On perusal of the case file, it was found that the complainant had not impleaded Rupa Gupta, the co-allottee named in the agreement, as a party to the present matter. Regarding impleading the co-allottee in the matter, the Uttar Pradesh Real Estate Regulatory Authority provided in its office order dated 05.03.2024 that “if the complainant has not added the name of the co-allottee on the complaint page, it is necessary to add the name of the co-allottee also as a complainant in all such complaints.” Accordingly, the complainant is directed to ensure that an application to add the co-allottee's name as a party in the present matter is uploaded on the RERA portal and a copy is also provided to the opposite party. In addition, before the scheduled date, the complainant shall upload on the RERA portal authentic evidence, including a copy of the receipt, for the amount of Rs. 47,42,660 paid to the opposite party, as shown on the complaint page.
