Ltd. Order The complainant's complaint was presented for hearing through video conferencing. Upon call, learned counsel Mr. Punit Jain, proxy counsel for learned counsel Mr. Manendra Kumar, appeared on behalf of the complainant. C.S. Mr. Vijay Gupta appeared on behalf of the respondent. In the matter, on the previous date / hearing dated 20-03-2026, preliminary objection was raised by the C.S. of the respondent company to the effect that another complaint bearing No.: C-70/2024 regarding similar facts / relief has been instituted by the complainant before the Hon'ble State Consumer Disputes Redressal Commission, New Delhi and simultaneously the complaint in question has been instituted before this Bench, which is contrary to the Doctrine of Election. In light of the aforesaid facts, on the previous date / hearing dated 20-03-2026, the complainant was directed by the Bench to clarify within the next 02 weeks, uploading relevant evidence on the RERA complaint page and providing physical copies at the RERA Regional Office, Greater Noida, as to which of the two complaints pending between the present complaint and that before the Hon'ble State Consumer Disputes Redressal Commission, New Delhi they wish to pursue.

Pursuant to the above, today it was apprised by the learned counsel for the complainant that an application for withdrawal of case along with affidavit submitted before the Hon'ble State Consumer Disputes Redressal Commission, New Delhi has been uploaded on the RERA complaint page, physical copy of which was stated to have been provided at the RERA Regional Office, Greater Noida on dated 02-07-2026. Upon this, it was apprised by the C.S. of the respondent company that in the application for withdrawal of case submitted by the complainant before the Hon'ble State Consumer Disputes Redressal Commission, New Delhi, no final decision / order has been passed yet. Therefore, it would not be justified to take any further decision regarding the complaint in question; whereupon the learned counsel for the complainant requested 04 weeks' time to be granted to upload a copy of the final order passed by the Hon'ble State Consumer Disputes Redressal Commission, New Delhi on the RERA complaint page and provide a physical copy at the RERA Regional Office, Greater Noida, which is accepted. The C.S. of the respondent company strongly placed the fact that separate facts / pleadings are being submitted by the complainant before this Bench and before the Hon'ble State Consumer Disputes Redressal Commission, New Delhi, and the signatures on the BBA are also not identical.
