstanding amount of Rs. 3,54,223/- in accordance with the construction milestones. The complainant has herself admitted in her complaint that she received the reminder notice sent by the respondent, which clearly proves that the demand letters and reminder notices were sent to her at the postal address she had given. Since she did not comply with the demand letters and reminder notices, her allotment may be cancelled.
The complainant had assured that she would pay the first instalment of Rs. 6,20,482/- and that she would pay the second instalment, being the remaining 50 per cent of the amount, and that she would pay the advance instalments on time. But being aggrieved by the complainant's non-payment under the 50:50 payment plan and her several violations, and because the respondent has suffered loss as it has earned no monetary benefit from the unit, the respondent cannot sell the unit to any other buyer until it cancels the allotment issued in the complainant's favour. The complainant has also not paid the outstanding dues even though more than one year has passed. Because she did not pay despite the many demand letters and reminder letters, the respondent cancelled the unit by its notice dated 34.03.2022, a copy of which, with the postal receipt and tracking report, is attached. After receiving the cancellation notice dated 34.03.2022, the complainant, in order to keep the unit with her, paid Rs. 2,50,000/- by cheque No. 264805 dated 37.03.2023 and Rs. 5,00,000/- by cheque No. 264805 dated 34.03.2023, which were cleared on 04.04.2022 and 25.04.2022. Although the complainant knew that the outstanding amount for the first instalment was Rs. 43,79,482/-, the amount she paid was less than the instalment amount under the payment plan. The complainant has paid Rs. 6,20,482/-, and beyond that, although more than two years have passed, she has taken no step to pay the balance instalments outstanding. This clearly shows her malicious intention, and that she has not paid in accordance with the terms of the Agreement for Sale executed between the parties. It is also important to note that the complainant filed her complaint before the Authority on 03.04.2024, whereas the cancellation of the unit was sent on 34.03.2022, before the complainant filed the present complaint. Therefore the complaint is not maintainable, because the allotment of the unit was duly cancelled in compliance with Section 4 (5) of the RERA Act.
The respondent further states that although the complainant knew that the respondent had obtained all no-objection certificates from the competent development authority, the completion certificate of the project was obtained on 44.08.2023. The complainant has taken no step, nor requested the respondent to withdraw the final cancellation letter dated 34.03.2022 for the unit. After the respondent received the occupancy certificate from the competent authority, it informed the complainant by e-mail on 24.08.2023 about the status of the occupancy certificate. Because the complainant intended from the beginning to default on payments, she ignored the numerous demand letters, reminder letters and interest letters, and did not pay on time in accordance with the 50:50 payment plan. Therefore the respondent cancelled the unit on 34.03.2022. Although two years have passed since the complainant's last payment, she has still not paid the outstanding amount for the unit, and she has completely failed to perform her duties under the terms of the sale agreement and the application form. Because the complainant did not pay more than 70 per cent of the total sale value under the Agreement for Sale executed between the parties, the respondent has cancelled the unit. In view of these facts and circumstances, the respondent has requested that the complaint be dismissed.
In support of its statement, the respondent has filed copies of its written reply, the Agreement for Sale dated 34.08.2024, the payment plan, the demand letters sent by e-mail, the reminder letters dated 42.40.2024, the completion certificate dated 49.08.2023, the cancellation letter dated 34.03.2022, the receipt sheet of the amounts received, and other records.
On the other hand, by her rejoinder dated 20.09.2024, the complainant has stated that the responsibility of executing the registered sale agreement lay with the respondent, as provided in Section 43 of the RERA Act, 20i6. Both original copies of the agreement are with the respondent company, and the respondent has not returned them to the complainant. The complainant has only photocopies of the agreement originals handed over by the respondent. In addition, the respondent received Rs. 43,50,000/- from the complainant on 30.09.2024, which is after the date of the Agreement for Sale, 34.08.2024. The respondent has accepted more than 40 per cent of the amount from the complainant without signing the sale agreement, in violation of Section 43 of the RERA Act, 20:6, whereas the complainant has paid only Rs. 32,47,337/- up to now. The respondent, in its reply, has stated that the original copies of the agreement are with the complainant, while at the same time it is demanding 50 per cent of the unit price under Section 43 (4) of the RERA Act without any registered sale deed. How can the respondent collect more than 40 per cent from the complainant without any sale agreement? The respondent has not sent any notice dated 42.40.2024, so the process of cancelling the unit is illegal. The complainant further states that she has paid the respondent Rs. 42,50,000/- through three cheques, and that she visited the respondent's office from time to time, but the respondent neither returned the deposited amount with interest nor withdrew the cancellation letter of the unit. Further, the complainant booked the unit after the COVID-19 pandemic, so the respondent cannot take advantage of unforeseen events. On the basis of these facts, the complainant has requested possession and interest for the delayed period.
