U.P. Real Estate Regulatory Authority, Regional Office, Gautam Buddh Nagar. Hearing Bench-04 Smt. Kalpana Mishra, Member Sr. No. | Complaint No. | Complainant 4 | NCR44030603/209 | Vijay Radheshyam Lojewar 2 | 32048932738 | Urvashi Gupta 3 | 320932775 | Madan Lal Versus G.S. Promoters Pvt. Ltd. Complainant Vijay Radheshyam Lojewar, along with 02 other complainants, has filed a case against the opposite party. The facts and evidence of these three complaints are identical. These three complaints relate to SIKKA KARMIC GREENS. Therefore, they are being disposed of by a single decision. Complaint No. NCRI44030603/20I9, Vijay Radheshyam Lojewar, will be the lead case. The complaint applications have been filed by the complainants against the opposite party, requesting possession, interest for the delay and penalty.
Briefly, the complainant's statement is that the complainant booked Flat No. 506, Tower Aspire, in the opposite party's project SIKKA KARMIC GREENS, for which the complainant paid Rs. 45,34,246/- from time to time in instalments. The opposite party was to give possession of the unit to the complainant by 43.07.20i6, but the opposite party was unable to give possession within the period stipulated in the agreement. The complainant also says that the opposite party has not paid the outstanding amount to the Noida Development Authority. Moreover, the opposite party is not paying interest for the delay in possession. Therefore the complainants have requested that possession, interest for the delay period and penalty be awarded against the opposite party. For this reason, the complainant filed a complaint against the opposite party under Section 34 of the U.P. Real Estate Regulatory Authority Act. In support of their statement, the complainants filed copies of e-mails, flat allotment [?] letter, booking letter, reply, tripartite agreement, home loan agreement letter, copies of receipts, affidavit and other documents.
In its written reply, the opposite party stated that the complainant did not make payments according to the schedule, and several reminder letters have also been sent. The complainant is not entitled to any additional amount or interest, because payment was not made on time. The complainant had booked Flat No. 506 under the Flexi [?] Plan, whose total area is t000 sq. ft. Occupancy certificate has been obtained and the opposite party is ready to give possession. The opposite party further says that penalty for the delay will be paid at the time of possession as per the agreement. In support of its statement, the opposite party has enclosed copies of reminder letters and the flat allotment agreement. Both parties were heard and the case file was perused. It is an undisputed fact that the complainant booked a unit in the opposite party's project, and the opposite party was unable to give possession of the unit within the contracted period. On this, the opposite party says that the complainant did not pay on time and has applied for the occupancy certificate. As per the agreement, penalty for the delay will be given to the complainant at the time of possession. Considering the collective complaints of the complainants, the following points arise for consideration: 1. Whether, because there is an arbitration clause in the agreement, this Bench has jurisdiction to hear the complaint in question?
2. Whether the opposite party's project was delayed due to force majeure? If so, what is its effect? 3. Whether the complainant should be awarded interest for the delayed period? Decision on point No. 4 The opposite party has further argued that the agreement contains an arbitration clause, due to which any dispute between the complainant and the opposite party can be settled only through an arbitrator, and this Bench has no jurisdiction to hear this complaint. The opposite party stated in clause 82 of its agreement: Any and all the disputes arising out of or in connection with or in relation hereto shall so far as possible, in the first instance, be amicably settled between the Company, and the Allottee raising the dispute. In the event of disputes, claim and/or difference not being amicably resolved such disputes shall be referred to sole arbitrator to be appointed by the Company. The proceedings of the Arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act 996 or any rules made there-under, as amended from time to time. The venue of the arbitration shall be New Delhi, India. From this it is known that, according to the agreement, any dispute between the parties is to be settled by mutual consent under the Indian Arbitration and Conciliation Act 4996, with its jurisdiction at Delhi. In this regard, the Hon'ble Supreme Court in Booz Allen and Hamilton Inc. and others v. SBI Home Finance Ltd. and others has held:
All aspects of arbitrability have to be decided by the court seized of the suit, and cannot be left to the decision of the Arbitrator. Even if an arbitration agreement exists and the dispute is covered therein, the court will refuse to refer the parties to arbitration if the subject matter of the suit is capable of adjudication only by a public forum or the relief claimed can only be granted by a special court or Tribunal. Further, in A. Ayyaswamy v. A. Paramasivam, the Hon'ble Supreme Court has held: There are classes of disputes that fall within the exclusive domain of special bodies created under legislation that confers jurisdiction to the exclusion of ordinary civil courts. Such disputes would not then be capable of resolution by arbitration. The NCDRC has also held:
The NCDRC finally held that in light of the overall architecture of the CPA and Court-evolved jurisprudence, amended sub-section (1) of Section 8 cannot be construed as a mandate to the Consumer Fora, constituted under the CPA, to refer the parties to arbitration in terms of the Arbitration Agreement. the principle that jurisdiction of specially constituted judicial authorities cannot be ousted by a blanket mandate to refer disputes to arbitration under the umbrella of Section 8, A&C Act. On the ground level, it provides relief to a party to avail special remedies available under a statute, despite presence of an arbitration clause. This serves to protect parties from lop-sided and sparely-negotiable standard form agreements. From another angle, parties will no longer be mandated to adopt the relatively long and expensive process of arbitration in disputes arising under specific statutes having specific dispute redressal mechanisms. This judgment could also be used to interpret Section 79 of the Real Estate (Regulation and Development) Act 206 ("Real Estate Act") which bars the jurisdiction of civil courts in matters involving real estate. The NCDRC applied the reasoning in Ayyaswamy to conclude that the same principles could apply to cases under the Real Estate Act, which provides a special mechanism for resolution of disputes between buyers and builders.
