In response, the opposite party, by its objection dated 27-04--2026, has stated that, after both parties have uploaded and filed all their respective documents / submissions on the RERA complaint page (Pleadings Complete), the acceptance of any fresh relief is illegal. If the Bench accepts the said amendment application, the nature of the case will change completely. On these grounds, it has requested that the complainant's said amendment application be dismissed as not maintainable. Today, in the matter, the amendment application for relief dated 49-04-2026 uploaded on the portal by the complainant's learned advocate, and the objection dated 27-04--2026 uploaded on the portal by the opposite company against that amendment application, were heard in detail from the learned advocates of both parties. From the order passed by the Bench dated 47-09-2025, it is clear that on that date, apart from the opposite company's learned advocate not having a proper vakalatnama, both parties had already uploaded and filed all their respective documents / submissions on the RERA complaint page (Pleadings Complete). In such a situation, the matter cannot be treated as complete (Pleadings Complete). Further, the demand letter issued by the opposite party dated 40-04-2025 is after the date of filing of the complaint, 3i-07-2024, and thus gives rise to a fresh cause of action.