The arguments of both sides were heard and the evidence on the file examined, on the basis of which the following points have been framed: 1. Whether the complainant has paid the amount according to the payment plan or not, and whether the process of cancelling the unit is lawful? 2. Whether the complainant is entitled to the relief claimed, and whether the complainant falls within the category of allottee? Disposal of Point No. 4 Point No. 1 has been framed to decide whether the complainant has paid the amount according to the payment plan or not, and whether the process of cancelling the unit is lawful. This point has been framed on the allegations of the respondent, and the burden of proving them lies on the respondent.
The complainant, by her detailed written complaint dated 04.04.20224 filed under Section 34, states that she had booked Unit WI-T3-604 [?] in the respondent's project ORGANIC HOMES, having an area of i074 sq. ft. An Agreement for Sale was executed between the parties on 34.08.2024, under which the total price of the unit, including all charges, was Rs. 64,73,775/-, against which she paid Rs. 32,47,337/-. The respondent was to hand over possession of the unit by 28.03.2022, but the respondent's project is still incomplete, and the amenities and arrangements stated in the agreement between the parties have not been included. The technical team of the RERA Authority inspected the project on 06.06.2022, which was after the fixed date for handing over possession of the unit. This also shows that the respondent's project was still incomplete on 06 June 2022, and a copy is attached. The respondent had declared the completion date of the project on the Authority's website as 30.09.2020, but after the COVID-19 pandemic it was extended twice to 28.03.2022. The registration of the project under the RERA Act, 2046 has also now expired, and no fresh registration was made, which violates Sections 3 and 4 of the RERA Act, 2046. The respondent issued a reminder notice to the complainant on 24.50.2024 demanding Rs. 73,54,223/-, which the complainant has still not received.
The respondent also issued an illegal and invalid cancellation notice of the unit on 34.03.2022, which referred to the reminder letter dated 42.03.2022 and the reminder letter dated 24.44.2022, but the complainant did not receive any reminder letter dated 42.40.2024. Once the registration of the project was cancelled, the respondent cannot recover any amount from the complainant under Section 3 of the RERA Act, 20i6. The complainant visited the respondent's office on 40.04.2022 and raised the matter of cancellation of the unit, but the respondent had violated the date for possession of the unit given by it. Because the project was not completed within the timeline stated in the agreement between the parties, and construction had not started, the respondent had no right to issue a demand letter for the unit. Although the respondent had assured early completion of the project and had said that a decision would be taken to demand Rs. 42,50,000/- as the balance outstanding from the complainant and to cancel the unit, despite that assurance the complainant paid Rs. 72,50,000/- [?] to the respondent, and the details are attached. The respondent did not withdraw the cancellation of the unit, so the complainant has filed the present complaint before the RERA Authority. The respondent has issued an invalid and illegal cancellation notice for the complainant's unit, because the provisions of the RERA Act, 20i6 & [?]
were not followed, nor was the due process under the Uttar Pradesh Real Estate (Registration and Development) (Rent / Lease Agreement) Act, 20i6 followed. The registration of the project expired on 02.032022, so the cancellation notice of the unit is invalid and illegal. According to the agreement executed between the parties, the unit was to be handed over with possession by 28.03.2022, which has still not been done. On this basis, the respondent is directed to withdraw the cancellation letter of the complainant's unit, to execute the sale deed along with the handing over of possession and interest for the delayed period in accordance with the RERA Act, 2046, and not to demand any tax from the complainant, because all taxes are included in the price of the unit.