In light of the above legal propositions laid down by the Hon'ble Supreme Court and the NCDRC, it is clear that the jurisdiction of specially constituted authorities cannot be ousted merely by the cover of an arbitration clause. All disputes for which special bodies have been created by law, and which have been given jurisdiction in exclusion of the civil courts, cannot be resolved by an arbitrator. In light of the above, it is clear that Section 79 of the Real Estate (Regulation and Development) Act 20:6 will override the Arbitration Act. The NCDRC has concluded that the same principle applied in Ayyaswamy can apply to cases under the Real Estate Act, which provides a special mechanism for resolving disputes between home buyers and builders. In view of the principles laid down above, the question of the opposite party referring the matter to an arbitrator automatically ends. Accordingly, point No. 4 is decided. Decision on point No. 2 Point No. 2 has been framed on the question whether the opposite party's project was delayed due to force majeure, and if so, what its effect is. This issue has also been framed on the basis of the opposite party's allegations, the burden of proving which lies on the opposite party.
The opposite party stated that the project was delayed due to certain unforeseen events (force majeure), such as riots, agitation, strikes, industrial disputes, obstruction of services and supplies to the project, change of government policy, judicial stay orders, obstruction of work due to decisions and [?] orders, and delay in licences and approvals, etc., which were mentioned by the opposite party in clause 29 of the agreement, signed by the complainant. Therefore, the complainant is not entitled to any interest. But the opposite party has neither stated which force majeure the project was delayed by, nor has it filed on record any evidence of any force majeure. In such a situation it is not entitled to the benefit of this plea. Accordingly, point No. 2 is decided. Decision on point No. 3
The complainant has said that the opposite party was to complete the project by 43.07.207, but possession has still not been given to date, due to which interest for the delay in possession has been requested. To this the opposite party says that the complainant has not paid according to the agreement on time, and that the OC has been obtained. From perusal of the record it is known that under clause 26 of the agreement, the flat was to be completed within 36 months and a 6-month grace period after the excavation of the project. No date for the start of excavation for construction of the project is given on the record; in such a case, the project start date shown on the RERA website, i.e. 07.09.2044, shall be deemed to be the start date. According to that, the unit possession was to be given by 43.04.2047. In such a case, it is justified that the complainant be awarded interest for the period from 3.07.20:7 until possession is given along with OC/CC. In this regard, it is noteworthy that the Hon'ble High Court of Maharashtra, in the petition of Neelkamal Realtors Suburban Pvt. Ltd. and others v. Union of India, has held:
Section 48(4)(0) lays down that if the promoter fails to complete or is unable to give possession of an apartment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. If the allottee does not intent to withdraw from the project he shall be paid by the promoter interest for every month's delay till handing over of the possession,. The requirement to pay interest is not a penalty as the payment of interest is compensatory in nature in the light of the delay suffered by the allottee who has paid for his apartment but has not received possession of it. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable. Interest is merely compensation for use of money. Therefore, in light of the above judgment, it is clear that under the provisions of UP RERA, interest on the delay and on the principal amount is payable in accordance with the agreement made between the promoter and the buyer, because the promoters have utilized the said amount.
It is also noteworthy that an agreement executed between the parties, signed by both sides, from which it can be determined that both sides accept the terms of the agreement. As per the agreement, there is a provision of Rs. 5 per sq. ft. per month during the period of delay in the project, under which the complainant is entitled to receive the amount. However, the complainant has also objected that the said amount is very low, and that as per the RERA provisions the amount should be paid at the same rate at which the opposite party received the amount. In this regard, the Hon'ble High Court of Mumbai has also held in the above legal position that: For the reasons already indicated, aforesaid decisions are not applicable to the facts of the present case. I have already indicated that the provisions of RERA are prospective in nature. The penalty under Sections 8, 38, 59, 60, 64, 63 and 64 is to be levied on account of contravention of provisions of RERA, prospectively and not retrospectively.
