ORDER The complainant's complaint was presented for hearing through video conferencing. On call, learned counsel Mr. Manendra Kumar appeared on behalf of the complainant. Learned counsel Mr. Asit Kumar appeared on behalf of the respondent. During the pendency of the hearing of the verre complaint, a settlement agreement was executed and signed by both parties on date 33-40-2023, following which during the hearings on date 02-02-2024 and date oi-05-2024, the then learned counsels for the complainant Mr. Rakesh Taneja and Ms. Reema Chauhan requested time to comply with and study the terms recorded in the said settlement agreement dated 34-40-2023, which was accepted by the Bench; however, it has not been clarified by the complainant in written pleadings and oral caf which terms/clauses of the vat settlement agreement dated 3:-70-2023 have not been ensured to be complied with by the respondent company up to the present time.

Therefore, the complainant is ordered to ensure uploading a written clarification on the RERA complaint page within the next 02 weeks, and providing a physical copy at the RERA Regional Office, Greater Noida, stating which terms/clauses of the said settlement agreement dated 33-40-2023 have not been complied with by the respondent company at present, so that the updated status may become clear. In addition, since due to new circumstances, the respondent company uploaded their additional objection letter dated 04-05--2026 on the RERA complaint page and filed a physical copy regarding the serra complaint, upon which on the hearing date 06--05-2026 the learned counsel for the complainant requested 02 weeks' time to upload their additional reply to the respondent's said additional objection letter on the RERA complaint page and file a physical copy, which was accepted by the Bench; however, the learned counsel for the complainant has not uploaded their additional reply on the RERA complaint page and filed a physical copy in support of their aforesaid submission.

Therefore, giving the complainant a final opportunity again, they are directed that if they wish, they may within the next 02 weeks ensure uploading their additional reply on the said additional objection letter dated 04-05-2026 of the respondent company and regarding which terms/clauses of the settlement agreement dated 34-70-2023 were not complied with on the RERA complaint page, and make a physical copy available at the RERA Regional Office, Greater Noida. Both parties are also directed to share their documents/pleadings with each other via email. The file be presented for further proceedings on the fixed date 07-20-2026.
