Real Estate Regulatory Authority, Regional Office, Gautam Buddha Nagar Hearing Bench-2 Proceedings under Section-34 30-Complaint Number: -- NCRI44/0/87842/2022 Satish Pathak Versus Alpine Infraprojects Private Limited Date: - 30/06/2025 Order-Sheet Against the order dated 8.0.2022 passed under Section-34 by the Bench in the complaint in question, in Appeal No. 4/2023 filed by the complainant before the Hon'ble Appellate Tribunal, Lucknow, the order dated 27.04.2025 was passed setting aside the order dated 8.40.2022 passed under Section-34 by the Bench, and the RERA Authority was directed: (iii) RERA Authority shall proceed against the promoter under Chapter - VIII of the Act, 206 for imposition of Penalty after due process; (iv) cost of litigation assessed at Rs. 20,000/- to be paid to the appellant/allottee by the respondent/promoter within forty five days. In sequence of the above, the case in question was presented for hearing through video conferencing. On call, learned Advocate Mr. Gautam Johri appeared on behalf of the complainant. Learned Advocate Mr. Puneet Jain appeared on behalf of the respondent. It was informed by the learned Advocate for the complainant that a petition has been filed by the respondent / promoter in the Hon'ble High Court, Allahabad against the order dated 27.04.2025 passed by the Hon'ble Appellate Tribunal, Lucknow.

The respondent is directed to ensure uploading its written reply on the complaint page of the RERA portal within the next 2 weeks in respect of the complaint in question, and ensure making a copy available to the complainant via e-mail as well, and also ensure stating confirmation of the amount received from the complainant in its written reply.
