Ltd. 24.07.2023 The complainant's case under Section-63 was presented through video conferencing. On call, learned counsel Shri Manendra Kumar appeared on behalf of the complainant. Learned counsel Shri Asit Kumar appeared on behalf of the respondent. It was informed by the respondent that an appeal has been instituted by them in respect of the matter in question before the Hon'ble RERA Appellate Tribunal, Lucknow, the appeal number of which is Appeal No.- 400 / 2023, which is currently pending consideration. In respect of the said point, upon verification of the web portal of the Hon'ble RERA Appellate Tribunal, it was found that the said Appeal No.- 400 / 2023 is pending. In the described situation, at present there is no justification for passing any order under Section-63 in the matter in question. At present the file is kept in Abeyance. After receiving the final order from the RERA Appellate Tribunal, Lucknow, the complainant shall inform the Authority by filing a copy of the said order, after which an appropriate decision can be taken.
