On call, the complainant was absent and learned Advocate Ms. Anjali Tyagi appeared on behalf of the respondent. Against the order dated 48.40.2022 passed under Section-34 by the Bench in the complaint in question, in Appeal No. 6/2023 filed by the complainant before the Hon'ble Appellate Tribunal, Lucknow, the order dated 27.04.2025 was passed setting aside the order dated 8.0.2022 passed by the Bench under Section-34, and the RERA Authority was directed: (iii) RERA Authority shall proceed against the promoter under Chapter —VIII of the Act, 206 for imposition of Penalty after due process; (iv) cost of litigation assessed at Rs. 20,000/- to be paid to the appellant/allottee by the respondent/promoter within forty five days. It was informed by the learned Advocate for the respondent that against the order dated 27.04.2025 passed by the Hon'ble Appellate Tribunal, Lucknow, the following orders were passed on date 46.02.2026 in Petition No. 35/2025 filed by the respondent / promoter in the Hon'ble High Court, Allahabad:

(i) The execution proceedings pursuant to the impugred order dated order dated 27.0.2025 passed by learned U.P. Real Estate Appellate Tribunal in Appeal No. 5 of 2023 In Re: Hari Prasad Yaday Vs. M/s Alpine Infra Projects Private Ltd., shall remain in abeyance. (ii) Till the next date of listing the parties shall maintain status quo in respect of the unit in question.
