U.P. Real Estate Regulatory Authority, Regional Office, Gautam Buddh Nagar Hearing Bench-2 (formerly Bench-4) Order under Section 34 read with Section 37 Presiding Officer: Shri T. Venkatesh, Member Complaint No.: NCR44/09/23390/2024 Shweta Agarwal and Rajni Agarwal vs. M/s Rise Projects Pvt. Ltd. The present complaint application has been instituted by the complainant against the opposite party seeking possession of the unit in question, along with interest for the delayed period, and execution of the registry. In brief, the complainant's statement is that on 09.05.2048 they booked unit no. [?] 3-TS-G02 in Tower-5 of the opposite party's project Rise Resort Residences Phase-I (registration no. [?]). The total value of the unit was Rs. 78,76,300/-, against which they paid Rs. 73,44,472/- to the opposite party from time to time in installments.
The complainant also states that, despite a delay of about 05 years, the opposite party is offering possession of the unit on 02 September, 2024 without completing construction of the project, is not paying delay interest for the delay in handing over possession, and is demanding the balance amount due. Further, the opposite party has not yet obtained OC/CC for the project from the competent development authority. For this reason the complainant has filed this complaint under the Real Estate (Regulation and Development) Act for possession of the unit along with interest for the delayed period and execution of the registry against the opposite party. In support of their statement, the complainant has filed photocopies of records including the detailed written complaint, the booking form dated 09.05.2048, the flat buyer agreement dated [?] 06.2048, a letter dated 20.02.2025 sent to the opposite party seeking handover of possession of the unit, receipts of amounts paid to the opposite party, and other records.
The opposite party, by its written reply to the complaint in question, has stated that the project 'RISE RESORT [?] (Sector Techzone-4, Greater Noida)' is registered with RERA under registration no. WTI-UPRERAPRI7S6!. The complainant had booked unit no. [?]-3-75-502 in the said project, against which a flat buyer agreement was executed between the parties on 08.06.2048. As per clause 9.4 thereof, the opposite party was to hand over possession of the unit by 30.42.2022, with a grace period of 06 months. The complainant has attempted to mislead the Hon'ble RERA Bench, and has stated the date for handing over possession under the agreement as 34.04.2020, which is incorrect. The complainant has claimed payment of Rs. 73,4,472/- against the total sale value of the unit, but has produced no evidence in this regard. On 02.09.2024 the opposite party sent an offer for fit-out possession and a final demand letter, requesting that the complainant obtain possession of the unit after paying the balance amount due; however, the complainant has not paid the balance amount due. The opposite party has completed construction of the project and the said unit is ready for possession. However, due to an ongoing dispute relating to land, the opposite party has not obtained OC for the project.
The opposite party has also stated that, due to environmental pollution, the Hon'ble National Green Tribunal from time to time completely banned construction activities in Delhi-NCR, which adversely affected the progress of the project. It has further been stated that the Government of India adopted some of the strictest measures in the world to stop the spread of COVID-19[?], and from 24 March, 2020 a nationwide lockdown was declared, which was extended by various notifications. Because construction material was not available, construction activities were completely obstructed for more than 446 days, which caused delay in completing the project. The opposite party says that the reason for the delay in the project is the failure of the complainant and several other allottees to pay their balance dues on time, which has fully affected the progress of the project. In view of the above facts, the opposite party has requested that in the complaint in question the complainant be directed to pay the balance dues and obtain possession of the unit.
In support of its statement, the opposite party has filed photocopies of records including its written reply dated 44.07.2025, the flat buyer agreement dated 08.06.2048, the order dated 40.05.2023 passed by the Hon'ble High Court at Allahabad in Writ Petition No. 8428/2023 "Archana Tyagi vs. State of U.P.", the fit-out letter dated 02.09.2024, the final demand letter dated 02.09.2024, various orders passed by the Greater Noida Industrial Development Authority, copies of orders passed by the Hon'ble RERA Bench, the orders dated 06.06.2020 and 48.08.2024 passed by the RERA office, and other records. In support of its statement, the complainant has filed a rejoinder stating that they booked the unit in the said project of the opposite party on 09.05.20i8, against which a flat buyer agreement was executed between the parties on 08.06.2048. According to it, the opposite party was to complete construction of the project and hand over possession of the unit to the complainant by 34.07.2049. The complainant has paid 95 per cent of the total sale value of the unit to the opposite party by 23.06.208 under the down-payment plan. Under clauses 40.4 and 0.2 of the flat buyer agreement executed between the parties, the date fixed for offering fit-out possession was 30.07.2049. Accordingly, the complainant has requested that possession of the unit be given along with interest for the delayed period as per clauses 40.4 and 40.2 of the agreement.
