Uttar Pradesh Real Estate Regulatory Authority, Regional Office, Gautam Buddh Nagar. Hearing Bench-04, Shri Rajeev Kumar, Chairman Smt. Kalpana Mishra, Member Sl. No. | Complaint No. | Complainant 9204848852 | Anuradha Bhardwaj 2 | 220786638 | Nitin Suresh Jain 4 | 22086754 | Bharat Tyagi 2208677 | [Gaurav Gupta] vs. G.S. Promoters Pvt. Ltd. Order 27.03.2049 Along with complainant Anuradha Bhardwaj, 03 other complainants have filed a suit against the opposite party. The facts of all these complaints are the same and there is the same evidence. All these complaints relate to SIKKA KARMIC GREENS. Therefore, they are being disposed of by a single decision. Complaint No. 9204848852, Anuradha Bhardwaj, shall remain the lead case. The complaint application has been filed by the complainant against the opposite party, seeking immediate possession along with the necessary documents, failing which refund of the amount deposited with 24 per cent interest.
In brief, the complainant's statement is that the complainant booked flat [WO?] K.G., / Aspire / 4604 in the opposite party's project SIKKA KARMIC GREENS, and from time to time, on the basis of instalments, an amount of Rs. 54,68,379/- was also paid. However, the opposite party did not give possession within the contracted period, and the project is considerably delayed. Now the opposite party is demanding amounts under certain other heads in addition, and possession is not being given. Accordingly, the complainant has requested possession along with the necessary documents, failing which refund of the amount with 24 per cent annual interest. In support of the statement, the complainants submitted: a copy of the brochure, receipt of the amount deposited, loan application, photocopy of cheque, copy of e-mail, copy of offer of possession, photocopy of [Rages?] section plan, photocopies of letters sent to the opposite party, and an RTI application.
In its written reply, the opposite party has stated that the real estate sector is currently going through a bad phase. The project has been delayed due to the global economic slowdown, orders of the Ministry of Environment and certain other reasons (shortage of labour, shortage of manpower, rising prices of material, and delays in recommendations of government departments), for which the opposite party is not responsible. The complainant executed an agreement for the unit allotted on 20.4.203, and in the agreement the opposite party had stated that possession would be given in 42 months with the grace period. Time was lost in formalities of some government departments. Despite adverse circumstances, the opposite party was keen to complete the project, and it has earlier also carried out work in keeping with its reputation. The project is complete, and an offer of possession was sent to the complainants on 24.7.2047. For the delay period, the opposite party is ready to give compensation as per the agreement. In support of its statement, the opposite party has filed a copy of the offer of possession and the agreement. Heard the submissions of both parties and perused the file. 1. Is the complainant entitled to receive the deposited amount with interest? 2. Is the opposite party levying additional charges illegally? 3. Are the complainants entitled to interest for the delayed period? Disposal point No. 4
The complainants have stated that the opposite party was to give possession within [?] months from the agreement, which has not been done. Therefore, the deposited amount of the complainant be refunded with interest. The opposite party says that the project is complete and the offer of possession was sent to the complainants on 22.7.20:7, but instead of taking possession, the complainants have filed this suit to harass the opposite party. At present the opposite party has invested all the money in the project, so refund is not possible. Photographs of the project filed by the parties show that the project is nearing completion. At this stage, refund does not appear appropriate. In this regard, the observation made by the Hon'ble Supreme Court in Civil Appeal No. 744/20:7, Chitra Sharma and others vs. Union of India and others, is important: "40. The figures........ which have been made available presently, following the opening of the web portal by the amicus curiae, indicate that 8% of the home buyers have sought a refund of their monies while 92% would evidently prefer possession of the homes which they have purchased. We cannot be unmindful of the interests of 92% of the home buyers many of whom would also have obtained loans to secure a home. They would have a legitimate grievance if the corpus of Rs 750 crores (together with accrued interest) is distributed to the home buyers who seek a refund."
At this stage, keeping in view the present financial condition of the real estate sector, returning the amount is likely to adversely affect the interests of those allottees who want to take possession of their units. Also, the opposite party has stated that it has already offered possession. At this stage, if the complainant receives possession along with the amount/interest for the delay, the interests of all allottees will be served. In light of the principle laid down by the Hon'ble Supreme Court, refund to the complainants does not appear appropriate. Accordingly, point No. 4 is disposed of [?]. Disposal point No. 2 The complainants have stated that the opposite party is demanding various additional charges. According to the agreement, a power backup of 4 [?] was described, but now 5 KVA backup is being given. Apart from this, 24 months' maintenance is being charged, which is wrong. Removal of these has been requested. As far as the question of additional charges is concerned, neither party has filed the complete copy of the [wire?] allotment letter etc. However, the following position is clear from the records available on the file: (a) [?] Rs. 3 lakh is the basic price and the tax component. No separate additional amount is being demanded. In this matter, the complainant has neither given any citation of the Supreme Court order mentioned, nor stated the facts of that case. Therefore this amount is payable.
