U.P. Real Estate Regulatory Authority, Regional Office, Gautam Buddh Nagar. Order, Bench-Adjudicating Officer E-Court Presiding: Shri Chaitanya Kumar Kulshreshtha Complaint No.: ADI/NCR44/03/52374/2020 Vandana Saxena, 0l, Tower-7, Sector-Tech Zone 4, Nirala Estate, Noida Extension, Gautam Buddha Nagar, 20304, UP. Versus M/s La Residentia Developers Pvt. Ltd, Pankaj Jain House 100.-95, Second Floor, Ram Vihar, Delhi-0092. The complainant has filed this complaint against the opposite party seeking compensation. 2... The complainant says that the complainant booked Flat No. 403 in Tower-7 of the opposite party's project La Residentia, Gautam Buddh Nagar. The total value of this flat was Rs. 25,46,350/-, and the complainant has so far paid Rs. 20,57,820/-. The project was to be completed by 30.03.204. The builder gave wrong information. The project has been sold in the name of Amrapali. On these grounds compensation has been requested.
3. Notices were sent to the opposite party to appear. The notices were served. The opposite party appeared and has filed its reply. In its reply the opposite party has said that the complainant has filed this complaint on [?] grounds, and has not placed all the facts before the Bench. The complainant had earlier filed a complaint No. 4420473472 before the Authority's Bench, in which the Hon'ble Bench passed orders. Against that order the complainant filed an appeal before the Appellate Tribunal, Lucknow. The Appellate Tribunal, by its order dated 20.02.2020, modified the Bench's order and passed an order for the delay at 12 percent interest. The complainant could either have filed the complaint before the Authority's Bench, or before the Adjudicating Officer's Bench. The order for refund of the amount has already been passed by the Hon'ble Appellate Bench. Therefore the complaint in question is barred by the principle of res judicata. Accordingly, dismissal of the complainant's complaint has been requested. Page 2
The complainant has filed a rejoinder stating that in the order No. 42 / 2048 dated 20.02.2020 passed by the Appellate Tribunal, Lucknow, the Hon'ble Bench directed the complainant to file a complaint before this Bench in order to obtain the compensation and benefit available under Section 34 of the RERA Act. Therefore the complainant has filed this complaint. The opposite party has been using the complainant's money for 0 years. A heavy sum of Rs. 20,57,820/- has reached the builder. The complainant took a loan from a bank and paid it to the opposite party, and is paying its EMI, and at present lives in a rented house, which imposes a financial burden. The builder is causing mental harassment. The complainant is seeking compensation and benefit for the loss suffered, and also states that the complainant is paying the bank EMI and there has been no delay in payment on the complainant's part. Therefore the complainant has requested that all losses and expenses be awarded, and compensation under the head of rent. In support of the complainant's statement, the complainant has filed photocopies of records including documents relating to payment, newspaper cuttings, copies of letters sent, the builder-buyer agreement and other records. In support of its statement, the opposite party has filed a photocopy of the order dated 20.02.2020 passed by the Appellate Tribunal, Lucknow, in order No. 2,/ 2048 "Vandana Saxena v. La Residentia Developers wo feo".
On the basis of the pleadings of both parties, the following points are framed in this complaint for determination: L. Is the complaint in question barred by the principle of res judicata? 2, Is the complainant entitled to receive compensation? If so, how much compensation is the complainant entitled to receive? The arguments of both parties were heard and the evidence available on the file was perused, on the basis of which the Bench's findings are as follows: Findings 9. Point for determination In this point for determination it has to be seen whether the complaint in question is barred by the principle of res judicata. The opposite party contends that the complaint in question is barred by the principle of res judicata, and says that the complainant should either have filed the complaint before the Authority's Bench, or before the adjudicating officer's Bench, because an order for the refund of the amount has already been passed by the Hon'ble Appellate Bench in the appeal filed by the complainant. Therefore the complaint is barred by the principle of res judicata. Page 3 (i) I have perused the order dated 20.02.2020 passed by the Hon'ble Appellate Bench.