The arguments of both parties were heard and the evidence available on the file was perused, on the basis of which the following point has been framed: 4. Whether the complainant should be granted possession and interest for the delayed period? If so, what will be the rate of interest? Point for determination No. 4 is framed to the effect of whether the complainant should be granted possession and interest for the delayed period, and if so, at what rate. This point is framed on the complainant's averments, and the burden of proving it lies on the complainant. The complainant has stated that they booked a unit in the opposite party's project on 09.05.20:8, against which a flat buyer agreement was executed between the parties on 08.06.2048. According to it, the opposite party was to complete construction of the project and hand over possession of the unit to the complainant by 34.07.20I9. The complainant has paid 95 per cent of the total sale value of the unit to the opposite party by 23.06.2048 under the down-payment plan. Under clauses 40.4 and 40.2 of the flat buyer agreement executed between the parties, the date fixed for offering fit-out possession was 30.07.2049 [?]. Accordingly, the complainant has requested possession of the unit along with interest for the delayed period as per clauses 40.4 and 40.2 of the agreement.
In reply to this, the opposite party filed its written reply stating that the complainant had booked unit [?]-Street-3-TS-702 in the said project, against which a flat buyer agreement was executed between the parties on 08.06.2048. The opposite party's position is that the delay in the project was caused by the failure of the complainant and several other allottees to pay their balance dues on time, which fully affected the progress of the project. In view of the above facts, the opposite party has requested that the complainant be directed to pay the balance dues and obtain possession of the unit.
Section 48(II) of the RERA Act provides: "8 (4): If the promoter fails to complete or is unable to give possession of an apartment, plot or building,- (a) in accordance with the terms of the agreement for sale or, as the case may be, duly completed by the date specified therein; or (b) due to discontinuance of his business as a developer on account of suspension or revocation of the registration under this Act or for any other reason, he shall be liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice to any other remedy available, to return the amount received by him in respect of that apartment, plot, building, as the case may be, with interest at such rate as may be prescribed in this behalf including compensation in the manner as provided under this Act: Provided that where an allottee does not intend to withdraw from the project, he shall be paid, by the promoter, interest for every month of delay, till the handing over of the possession, at such rate as may be prescribed." Accordingly, the allottee has the right that if possession is not given in accordance with the agreement, they may demand return of the amount deposited with interest, or remain in the project receiving interest for each month of delay. However, in the case in question the complainant has requested possession of the unit and interest for the delayed period.
It is clearly stated in Section [?]—(4)(b) of the Real Estate (Regulation and Development) Act, 20:6 that it shall be the obligation of the promoter to obtain the OC/CC of the project and make it available to the allottee. Clause 7.2 of the U.P. Real Estate (Regulation and Development) (Agreement for Sale/Lease) Rules, 2048, in respect of the offer of possession, provides that only after obtaining OC/CC of the project will the promoter offer possession of the unit to the complainant (allottee) in writing. On the file the complainant has filed a photocopy of the allotment-cum-flat buyer agreement dated 08.06.2048, executed between the parties. Its possession clause [9.[?]] shows that the opposite party was to complete construction of the project and make possession of the said unit available to the complainant by 30.06.2022. Accordingly, as stated above, the complainant was entitled to possession of the unit by 30.06.2022, but the opposite party has not handed over possession within the stipulated period. As regards up to what period interest for the delayed period should be awarded, the Hon'ble Supreme Court has held in Civil Appeal No. 6649-50/2048, "Supertech Limited vs. Rajni Goyal", that:
"the period of Interest should close on April 2016 when the Full Occupancy Certificate was obtained as per the admission of the Respondent — Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant — Builder had obtained the Completion Certificate as late as April 2016. The Respondent — Purchaser could not have any further grievance after April 2016 with respect to delay in handing over possession. The Respondent — Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession." As per the above legal position, the complainant shall be entitled to delay interest up to the date of receipt of OC or offer of possession, whichever is later. It is clear that the opposite party has not completed the project as per the agreement. In such a case it appears just to award the complainant interest for the delayed period from 07.07.2022 up to the date of receipt of OC/CC or offer of possession, whichever is later. In this regard it is noteworthy that, in the petition of the Bombay High Court in "Neelkamal Realtors Suburban Pvt. Ltd. and Others vs. Union of India", the Hon'ble High Court has held that:
"Section 18(1)(b) lays down that if the promoter fails to complete or is unable to give possession of an apartment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. If the allottee does not intend to withdraw from the project he shall be paid by the promoter interest for every month's delay till handing over of the possession. The requirement to pay interest is not a penalty as the payment of interest is compensatory in nature in the light of the delay suffered by the allottee who has paid for his apartment but has not received possession of it. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable." Accordingly, in light of the above judgment, it is clear that under the provisions of U.P. RERA, interest on the delay and on the principal amount shall be payable as per the agreement between the promoter and the buyer, because the promoter has used the said amount. Section 2(za) of the RERA Act provides: "(za) 'interest' means the rates of interest payable by the promoter or the allottee, as the case may be. Explanation.—For the purpose of this clause—
(i) the rate of interest chargeable from the allottee by the promoter, in case of default, shall be equal to the rate of interest which the promoter shall be liable to pay the allottee, in case of default; (ii) the interest payable by the promoter to the allottee shall be from the date the promoter received the amount or any part thereof till the date the amount or part thereof and interest thereon is refunded, and the interest payable by the allottee to the promoter shall be from the date the allottee defaults in payment to the promoter till the date it is paid;" As regards the rate of interest payable, the State Government, under the Real Estate (Regulation and Development) Act, 20:6, notified on 47.40.2048 the Real Estate (Regulation and Development) (Sale/Lease Agreement) Rules, 20i8. In the sale/lease deed format annexed to them, the Events of Default of promoters are defined in clause 9, under which clause 9.2(II) provides for the allottee, in the event of the promoter's default, that: "The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:"
The same rate is also prescribed in clause 9.3(i) for default by allottees. Having regard to that provision, it appears just to award the allottee interest for the delayed period at the rate of MCLR+1[?] per cent. It is also clarified that if there is delay in any amount due from the complainant, the opposite party too may recover interest only at the rate of MCLR+1[?] per cent. This has also been held to be proper and lawful by the Hon'ble High Court at Allahabad in Writ Petition No. C-9420/2020, "Habitech Infrastructure Ltd. Versus State of U.P. & Ors." In such circumstances, the annual interest rate fixed under the Real Estate (Regulation and Development) (Sale/Lease Agreement) Rules, 2048, notified by the U.P. State Government, which is MCLR+[?]7 per cent and is somewhat higher than the maximum interest rate of the State Bank of India, is just and correct. Further, by notification No. 4740/8--3-48-65 Miscellaneous/46 of the U.P. Government Housing and Urban Planning Department, Section-3, dated 47.40.2048, the following has been stated regarding force majeure in clause 7 of the model agreement:
"7. POSSESSION OF THE APARTMENT/PLOT: 7.1 Schedule for possession of the said [Apartment/Plot] - The Promoter agrees and understands that timely delivery of possession of the [Apartment/Plot] to the Allottee and the Common Areas to the association of Allottees or the competent authority, as the case may be, is the essence of the Agreement. The Promoter assures to hand over possession of the [Apartment/Plot] along with ready and complete Common Areas with all specifications, amenities and facilities of the Project in place on , unless there is delay or failure due to war, flood, drought, fire, cyclone, earthquake or any other calamity caused by nature affecting the regular development of the real estate project ("Force Majeure"). If, however, the completion of the Project is delayed due to the Force Majeure conditions then the Allottee agrees that the Promoter shall be entitled to the extension of time for delivery of possession of the [Apartment/Plot]."
Following on from this, after all relevant facts were considered, the U.P. RERA Authority by its order dated 06.06.2020, due to the effect of COVID-49 (Corona Virus Disease), granted an additional period of 6 months from 25.03.2020, i.e. up to 25.09.2020, for completing projects, and this period shall be treated as due to force majeure. Having regard to this, no interest for the delay in the project from 25.03.2020 to 25.09.2020 shall be paid by the promoter to the allottees, and no delay interest shall be taken from the complainant. Accordingly point No. 4 is disposed of. Disposing of the above point, the following order is passed: Order 4. The opposite party is directed to ensure that, within 45 days of the date of uploading of this order on the portal, the complainant's unit is completed with all facilities as per the allotment letter / agreement, that the physical possession of the said unit is given along with OC/CC, and that, after receiving the payable stamp duty from the complainant, the registry is executed in the complainant's favour as per rules.
