However, the learned advocate Shri Puneet Jain, appearing on behalf of the respondent, informed the Bench that the parties have reached a settlement, which was found uploaded on the portal. Further, a withdrawal application uploaded by the complainant was also found. It is noteworthy that the project is unregistered, and the RERA Authority has no right to hear complaints relating to unregistered projects. The complainant was directed to provide certain information for registration, but in this regard the complainant has filed the withdrawal application mentioned above.

Since the project is unregistered, the complaint is not maintainable in RERA, and taking cognisance of the settlement between the parties, or recording it, when the complaint itself is not maintainable before the Bench, is wholly improper from the judicial point of view.
