Ltd. Order The complainant's complaint was presented for hearing through video conferencing. Upon call, learned counsel Mr. Punit Jain, proxy counsel for learned counsel Mr. Manendra Kumar, appeared on behalf of the complainant. C.S. Mr. Vijay Gupta appeared on behalf of the respondent. In the matter, preliminary objection was raised by the C.S. of the respondent company to the effect that on the ground of default in payment by the complainant, booking of the unit in question was cancelled by the respondent company in the year 2024, the deposited amount of the complainant was refunded, and third-party rights and interests have already been created in the matter; another complaint bearing No.: C-70/2024 regarding similar facts / relief was instituted by the complainant before the Hon'ble State Consumer Disputes Redressal Commission, New Delhi, which is currently pending. The aforesaid statements made on behalf of the respondent have not been refuted by the learned counsel for the complainant. The complaint has already been submitted by the complainant before the Consumer Commission itself, which is pending. A question of jurisdiction is involved.

It would be appropriate to pass any interim order in the matter only after hearing both parties in detail. Therefore, the complainant is directed to clarify within the next 02 weeks, uploading relevant evidence on the RERA complaint page and ensuring physical copies are provided at the RERA Regional Office, Greater Noida, as to which of the two complaints pending between the present complaint and that before the Hon'ble State Consumer Disputes Redressal Commission, New Delhi they wish to pursue. Since, according to the statement of the respondent company, a physical copy of the preliminary objection has been filed by them regarding the complaint in question, but the said preliminary objection has not been uploaded on the portal by the respondent. Therefore, the respondent company is directed to ensure uploading the aforesaid preliminary objection on the RERA complaint page within the next 02 weeks; thereafter, within the subsequent 02 weeks, the complainant shall ensure uploading their written reply to the respondent's said preliminary objection on the RERA complaint page and providing a physical copy. Both parties are also directed to share their documents / pleadings with each other via email, and before the next fixed date, ensure providing physical copies of their documents / pleadings at the RERA Regional Office, Greater Noida, and upload proof of receipt on the portal.