The complainant, by her rejoinder dated 20.09.2024, has stated that the responsibility of executing the registered sale agreement lay with the respondent, as provided in Section 43 of the RERA Act, 20i6. Both original copies of the agreement are with the respondent company, and the respondent has not returned them to the complainant. The complainant has only photocopies of the agreement originals handed over by the respondent. The respondent also received Rs. 43,50,000/- from the complainant on 30.09.2024, which is after the date of the Agreement for Sale, 34.08.2024. The respondent accepted more than 40 per cent of the amount from the complainant without signing the sale agreement, in violation of Section 43 of the RERA Act, 20:6, whereas the complainant has paid only Rs. 32,47,337/- up to now. The respondent, in its reply, says that the original copies of the agreement are with the complainant, while it is demanding 50 per cent of the unit price under Section 43 (4) of the RERA Act without any registered sale deed. How can it collect more than 40 per cent from the complainant without any sale agreement? The respondent has not sent any notice dated 42.40.2024, so the cancellation process is illegal. The complainant paid Rs. 42,50,000/- through three cheques, and visited the respondent's office from time to time, but the respondent neither returned the deposited amount with interest nor withdrew the cancellation letter. The complainant booked the unit after the COVID-19 pandemic, so the respondent cannot take advantage of unforeseen events. On the basis of these facts, she has requested possession and interest for the delayed period.
In reply, the respondent, in support of its defence, has stated that after RERA came into force it registered the project "Rise Organic Homes" with RERA, under registration No. GeT-UPRERAPRI4O86. For Towers 2, 3, 4, 5, 6 and 9 of the project, the Ghaziabad Development Authority issued a completion certificate on 49.08.2023. The project is being developed on the land numbered Plot No. 0प-03 [?], Block-[?], Jaipuria Sunrise Greens, NH-24, Ghaziabad. The respondent says that the complainant applied through her application dated 26.07.2024 for Unit No. 3-60 [?], having an area of t995 sq. ft., and a total price of Rs. 64,73,775/-. In compliance with Section 43 of the RERA Act, 20i6, an Agreement for Sale was executed between the parties on 34.08.2024. It is also worth noting that both parties, after mutual consent and after finalising the terms and conditions, signed the said agreement, under which the complainant chose the 50:50 payment plan. Under that plan the complainant has paid Rs. 26,46,550/- (excluding taxes) as partial sale value, whereas Rs. 38,57,225/- is still payable as the total cost of the unit, and because the complainant did not pay the instalments on schedule she is liable to pay Rs. 94,640/- as delayed interest.
Under the payment plan in the Agreement for Sale executed between the parties, 50 per cent of the total sale value was to be paid within 45 days of booking (10 per cent at the time of booking plus 40 per cent within 45 days of booking), and the remaining 50 per cent was to be paid on the offer of fit-out. The complainant has paid Rs. 26,46,550/- (excluding taxes) and has not paid the first instalment in full, and has completely disregarded the terms and conditions of the selected payment plan. The complainant signed the application form dated 26.07.2024, under which she was bound to pay 50 per cent of the amount within 45 days of booking. Up to 07.09.2024 the complainant paid only Rs. 49,02,264/-, which is far less than the first instalment due within 45 days of booking. The complainant was duly informed of the late fee and delayed interest, which were payable if instalments were not paid on time under the payment plan. The respondent has also issued an interest letter, which shows the delayed interest for the payment delay and states that the total outstanding amount is Rs. 43,79,482/-. Although the complainant was aware of the reminder letters and delayed-interest letters sent to her, she has for a long time completely failed to pay the outstanding amount for the unit. A copy of the interest letter sent by the respondent to the complainant is attached. The complainant had assured payment of the outstanding amount within one month, but did not pay.