The Hon'ble Appellate Bench has ordered the refund of the entire deposited amount at the rate of MCLR+l %, and has also recorded in its order that the complainant may file a complaint before the Hon'ble Adjudicating Officer's Bench to obtain compensation. The complainant has filed this complaint before this Bench in compliance with that order. In any case, complaints relating to compensation are filed before this Bench. Therefore the principle of res judicata will not bar this Bench's order, because the jurisdiction of the two forums is different and the reliefs sought are different. Accordingly, this point for determination is decided against the opposite party. 40. Point for determination No. 2 In this point for determination it has to be seen whether the complainant is entitled to receive compensation, and, if so, how much compensation the complainant is entitled to receive. (i) Under the Real Estate (Regulation and Development) Act, 20i6, the jurisdiction to hear the matter and to award compensation, where the provisions relating to determination are violated, in Section 7, Sections 42, 4, 48 and 49, has been given to the adjudicating officer. (ii) In this connection, the factors to be considered by the adjudicating officer are recorded in Section 72 of the Act as follows:- "72, While adjudging the quantum of compensation or interest, as the case may be, under section 7l, the adjudicating officer shall have due regard to the following factors, namely:—
(a) the amount of disproportionate gain or unfair advantage, wherever quantifiable, made as a result of the default; (b) the amount of loss caused as a result of the default; (c) the repetitive nature of the default; (d) such other factors which the adjudicating officer considers necessary to the case in furtherance of justice." Page 4 Page 4 (#) The complainant has said that the opposite party is using the amount that the complainant paid to it as it wishes. The complainant had to live in a rented house. Therefore the complainant has prayed for compensation under the heads of rent, mental harassment and litigation expenses. These points will be considered separately. () Compensation under the head of rent:-
(i) The complainant says that the complainant has been living in a rented house since April 2044, and had to spend money on rent because the building had not been handed over. Therefore the complainant has prayed for compensation under the head of rent. This Bench can award compensation under those heads which come before it, under Section 72(d) of the Act. The complainant had to live in a rented house. Because possession of the unit was not given, the complainant had to spend money on rent. Therefore it appears proper that the loss suffered under the head of rent be made good. The unit the complainant had booked was a 3BHK +2 Toilet, with a super area of 4470 sq ft. If the complainant had received this building within the stipulated period, the complainant would not have had to take a rented building. (ii) In this connection, the Real Estate (Regulation and Development) Act, 20:6 came into force on 04.05.20I7. In this connection, by the notification dated 03.05.20:7 of the U.P. Housing and Urban Planning Department, Section-2, the Governor granted approval for functioning as the Regulatory Authority in U.P. from 04.05.207; that is, the Real Estate (Regulation and Development) Act, 206 came into force in U.P. from 04.05.2047, and this Act became applicable in U.P. from 02,05.20i7. The enforcement of this Act is prospective. Therefore compensation under the head of rent shall be payable from 04.0520I7, the date from which the Act applies in U.P.
It now has to be considered how much compensation per month should be awarded under the head of rent. The flat the complainant had booked was of 4470 sq ft. If the complainant had got this flat, the complainant would have lived in their own flat. The flat was situated in Greater Noida West. Therefore the complainant is entitled to compensation for the loss suffered under the head of rent for a flat of 4470 sq ft. This Bench therefore considers it proper that the complainant be awarded Rs. 6,000/- per month as compensation from 04.05.2047, in compliance with the order passed by the Hon'ble Appellate Tribunal, Lucknow, up to the actual date of payment of the amount. (2) Compensation for mental harassment and litigation expenses:- The complainant has prayed for compensation for mental harassment and litigation expenses, but in Section 7 of the Real Estate (Regulation and Development) Act, 20i6, and in Sections 42, 44, 48 and 49, there is no clear provision for awarding compensation under the heads of mental harassment and litigation expenses. In such a situation it is not possible to award the complainant compensation for mental harassment and litigation expenses. Therefore, in such a situation, the complainant's complaint is fit to be accepted in part. Page 5 ORDER The complainant's complaint is accepted in part. The complainant shall receive compensation from the opposite party under the following heads: [?] (i) (ii) (iii) Compensation under the head of rent:-
The complainant shall receive from the opposite party under this head Rs. 6,000/- per month from 0.05.2047, until the actual date of payment of the amount, in compliance with the order of the Hon'ble Appellate Tribunal, Lucknow, [?]. To receive compensation from the opposite party up to the actual date of payment of the amount, in compliance with the order passed by the Hon'ble Appellate Tribunal, Lucknow, the complainant shall inform the Authority of the actual date of payment of the amount, so that the above compensation can be awarded to the complainant. The opposite party is directed to ensure that it pays the compensation up to the date of actual payment of the amount, in compliance with the order dated 20.02.2020 passed by the Hon'ble Appellate Tribunal, Lucknow, within 45 days from the date of actual payment of the amount. If the opposite party does not comply with the order, the complainant shall have the right to get the order implemented through the execution procedure before the U.P. Real Estate Regulatory Authority, [?]. The order shall be uploaded on the portal. The file shall be filed in the record room. Date-44/0/2020 (Chaitanya Kumar Kulshreshtha) (Adjudicating Officer) U.P. di) इस सम्बन्ध में wr अधिनियम की धारा-72 में न््यायनिर्णायक अधिकारी द्वारा विचार में लिये ' जाने वाले कारको को निम्न प्रकार अंकित किया गया है :- "72, While adjudging the quantum of compensation or interest, as the case may be, under section 7l, the adjudicating officer shall have due regard to the following factors, namely:— (a) the amount of disproportionate gain or unfair advantage, wherever quantifiable, made as a result of the default; (b) the amount of loss caused as a result of the default; (c) the repetitive nature of the default; (d) such other factors which the adjudicating officer considers necessary to the case in furtherance of justice." 4 4 (#) शिकायतकर्ता ने कहा है कि उसने जो धनराशि विपक्षी को अदा की है, उसका विपक्षी अपने हिसाब से उपयोग कर रहा है।
