Ltd. Order The complainant's case was presented for hearing through video conferencing. On being called, the complainant's learned advocate Shri Tushar Jeet Singh appeared. For the opposite party, Advocate Shri Puneet Jain appeared. On behalf of the complainant's learned advocate, a request was made for 02 weeks' time to upload the complainant's reply on the RERA complaint page to the objection filed by the opposite party, together with the additional written submissions signed by the complainant on each page as per rules, and to provide their physical copies at the RERA Regional Office, Greater Noida. This request is accepted. In the present case, the application dated 28-06-2025 filed by the opposite company for waiver / recall of the cost imposed against it by the Bench on 25-04-2025 is not justified. By its order dated 25-04-2025 the Bench had directed the opposite company to upload and file its objection regarding the complaint on the RERA complaint page within 02 weeks, that is, by the date 40-05-2025, but the opposite company uploaded and filed its objection on the RERA complaint page after extreme delay. Therefore, after hearing, the application for waiver / recall of the imposed cost is found unjustified and is dismissed.

Accordingly, the Secretary, U.P. RERA is directed to issue a recovery certificate for recovery of the cost of Rs. 5,000,//- imposed against the opposite company, in compliance with the order dated 25-04-2025. A copy of this order and of the said order dated 25-04-2025 shall be sent to the Secretary, RERA for further action. Both parties are further directed to share their documents and affidavits with each other by e-mail, and to ensure that physical copies of their documents and affidavits are made available at the RERA Regional Office, Greater Noida before the next date, and to upload proof of receipt on the portal. प्रकरण में विगत तिथि 25-04--2025 को पीठ द्वारा विपक्षी कम्पनी के विरूद्ध अधिरोपित खर्चा (Cost) को Waiver/Recall किये जाने हेतु, विपक्षी कम्पनी द्वारा दाखिल लिखित प्रार्थना-पत्र, दिनांक 28-06-2025 औचित्यपूर्ण नहीं है, क्योंकि आदेश, दिनांक 25-04-2025 में पीठ द्वारा विपक्षी कम्पनी को आगामी 02 सप्ताह अर्थात्‌ दिनांक 40-05-2025 तक प्रश्नगत शिकायत के सम्बन्ध में अपना आपत्ति-पत्र रेरा कम्प्लेन्ट पेज पर अपलोड एवं दाखिल करने हेतु आदेशित किया गया, परन्तु विपक्षी कम्पनी द्वारा अत्यधिक विलम्ब से अपना आपत्ति-पत्र रेरा कम्प्लेन्ट पेज पर अपलोड एवं दाखिल किया गया, जिसके उपरान्त विपक्षी कम्पनी द्वारा अधिरोपित खर्चा (Cost) को Waiver/Recall किये जाने का अनुरोध किया जा रहा है। अतः अधिरोपित खर्चा (Cost) को Waiver/Recall किये जाने सम्बन्धी प्रार्थना-पत्र को सुनवाई के उपरान्त अनुचित पायें जाने के कारण खारिज किया जाता है। अतः सचिव, उ.प्र. रेरा को निर्देशित किया जाता है कि वह पीठ द्वारा पारित आदेश, दिनांक 25-04-2025 के अनुपालन में विपक्षी कम्पनी के विरूद्ध अधिरोपित खर्चा (Cost) रू.5,०००,//- की वसूली हेतु, वसूली प्रमाण-पत्र जारी करायें। इस आदेश एवं उक्त आदेश, दिनांक 25-04-2025 की एक प्रति सचिव, रेरा को अग्रिम कार्यवाई हेतु प्रेषित की जाये। उभय पक्षों को यह भी निर्देशित किया जाता है कि वे अपने दस्तावेज,/अभिकथनों को आपस में ई-मेल के माध्यम से साझा करें तथा अग्रिम नियत तिथि से पूर्व अपने दस्तावेज /अभिकथनों की भौतिक प्रतियाँ रेरा क्षेत्रीय कार्यालय, ग्रेटर नोएडा में उपलब्ध कराना सुनिश्चित करें और प्राप्ति का प्रमाण भी पोर्टल पर अपलोड करें। पत्रावली अग्रिम कार्यवाही हेतु, नियत तिथि 03-20-2025 को पेश हो।