The respondent then sent reminder notices dated 22-40.2024 and 24.44.2024, giving the complainant an opportunity to pay the outstanding amount of Rs. 43,54,223/- in accordance with the construction milestones as set out by the respondent. The complainant herself admitted in her complaint that she received the reminder notice sent by the respondent, which clearly proves that the demand letters and reminder notices were sent to her at the postal address she had given. Because she did not comply with the demand letters and reminder notices, her allotment may be cancelled. The complainant had assured that she would pay the first instalment of Rs. 6,29,482/- and the second instalment, being the remaining 50 per cent, and that she would pay the advance instalments on time. But being aggrieved by the complainant's non-payment under the 50:50 payment plan and several violations, and because the respondent has suffered loss as it earned no monetary benefit from the unit, the respondent cannot sell the unit to any other buyer until it cancels the allotment issued in the complainant's favour. Even after more than one year had passed, the complainant did not pay the outstanding dues, so despite several demand letters and reminder letters the respondent cancelled the unit on 34.03.2022. A copy of the cancellation notice, with the postal receipt and tracking report, is attached. After receiving the cancellation notice dated 34.03.2022, the complainant paid Rs. 2,50,000/- by cheque No.
264805 dated 37.03.2023 and Rs. 5,00,000/- by cheque No. 264805 dated 3.032023 [?], to keep the unit with her, which were cleared on 04.04.2022 and 25.04.2022. Although the complainant knew that the outstanding amount for the first instalment was Rs. 43,79,482/-, the amount she paid was less than the instalment amount under the payment plan. The complainant paid Rs. 6,29,482/-, and beyond that, although more than two years have passed, she has taken no step to pay the balance instalments outstanding. This clearly shows her malicious intention, and that she has not paid in accordance with the terms of the Agreement for Sale. It is also worth mentioning that the complaint was filed before this Authority on 03.04.2024, whereas the unit was cancelled by the notice dated 37.03.2022, which is earlier than the present complaint. Therefore this complaint is not maintainable, because the allotment of the unit has been duly cancelled in compliance with Section 4 (5) of the RERA Act. The respondent further states that although the complainant knew that the respondent had obtained all no-objection certificates from the competent development authority, the completion certificate of the project was obtained on 44.08.2023. The complainant has taken no step, nor asked the respondent to withdraw the final cancellation letter dated 34.03.2022.
After receiving the occupancy certificate from the competent authority, the respondent informed the complainant by e-mail on 24.08.2023 about the status of the occupancy certificate. Because the complainant intended from the beginning to default on payment, she ignored the numerous demand letters, reminder letters and interest letters, and did not pay on time under the 50:50 payment plan. Therefore the respondent cancelled the unit on 34.03.2022. Although two years have passed since the complainant's last payment, she has still not paid the outstanding amount for the unit, and has completely failed to perform her duties under the terms of the sale agreement and the application form. Because the complainant did not pay more than 70 per cent of the total sale value under the Agreement for Sale executed between the parties, the respondent has cancelled the unit. In view of these facts and circumstances, the respondent has requested that the complaint be dismissed. Under the Rules of the Real Estate (Regulation and Development) (Agreement for Sale) Rules, 2018, Sections 9.2 and 9.3 state as follows: "In case of Default by Promoter under the conditions listed above a non defaulting Allottee is entitled to the following:
i. Stop making further payments to Promoter as demanded by the Promoter. If the Allottee stops making payments, the Promoter shall correct the situation by completing the construction milestones and only thereafter the Allottee be required to make the next payment without any interest; or ii. The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +% unless provided otherwise under the Rules, within forty-five days of receiving the termination notice: Provided that where an Allottee does not intend to withdraw from the Project or terminate the Agreement, he shall be paid, by the Promoter, interest at the rate prescribed in the Rules, for every month of delay till the handing over of the possession of the [Apartment/Plot], which shall be paid by the Promoter to the Allottee within forty-five days of it becoming due." Section 9.3: "The Allottee shall be considered under a condition of Default, on the occurrence of the following events:
i. In case the Allottee fails to make payments for 2 (two) consecutive demands made by the Promoter as per the Payment Plan annexed hereto, despite having been issued notice in that regard the Allottee shall be liable to pay interest to the promoter on the unpaid amount at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +7% unless provided otherwise under the Rules. The Promoter must not be in default to take this benefit; ii. In case of Default by Allottee under the condition listed above continues for a period beyond 3 (three) consecutive months after notice from the Promoter in this regard, the Promoter may cancel the allotment of the [Apartment/Plot] in favour of the Allottee and refund the money paid to him by the Allottee by deducting the booking amount and the interest liabilities and this Agreement shall thereupon stand terminated. The Promoter must not be in default to take this benefit; Provided that the Promoter shall intimate the Allottee about such termination at least thirty days prior to such termination."