2. The opposite party is directed to ensure payment to the complainant of interest for the delayed period at the rate of MCLR+1[?] per cent per annum on the amount deposited by the complainant, from 04.07.2022 up to the date of receipt of legal OC/CC or the date of offer of the legal possession letter, whichever is later. As regards the interest for the delay in the project from 25.03.2020 to 25.09.2020, in view of the COVID-49 situation, no interest shall be given to the complainant by the promoter, nor shall any delay interest be taken from the complainant. 3. The opposite party is also directed that, as per Section 2(4)6) of the RERA Act, 2046, if after the RERA came into force any interest rate is charged by the promoter from the allottee for default, the same rate shall be paid by the promoter to the allottee on the promoter's default. Accordingly, on delayed payment the complainants shall also be liable to pay interest at the rate of [?]+7[?] per cent. If any amount has been charged from the allottee at a higher rate for delay after the RERA came into force, the interest for the delayed period shall also be calculated at that same rate. 4. The opposite party is directed to ensure that, while handing over physical possession of the unit in question along with legal OC/CC to the complainant, it receives all charges only in accordance with the payment plan / conditions stated in the flat buyer agreement.
5. Violation of this order shall be punishable under Sections 38, 40 and 63 of the Real Estate (Regulation and Development) Act, 2046 and other relevant provisions. 6. The complainant is directed that if the opposite party does not comply with the above order within 45 days, the complainant shall upload a request for enforcement of the order through the RERA portal and ensure that a physical copy is made available to the RERA Regional Office, Greater Noida. Order to be uploaded on the portal. File to be consigned to record accordingly. T. Venkatesh (Member) U.P. Real Estate Regulatory Authority

में प्राविधान है कि :- Page 4 0 8 (4) “If the promoter fails to complete or is unable to give possession of an apartment, plot or building,- (a) in accordance with the terms of the agreement for sale or, as the case may be, duly completed by the date specified therein; or (b) due to discontinuance of his business as a developer on account of suspension or revocation of the registration under this Act or for any other reason, he shall be liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice to any other remedy available, to return the amount received by him in respect of that apartment, plot, building, as the case may be, with interest at such rate as may be prescribed in this behalf including compensation in the manner as provided under this Act: Provided that where an allottee does not intend to withdraw from the project, he shall be paid, by the promoter, interest for every month of delay, till the handing over of the possession, at such rate as may be prescribed.
"the period of Interest should close on April 20I6 when the Full Occupancy Certificate was obtained as per the admission of the Respondent — Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant — Builder had obtained the Completion Certificate as late as April 20l6. The Respondent — Purchaser could not have any further grievance after April 20!6 with respect to delay in handing over possession. The Respondent — Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession." आदि बनाम यूनियन ऑफ इंडिया” की याचिका में माननीय उच्च न्यायालय द्वारा अभिनिर्धारित किया गया है कि — "Section |8(])(b) lays down that if the promoter fails to complete or is unable to give possession of an aprtment due to discontinuance of his business as a developer on account of suspension or revocation of the registration
under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. If the allottee does not intent to withdraw from the project he shall be paid by the promoter interest for every month's delay till handing over of the possession,. The requirement to pay interest is not a penalty as the payment of interest is compensatory in nature in the light of the delay suffered by the allottee who has paid for his apartment but has not received possession of it. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable." अतः उपरोक्त निर्णय के आलोक में यह स्पष्ट है कि उ.प्र. रेरा के प्रावधानों के अन्तर्गत प्रमोटर व क्रेता के मध्य किये गये अनुबन्ध के अनुरूप विलम्ब तथा मूल धनराशि पर ब्याज देय होगा, क्योंकि प्रमोटर्स द्वारा उक्त धनराशि का उपभोग किया गया है। RI एक्ट की धारा-2(29) में प्राविधान है कि :- (za) "interest" means the rates of interest payable by the promoter or the allottee, as the case may be. Explanation.—For the purpose of this clause— (i) the rate of interest chargeable from the allottee by the promoter, in case of default, shall be equal to the rate of interest which the promoter shall be liable to pay the allottee, in case of default;
(ii) the interest payable by the promoter to the allottee shall be from the date the promoter received the amount or any part thereof till the date the amount or part thereof and interest thereon is refunded, and the interest payable by the allottee to the promoter shall be from the date the allottee defaults in payment to the promoter till the date it is paid; में प्रमोटर के डिफाल्टर ६ ef होने की स्थिति में आवंटी हेतु प्राविधानित है किः- 3 Page 7 : Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:"'
9420 / 2020, “Habitech Infrastructure Ltd.
