On being called, Mr. Gatik Sharma, proxy counsel for Mr. Harpreet Singh Arora, learned counsel for the complainant, appeared. The respondent was absent. A notice and public notice shall be issued to the respondent for appearance by registered post. The complainant has informed the Authority in the case that, against the total price of unit number i20i, namely Rs.27,03,870,//-, an amount of more than 40 percent, namely Rs.4,84,383 /—, has been paid, but the respondent company has not executed and signed an allotment letter / B.B.A. / Agreement for Sale between the parties in respect of the unit in question in compliance with Section-43 of the RERA Act, 20:6.

The respondent is directed that, within the next 03 weeks, it shall upload on the RERA Complaint Page its objection, along with its authority letter / vakalatnama, and a written explanation stating why and under what circumstances, after the complainant paid more than 40 percent of the total price of the unit in question, it did not execute an allotment letter / B.B.A. / Agreement for Sale between the parties in respect of that unit in compliance with Section-43 of the RERA Act, 206. It shall ensure that physical copies are submitted at the RERA Regional Office, Greater Noida. It shall also ensure that its objection states its explanation regarding the amount paid by the complainant, as recorded on the RERA Complaint Page. Thereafter, within the next 02 weeks, the complainant shall upload a rejoinder to the respondent's objection on the RERA Complaint Page and ensure that a physical copy is submitted at the RERA Regional Office, Greater Noida. Upon hearing the complainant's facts and arguments in detail and reviewing the records, it was found that, prima facie, the case, the balance of convenience, and the irreparable loss are all in favour of the complainant. Accordingly, the respondent company is directed to maintain the status quo in the case until the next date fixed.

Both parties are also directed to share their documents/pleadings with each other by email and to ensure that, before the next date fixed, they submit physical copies of their documents/pleadings at the RERA Regional Office, Greater Noida and upload proof of receipt on the Portal.