In the present case, under the payment plan stated in the Agreement for Sale signed by the complainant dated 3.08.2024, the complainant was to pay the amount due on the unit to the respondent. Of this, 40 per cent, that is Rs. 6,38,400/-, was payable on booking, and 40 per cent, that is Rs. 25,53,600/-, was payable within 45 days of booking, and the remaining 50 per cent, that is Rs. 32,8,775/-, was payable on receipt of the offer of fit-out letter. In the present case the total sale value of the unit was Rs. 64,73,775/-, against which the complainant has paid Rs. 32,47,337/- in instalments, as stated by the respondent. The respondent sent demand letters and reminder letters dated 42.40.2024 and 24.44.2024 to the complainant to pay the outstanding amount, but she did not pay, and by its final cancellation letter dated 34.03.2022 the respondent cancelled the allotment of the unit. The complainant filed the present complaint before the Authority on 03.04.2024, about two years after that. Accordingly, the process of cancelling the unit by the respondent is lawful, and the complainant has not performed her duties under the application form and the agreement. Point No. [?] is therefore disposed of. Disposal of Point No. 2 Point No. 2 has been framed to decide whether the complainant is entitled to the relief claimed. This point has been decided on the complainant's allegations, and the burden of proving them lies on the complainant.
The complainant states that she had booked Unit WI-T3-604 [?], having an area of i074 sq. ft., in the respondent's project ORGANIC HOMES. An Agreement for Sale was executed between the parties on 34.08.2024, under which the total price of the unit, including all charges, was Rs. 64,73,775/-, against which she paid Rs. 32,47,337/-. The respondent was to hand over possession of the unit by 28.03.2022, but it has not done so. The complainant has therefore requested possession of the unit along with interest for the delayed period.
In reply, the respondent has stated that the complainant applied through her application dated 26.07.2024 for Unit No. 3-60 [?], having an area of t995 sq. ft., and a total price of Rs. 64,73,775/-. In compliance with Section 43 of the RERA Act, 2016 [?], an Agreement for Sale was executed on 34.08.2024. Both parties, after mutual consent and finalising the terms, signed that agreement, and the complainant chose the 50:50 payment plan. The respondent sent two original copies of the agreement to the complainant for signature, but she kept them and did not return them for the company's signature. The complainant has paid Rs. 26,46,550/- (excluding taxes), while Rs. 38,57,225/- remains payable, and she is liable to pay Rs. 94,640/- as delayed interest. The respondent says the complainant has not paid the first instalment in full, and that up to 07.09.2024 she had paid only Rs. 49,02,264/-. The complainant was informed about the late fee and delayed interest, and the interest letter shows the total outstanding amount as Rs. 43,79,482/-. The complainant assured payment of the outstanding amount within one month but did not pay. The respondent sent reminder notices dated 22-40.2024 and 24.44.2024, giving the complainant an opportunity to pay the outstanding amount of Rs. 3,54,223/- as per the construction milestone. The complainant has admitted receiving the reminder notices, so her allotment could be cancelled. The complainant had assured payment of the first instalment of Rs.
6,20,482/- and the second instalment, being the remaining 50 per cent, but she did not pay. The respondent has suffered loss and cannot sell the unit to another buyer until the allotment issued to the complainant is cancelled. More than one year passed without payment, so the respondent cancelled the unit on 34.03.2022, with the postal receipt and tracking report attached. After receiving the cancellation notice, the complainant paid Rs. 2,50,000/- by cheque No. 264805 dated 37.03.2023 and Rs. 5,00,000/- by cheque No. 264805 dated 34.03.2023, which were cleared on 04.04.2022 and 25.04.2022. The complainant knew that the outstanding amount for the first instalment was Rs. 43,79,482/-, yet the amount she paid was less than the payment-plan instalment. The complainant paid Rs. 6,20,482/-, and for more than two years has taken no step to pay the balance instalments, which shows her malicious intention. The complaint was filed on 03.04.2024, whereas the cancellation was sent on 34.03.2022, before the complaint was filed. Therefore the complaint is not maintainable, as the allotment was duly cancelled in compliance with Section 4 (5) of the RERA Act. The respondent further states that the completion certificate was obtained on 44.08.2023. The complainant took no step to withdraw the cancellation or to request withdrawal of the final cancellation letter dated 34.03.2022. The respondent informed the complainant by e-mail on 24.08.2023 about the status of the occupancy certificate.
