Both parties were heard, and the application available on the case file was examined. It became evident that the respondent received financial assistance from swamih Investment Fund-I on 28.05.2024 to complete the project, pursuant to which funds have been released to the respondent. In this regard, U.P. RERA Office Order Letter No. 8553 / U.P. RERA / Administrative Cell / 2023-24, dated 20.06.2023, provides that, during construction and development work in a project financed by the SWAMIH[?] Fund, the allottees of the project should generally not be permitted to withdraw from the project and obtain refunds. Even in cases in which refund orders have already been passed in favour of the allottees, applications for enforcement of the orders shall be kept on hold. Accordingly, pursuant to the said RERA Office Order dated 20.06.2023, Letter No. 8653 / U.P. / Administrative Cell / 2023-24, and the final sanction letter dated 47.07. 2023 issued concerning the SWAMIH Fund, the present matter is kept in /70/059[?] (abeyance) until July 2025.
