UP Real Estate Regulatory Authority, Lucknow New Building, State Planning Institute, Kalakankar House, Purana Hyderabad, Lucknow Court: Adjudicating Officer Present: [?] Chandra Shrivastava Complaint No. [?] ADJ/NCRI44/03/704/202 Mrs. Shivani Shukla, [?], Complainant vs M/s La Residentia Developers [?], Opposite Party DECISION The complainant has applied for compensation because possession of the unit was delivered late. The complainant states that a unit in the opposite party's project "La Residentia 4" was allotted to the complainant on 20.02.20. The estimated price of the flat was Rs. 26,82,475/-. The complainant has paid Rs. 28,3[?],883/- to the opposite party. As per the agreement, possession of the unit was to be given within 30 months of the date of the agreement. The complainant states that possession was received on 05.02.2024. The opposite party states that its project is registered with RERA, construction work is complete, and the OC/CC certificate has been received. Registration was also completed in 2049, and possession was given to the complainant on full satisfaction. The opposite party therefore states that the complainant is no longer entitled to any compensation.
In support of the complainant's case, the complainant filed a copy of the allotment letter, a copy of the agreement, and copies of payment receipts. In support of its case, the opposite party filed a copy of the agreement, a copy of the possession handover form, and a copy of the registration. I heard both parties and perused the documentary evidence on file. On the facts stated by both parties, the main question in dispute is whether the complainant is entitled to compensation for the delay in receiving possession of the unit or not. Page 1 The allotment of the unit to the complainant in the opposite party's project on 20.02.204 is accepted by both parties. The agreement executed between the parties on this same date is binding on both parties. As per paragraph 9 of the agreement, possession of the unit was to be given within 30 months, that is, by 20.08.203. The opposite party has not given possession within that period. The complainant had filed a complaint no. (02144/42/0937/2049 before Authority Bench No. 04 for this. By the order of the Authority's bench dated 30.42.2020, the opposite party was directed to give possession to the complainant by 28.02.2024. In compliance with that order, the opposite party gave possession of the unit to the complainant on 05.022024. Thus, the period from 49 08 2043 to 05.02.2024 is the delayed period. The opposite party has not stated any reason for this delay.
The opposite party argues that at the time of taking possession the complainant gave a written undertaking that possession is being taken on the basis of [?], and that no [?] claim will be made; therefore the complainant is no longer entitled to any compensation. This argument of the opposite party is not acceptable. Possession was delayed, and the opposite party is responsible for compensating that delay. No person can be pressured, at the time of handing over possession, to agree that the person will not claim for the delay. No person can be deprived of legal rights. Paragraph 49 of the agreement between the two parties also provides for compensation for delayed possession at the rate of Rs. 5/- per sq ft per month. This provision is binding on both parties. The agreement states the area of the unit as 395 sq ft. The delayed period from 9.08.203 to 05.02.2024 is a total of 89 months. From this delayed period, the 06-month period of [?] can be deducted. Hence an 83-month delayed period can be considered. The area of the unit is stated to be 4395 sq ft. At Rs. 5/- per sq ft per month, the compensation for one month (4395 x 5) will be Rs. 6,975/-. For 83 months, the compensation (6,975 x 83) will be Rs. 5,78,925/-. The complainant shall be entitled to receive this compensation from the opposite party.
The opposite party also states that a civil suit should be filed in a civil court to enforce the terms of the agreement, and that no suit is pending in this court. This statement is not acceptable. After the Real Estate (Regulation and Development) Act, 2076 [?] was passed, the Authority has jurisdiction to hear real estate matters, and this court has jurisdiction, under the Authority, to hear and dispose of compensation matters. From the above facts it is clear that, as per the terms of the agreement, the complainant is entitled to compensation for the delay, and is entitled to receive the interest amount as compensation. The area of the unit is stated as 2395 sq ft. At Rs. 5/- per sq ft per month, the compensation for one month (2395 x 5) will be Rs. 6,975/-, and the compensation for 83 months (6,975 x 83) will be Rs. 5,78,925/-. The complainant's application is acceptable. Page 2 ORDER The complainant's application for compensation is accepted, and the opposite party is directed to pay Rs. 5,78,925/- (Rupees Five Lakh Seventy-Eight Thousand Nine Hundred Twenty-Five only) to the complainant as compensation within 45 days from the date of the decision. If the opposite party does not pay within the stipulated period, recovery proceedings may be initiated under the provisions of the Act. If payment is not made within the stipulated period, the complainant shall also be entitled to interest on the compensation amount at [?]+1% per annum until actual payment is made.
