U.P. Real Estate Regulatory Authority Regional Office, Gautam Buddh Nagar Hearing Bench: Adjudicating Officer Proceedings under Sections 38 / 40 / 63 read with Rule 24 Serial No. 44. Complaint No. WM—NCR45/0/68874/202I Sandeep Sehta vs. Rise Projects Private Limited ORDER SHEET Date: 48.08.2026 The complainant's case was presented through video conferencing. The file was presented. On being called, learned advocate Shri Atul Kumar appeared for the complainant. Learned advocate Shri Puneet Jain appeared for the opposite party. Both parties were heard and the file was perused. In compliance with the order dated 49.05.2026, the RERA-authorised receiver has filed a report [?] dated 43.08.2026. Both parties sought time to file their objections to the said [?] report, which is granted. If the parties wish, they may file their objections to [?] within one month, by uploading them on the RERA portal and by filing them physically at the RERA office. The complainant has filed an application under Order 24 of the Code of Civil Procedure, Rule 44. If the opposite party wishes, it may file its objection to the said application within one month, by uploading it on the RERA portal and by filing it physically at the RERA office.
During the hearing, learned advocate Shri Puneet Jain for the opposite party stated that in this matter the unit/project has obtained OC/CC, which the opposite party filed with its reply on 22.07.2025. This makes it clear that the OC/CC for the said project unit was received on 49.08.2023. Today the complainant's learned advocate also accepted that the opposite party holds the OC/CC for the project unit, and that possession of the unit be handed over to him. The opposite party stated that the order dated 20.04.2025 clearly provided that the opposite party shall not collect holding charges from the complainant at Rs. 5 per sq. ft. per month, but shall be entitled to collect holding charges from the complainant at Rs. 2 per sq. ft. per month. However, on perusal of the file it is clear that on 23.02.2026 the complainant's learned advocate placed an incorrect fact before the Bench, namely that OC/CC had not been obtained. As a result, the order recorded that the opposite party would not be entitled to collect holding charges from the complainant. Therefore, in view of the order dated 20.04.2025 and the present OC/CC position, the order dated 23.02.2026 is recalled in respect of holding charges. The order dated 20.04.2025 shall remain effective in respect of holding charges, and the opposite party shall be entitled to collect holding charges from the complainant accordingly.