Because the complainant intended from the beginning to default on payment, she ignored the demand letters, reminder letters and interest letters. As she has not paid more than 70 per cent of the total sale value, the respondent cancelled the unit, and it requests dismissal of the complaint. Section 4 (5) of the RERA Act provides: "(5) The promoter may cancel the allotment only in terms of the agreement for sale: Provided that the allottee may approach the Authority for relief, if he is aggrieved by such cancellation and such cancellation is not in accordance with the terms of the agreement for sale, unilateral and without any sufficient cause." From the above provision it is clear that the respondent could cancel the allotment only in accordance with the terms of the agreement / allotment letter executed between the parties. In the application form dated 07.06.2024 [?], paragraph 4 is also relevant, and reads as follows:
"(14). 'Earnest Money shall be 10% of the total sale price. Timely payment of instalments as indicated in the payment plan is the essence of the allotment. If an installment is not paid on or before the due date, the company will charge SBI's MCLR+ % interest per annum on the delayed payment for the period of delay. However, if any installment remains in arrear for more than 30 days, the allotment will stand cancelled without any notice or liability of any kind, on the sole discretion of company. The Allottee in such an event happening, will have no lien further on the allotted unit. In such cases, the amount deposited up to 10% of total sales price of the unit, constituting the Earnest Money along with brokerage/facilitation charges (if any paid), will stand forfeited. The balance amount received, if any (over and above the earnest money) will be refunded without any interest after the resale of the apartment.'" From the above paragraph it appears that 10 per cent of the total sale price is the earnest money, and timely payment of the instalments under the payment plan is essential to the allotment. If any instalment remains in arrear for more than 30 days, the allotment may be cancelled at the sole discretion of the company, without any notice or liability, and the allottee then has no further lien on the unit. The amount of up to 10 per cent of the total sale price is forfeited, and any balance received is refunded without interest after resale of the apartment.
It is clear from the record that under the application form dated 07.06.2024 and the Agreement for Sale dated 34.08.2024 (Schedule-8, payment plan), the complainant was to pay her outstanding dues as per the payment plan, which she did not do. The respondent sent demand letters and reminder letters to the complainant several times, but she did not pay. Because of this, the respondent cancelled the complainant's allotment by its final cancellation letter dated 34.03.2022. The complainant then filed this complaint before the Authority on 03.04.2024. Section 2 (6) of the RERA Act reads as follows: "(6) 'allottee' in relation to a real estate project, means the person to whom a plot, apartment or building, as the case may be, has been allotted, sold (whether as freehold or leasehold) or otherwise transferred by the promoter, and includes the person who subsequently acquires the said allotment through sale, transfer or otherwise but does not include a person to whom such plot, apartment or building, as the case may be, is given on rent;"