Therefore, in light of the above judgment, it is clear that the penalty provided under UP RERA provisions must be prospective and not retrospective. In such a case, the amount should be paid as per the agreement before the coming into effect of RERA (dated 45.2046), and after RERA came into effect, from 4.5.2046 onwards, the complainant is entitled to interest on the deposited amount for the delayed period as per RERA provisions. Where no agreement has been executed between the parties, the complainant shall be entitled to interest on the deposited amount as per RERA provisions. As regards the rate of interest payable, the State Government, under the Real Estate (Regulation and Development) Act 20:6, notified on 47.0.208 the Real Estate (Regulation and Development) (Agreement for Sale/Lease) Rules 2or8. In the format of the sale/lease deed annexed to them, in clause 9, the Events of Default of promoters are defined, and clause 9 (ii) F provides for the allottee in case of the promoter's default: The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +[?]% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:
The same rate is also fixed for allottees' default in clause (iii) 4. Keeping in view the above provision, it appears justified that the allottee be awarded interest at the rate of MCLRH per cent. It is also clarified that if any amount payable by the complainant is delayed, the opposite party will also be entitled to interest only at the rate of MCLRH per cent. As regards the period up to which interest is to be awarded, in this regard the Hon'ble Supreme Court, in Civil Appeal No. 6649-50 ,//2048 Supertech Limited v. Rajni Goyal, has held: the period of Interest should close on April 20I6 when the Full Occupancy Certificate was obtained as per the admission of the Respondent Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant Builder had obtained the Completion Certificate as late as April 2046. The Respondent Purchaser could not have any further grievance after April 20I6 with respect to delay in handing over possession. The Respondent Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession. As per the above legal position, the complainant will be entitled to delay interest until the OC is received. In such a case, the said complainants shall be entitled to interest only up to the date of receipt of the OC. Accordingly, point No. 3 is disposed of.
So far as the award of compensation is concerned, it falls within the jurisdiction of the Adjudicating Officer under Section 74 of the Real Estate (Regulation and Development) Act, 2006. No order in this regard can be passed by this Bench. The complainants' application is accordingly disposed of, and the opposite party is ordered as follows. ORDER 4... The opposite party is directed to ensure that it gives possession to the complainants with OC/CC within 60 days from the upload of this order, after receiving any amount due and outstanding, and to ensure registration after receiving stamp duty as per rules. 2... The opposite party shall pay interest on the amount, with grace period, to the complainants as per the agreement, payable before the coming of RERA, and after the coming of RERA at the rate of [?]+3 per cent fixed by the State Bank of India. It is also clarified that this interest amount shall be adjusted in the final payment amount. If the interest amount exceeds the amount due, it shall be returned to the complainants as per rules. 3. If any amount is payable by the buyers to the builder, then in accordance with the provisions of Section 2 (za) (), the builder shall charge interest only at the rate of [?] per cent per annum. 4... The opposite party is to adjust the EMI amounts deposited by the complainants during construction into the final payment amount.
5. A copy of this order shall be kept on the related files, and the amount and interest in each case shall be calculated in accordance with the principle laid down in this order. Violation of this order shall be punishable under Section 63 of the U.P. Real Estate (Regulation and Development) Act, 20i6 and other relevant provisions. If the opposite party does not comply with this order, the complainant shall have the right to get the order implemented through the RERA Authority. Date: 46 /829/ 2049 (Kalpana Mishra) (Member) U.P.
“Section 48(4)(0) lays down that if the promoter fails to complete or is unable to give possession of an aprtment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. The re interest is merely compensation for use of money."
इस सम्बंध में उल्लेखनीय है कि माननीय उच्च न्यायालय मुम्बई द्वारा उपरोक्त विधि व्यवस्था में यह भी अभिनिर्धारित किया गया है कि :- "For the reasons already indicated, aforesaid decisions are not applicable to the facts of the present case. | have already indicated that the provisions of RERA are prospective in nature. The penalty under Sections 8, 38, 59, 60, 64, 63 and 64 is to be levied on account of contravention of provisions of RERA, prospectively and not retrospectively." aa: उपरोक्त निर्णय के आलोक में यह स्पष्ट है कि उ0प्र0 रेरा के प्राविधानों के अन्तर्गत प्राविधानित दंड पूर्वव्यापी नहीं, बल्कि भविष्यलक्षी होना चाहिये।
इसमें संलग्नक के रूप में दिये गये विकय /पटटा विलेख के प्रारूप के wer 9 में प्रमोटर्स के डिफाल्ट प्रकरण (Events of default) परिभाषित है, जिसमें प्रस्तर 9 (ii) F प्रमोटर के डिफाल्टर होने की स्थिति में आवंटी हेतु प्राविधानित है कि:- The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +% unless provided otherwise under the Rules. within . forty-five days of receiving the termination notice: यही दर आवंटियों के द्वारा डिफॉल्ट की स्थिति में भी प्रस्तर (iii) 4 निर्धारित है।
इस सम्बंध में सिविल अपील wo 6649-50 ,//2048 yen लिमिटेड बनाम रजनी गोयल में माननीय उच्चतम न्यायालय द्वारा अभिनिर्धारित किया गया है कि :- वि " the period of Interest should close on April 20I6 when the Full Occupancy Certificate was obtained as per the admission of the Respondent — Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant —Builder had obtained the Completion Certificate as late as April C~— ४ — =: 2046.
