U.P.[?] Real Estate Regulatory Authority, Regional Office, Gautam Buddh Nagar Hearing Bench-04E[?] Order under Sections-38 /40 / 63 Mr. Rajiv Kumar, Hon'ble Chairman Complaint Number: NCR44/03/7998/202I Vijendra Pal Versus La Residencia Developers Pvt. Ltd.[?] In this matter, after hearing the arguments of both parties, the Bench reserved the case file for orders on 30.05.2023. During the hearing on that date, the respondent stated that it would provide the complainant possession of the unit in question by June, 2025. The respondent was directed to comply fully with the order previously passed by the Bench under Section-34 and upload its compliance report/reply to the RERA[?] complaint page[?] by 05.06.2023. Accordingly, the respondent has filed its written reply. The main purpose of the Real Estate (Regulation and Development) Act, 20i6, is to protect consumers' interests in the real estate sector and ensure speedy disposal of disputes. To fulfil this purpose, the Authority has been given responsibilities and powers under the RERA Act. Section-34(8) of the Real Estate (Regulation and Development) Act, 20I6, sets out the Authority's functions. Section 34(8) contains the following provision: “34(g). to ensure compliance of its regulations or orders or directions made in exercise of its powers under this Act;”
Under the provision of Section-38 of the Real Estate (Regulation and Development) Act, 20i6, the Authority has been empowered to impose a penalty or interest under this Act and the rules and regulations made under it if the promoter violates the obligations placed upon it. Section-38 of the RERA Act is as follows: “38. (4) The Authority shall have powers to impose penalty or interest, in regard to any contravention of obligations cast upon the promoters, the allottees and the real estate agents, under this Act or the rules and the regulations made thereunder. (2) The Authority shall be guided by the principles of natural justice and, subject to the other provisions of this Act and the rules made thereunder, the Authority shall have powers to regulate its own procedure. (3) Where an issue is raised relating to agreement, action, omission, practice or procedure that— (a) has an appreciable prevention, restriction or distortion of competition in connection with the development of a real estate project; or (b) has the effect of a market power of monopoly situation being abused for affecting the interest of allottees adversely, then the Authority may, suo motu, make reference in respect of such issue to the Competition Commission of India.” Section-40 of the RERA Act is as follows:
“40. (I) If a promoter or an allottee or a real estate agent, as the case may be, fails to pay any interest or penalty or compensation imposed on him by the adjudicating officer or the Regulatory Authority or the Appellate Authority, as the case may be, under this Act or the rules and regulations made thereunder, it shall be recoverable from such promoter or allottee or real estate agent, in such manner as may be prescribed, as arrears of land revenue. (2) If any adjudicating officer or the Regulatory Authority or the Appellate Tribunal, as the case may be, issues any order or directs any person to do any act, or refrain from doing any act, which it is empowered to do under this Act or the rules or regulations made thereunder, then in case of failure by any person to comply with such order or direction, the same shall be enforced in such manner as may be prescribed.” Section-63 of the Real Estate (Regulation and Development) Act, 2046, empowers the Authority to impose a penalty on the promoter of up to 5 per cent of the estimated cost of the promoter's real estate project if the promoter fails to comply with the Authority's order. Section-63 is as follows:
“63. If any promoter fails to comply with, or contravenes, any of the orders or directions of the Authority, he shall be liable to a penalty for every day during which such default continues, which may cumulatively extend up to five per cent of the estimated cost of the real estate project as determined by the Authority.” It is pertinent to mention here that Section-40 of the Real Estate (Regulation and Development) Act, 20i6, falls under Chapter-5, which concerns the Real Estate Regulatory Authority, whereas Section-63 of the Real Estate (Regulation and Development) Act, 2046, falls under Chapter-8, which concerns offences, penalties and adjudication. The above provisions make it clear that, under the RERA Act, the Authority is empowered to enforce its orders under Section-40 when the promoter fails to comply with them, and to impose a monetary penalty on the promoter under Section-63. The Authority can conduct both proceedings simultaneously.
The first wave of COVID--49 (Corona Virus Disease) adversely affected the construction work of projects. Accordingly, following the directions issued by the Central Government and after considering the relevant facts, the Uttar Pradesh Real Estate Regulatory Authority passed an order on 06.06.2020 granting an additional period of 6 months from 25.03.2020, namely until 25.09.2020, for completing projects owing to the effects of COVID-49 (Corona Virus Disease). Subsequently, the second wave of COVID-49 (Corona Virus Disease), which became effective from April 2024, also adversely affected the construction work of projects. In addition, the third wave of COVID-49 (Corona Virus Disease) is currently prevalent and is also obstructing the completion of projects. These circumstances fall within the definition of force majeure. The arguments of both parties were heard and the case file was examined. In the present matter, the complainant submitted an application through the RERA portal for implementation of the order. The Authority accordingly issued a notice to the respondent, directing compliance with the said order by 05.02.2023 and submission of a compliance report. However, the respondent did not furnish a compliance report. The Authority issued a show-cause notice on 09.02.2023, directing the respondent to comply with the said order by 25.02.2023 and submit a compliance report. However, the respondent has not filed any compliance report/reply.
The Authority issued a notice under Section-63, pursuant to which the Bench held hearings on 25.04.2023 and 30.05.2023. The respondent filed a written reply stating that Phase-4 of the project has a total of i8 towers (Tower-4 to 48), containing 4,408 units. O.C.s have already been obtained for 42 of these towers, and applications have been submitted to the Greater Noida Industrial Development Authority for obtaining O.C.s for the remaining towers. Possession of units is being given in the towers for which O.C.s have been obtained, and possession of 4260 units has been given at present. Phase-2 of the project has a total of 44 towers (Tower-49 to 29), in which finishing work is underway, and possession of the unit will be given by June, 2024 + 6 months' grace period. Phase-3 of the project has a total of t0 towers (Tower-30 to 39), in which finishing work is underway, and possession of the unit will be given by June, 2025 + 6 months' grace period, with possession along with all amenities to be given by December, 2025. On these grounds, the respondent requested that the complainant be directed to pay the outstanding amount and obtain possession of the unit in question. However, the respondent has not furnished any compliance report demonstrating full compliance with the order dated 24.05.2022 previously passed by the Bench. This shows that, despite being given adequate opportunities, the respondent has not complied with the order dated 24.05.2022 previously passed under Section-34.
In view of all the facts and circumstances described above, the Secretary, RERA, shall have a recovery certificate issued in this matter for the amount deposited together with interest, in accordance with point No.-4 of the directions on page No.-45 of the order dated 24.05.2022. The case file shall be placed before the Authority for imposition of an appropriate monetary penalty against the respondent/promoter under Section-63 of the RERA Act, 2046. The order shall be uploaded to the portal. Date -/2 /68 /2023 (Rajiv Kumar) (Chairman) Uttar Pradesh Real Estate Regulatory Authority