From the above, it appears that the complainant does not fall within the category of allottee under Section 2 (9) of the RERA Act. The cancellation of the complainant's unit by the respondent is in accordance with Section 4 (5) of the RERA Act and with the terms of the allotment letter / agreement dated 34.08.2024. Therefore the complainant is not entitled to the relief claimed, and the present complaint is liable to be dismissed. Accordingly, Point No. 2 is disposed of. Order The complainant's complaint is dismissed. Upload this order on the portal, and consign the file to the record room. Date: [?] 57: 7 / 3/26 [?] T. Venkatesh (Member) U.P. परियोजना अभी भी अपूर्ण है, जिसमें ब्रोशर एवं उभयपक्ष के मध्य हुए समझौते में उल्लिखित सभी सुविधाएं तथा व्यवस्थाएं शामिल नहीं हैं। रेरा प्राधिकरण की तकनीकी ठीम द्वारा दिनांक 06.06.2022 को प्रश्नगत परियोजना का निरीक्षण किया गया, जोकि प्रश्नगत यूनिट का कब्जा दिये जाने नियत तिथि के बाद किया गया था। इससे यह भी सिद्ध होता है कि प्रतिवादी की परियोजना 06 जून 2022 को भी अपूर्ण थी, जिसकी प्रति उनके द्वारा संलग्न की गयी है। विपक्षी द्वारा प्राधिकरण की वेबसाइट पर प्रश्नगत परियोजना की पूर्ण होने की तिथि 30.09.2020 घोषित की थी, परन्तु कोविड-49 महामारी के बाद इसे दो बार बढ़ाकर दिनांक 28.03.2022 कर दिया गया है, जोकि रेरा अधिनियम, 2046 के तहत परियोजना का पंजीकरण भी वर्तमान समय में समाप्त हो चुका है, जिसके उपरान्त उनके द्वारा पंजीकरण नहीं कराया गया है, जोकिरेरा अधिनियम, 2046 की धारा-3 व 4 के प्रावधानों का उल्लंघन है। विपक्षी द्वारा शिकायतकर्ता को दिनांक 24.50.2024 को अनुस्मारक नोटिस जारी करते हुए, जिसमें उनके द्वारा 43,54,223,/- रुपये की मांग की गयी थी, वह नोटिस शिकायतकर्ता को वर्तमान समय में भी प्राप्त नहीं हुआ है तथा विपक्षी द्वारा शिकायतकर्ता को दिनांक 37.03.2022 को अवैध और अमान्य यूनिट का निरस्तीकरण नोटिस जारी किया था, जिसमें दिनांक 42.03.2022 के अनुस्मारक पत्र-4 एवं दिनांक 24.::.2022 के अनुस्मारक पत्र का उल्लेख था, जबकि शिकायतकर्ता को दिनांक 42.40.2024 का कोई अनुस्मारक पत्र प्राप्त नहीं हुआ। परियोजना का पंजीकरण निरस्त होने के बाद भी, विपक्षी रेराअधिनियम, 2046 की धारा-3 के अन्तर्गत शिकायतकर्ता से कोई राशि वसूल नहीं कर सकता है ।शिकायतकर्ता द्वारा दिनांक 40.04.2022 को विपक्षी के कार्यालय का दौरा किया गया एवं प्रश्नगत यूनिट का निरस्त करने का मुद्दा भी उठाया गया, जबकि उनके द्वारा दी गयी wat यूनिट के कब्जे की तारीख का उल्लंघन किया गया है, क्योंकि उभयपक्ष के मध्य समझौते में उल्लिखित समयानुसार परियोजना पूर्ण नहीं की गयी है और न ही परियोजना का निर्माण कार्य शुरू किए बिना उनके द्वारा उक्त यूनिट के सापेक्ष मांग पत्र प्रेषित किया गया है, जबकि उनके द्वारा प्रश्नगत परियोजना को शीघ्र पूर्ण किये जाने का आश्वासन दिया गया था और साथ ही शिकायतकर्ता से प्रश्नगत यूनिट के सापेक्षबकाया धनराशि के रूप में 42,50,000,/- रुपये की धनराशि का भुगतान करने और gerd यूनिट कानिरस्तीकरण करने के निर्णय ले लिया जायेगा, परन्तु विपक्षी द्वारा दिये गये आश्वासन के उपरान्त भी शिकायतकर्ता द्वाराविपक्षी को 42,50,000/—ead की धनराशि का भुगतान कर दिया गया है, जिसका विवरण उनके द्वारा संलग्न किया गया है। विपक्षी द्वारा यूनिट का निरस्तीकरण वापस नहीं लिया गया, जिसके उपरान्त उनके द्वारा वर्तमान शिकायत रेरा प्राधिकरण के समक्ष योजित की गयी है। विपक्षी ने शिकायतकर्ता की प्रश्नगत यूनिट के लिए अमान्य तथा अवैध रूप से निरस्तीकरण नोटिस जारी किया गया है, 2