(b) The amount for arranging 2 KVA backup power is included in the basic price (Rs. 57.675 lakh). Therefore, if the complainants do not want the additional 5 [?] backup, it is not included in the agreement, and the complainants cannot be compelled to pay that amount. (c) As regards electrical and water connection charges and IGL charges, the builder shall inform the complainants, giving complete details including evidence of the actual payments made to the concerned bodies such as IGL, the Authority or the electricity supply company, the relevant ancillary expenses, and the calculation of the complainants' proportionate share. (d) Maintenance charges shall be payable only from the date of obtaining O.C./C.C. or the date of offer of possession, whichever is later. The amount of IFMS is included in the basic price, so action in this regard shall be taken accordingly. As per rules, the builder shall transfer responsibility for IFMS to the A.O.A. as per rules [?]. (f) If the agreement contains any escalation provision [?], then no additional amount other than [?] 4462500/- shall be charged in this regard. Accordingly, point No. 2 is disposed of. Disposal point No. 3
Complaint point No. 3: The opposite party has not given possession within the contracted period, for which the complainants have stated that interest at 24 per cent be awarded for the delayed period. The opposite party stated that the project is not delayed, and it has also stated that it will give compensation as per the agreement. From perusal of the documents it is clear that the project is complete, and as per clause 26 of the agreement, the opposite party had to give possession within 36+6 months (grace period), i.e., 42 months from the date of the agreement. The said agreement was executed on 20.4.2043, so the latest date for giving possession was 20.40.2046, for which reason the complainants are entitled to interest for the delayed period. In this regard, it is notable that in the petition of Neelkamal Realtors Suburban Pvt. Ltd. and others vs. Union of India, the Hon'ble High Court of Maharashtra has held that:
"Section 48()(0) lays down that if the promoter fails to complete or is unable to give possession of an aprtment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. If the allottee does not intent to withdraw from the project he shall be paid by the promoter interest for every month's delay till handing over of the possession, The requirement to pay interest is not a penalty as the payment of interest is compensatory in nature in the light of the delay suffered by the allottee who has paid for his apartment but has not received possession of it. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable." Therefore, in light of the above judgment, it is clear that under the provisions of UP RERA, interest on the delay and on the principal amount shall be payable in accordance with the agreement executed between the promoter and the buyer, because the promoters have [?] the said amount.
It is also notable that an agreement has been executed between the parties, signed by both sides, from which it can be determined that both sides have accepted the terms of the said agreement. As per the agreement, compensation at Rs. 5 per square foot per month is provided for the period of delay in the project, and according to it the complainants are entitled to compensation. However, the complainants have also objected that the said compensation is extremely low, and that under the RERA provisions the opposite party should pay compensation at the same rate at which it has received it, namely 24 per cent. Therefore, interest at 24 per cent has been requested. In this regard, it is notable that the Hon'ble High Court of Bombay has also held, in the above legal position, that: "For the reasons already indicated, aforesaid decisions are not applicable to the facts of the present case. I have already indicated that the provisions of RERA are prospective in nature. The penalty under Sections 8, 38, 59, 60, 64, 63 and 64 is to be levied on account of contravention of provisions of RERA, prospectively and not retrospectively."
Therefore, in light of the said judgment, it is clear that the penalties provided under the provisions of UP RERA must be prospective and not retrospective. In such a case, before RERA came into effect (dated 4.5.2046), since the agreement between the parties is in force, compensation shall be paid as per the agreement [?]. After RERA came into force, where no agreement between the parties has been executed, the complainant is entitled to interest on the deposited amount for the delayed period in accordance with the provisions of RERA. As regards the rate of interest payable, the State Government, under the Real Estate (Regulation and Development) Act 20i6, notified on 7.0.20:8 the Real Estate (Regulation and Development) (Agreement for Sale/Lease) Rules [?]. In the form of sale/lease deed annexed to it, clause 9 defines the Events of Default of promoters. Clause 9(ii) F provides for the allottee, in the event of the promoter being in default, that: "The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +l% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:"
The same rate is also fixed for default by allottees under clause [?](iii). In view of the said provision, it appears just to award interest to the allottee at the rate of MCLR+ [?] per cent. It is also clarified that if any amount payable by the complainant is delayed, the opposite party too shall be entitled to interest only at the rate of MCLR+ per cent. As regards the period of interest, the opposite party has said that possession was offered to the complainants on 2:7207, but the complainants have stated that the opposite party is giving possession without O.C./C.C., which is illegal. In this regard, the Hon'ble Supreme Court has held in Civil Appeal No. [?] 49-50/20:8, Supertech Limited vs. Rajni Goyal, that: "the period of Interest should close on April 206 when the Full Occupancy Certificate was obtained as per the admission of the Respondent — Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant — Builder had obtained the Completion Certificate as late as April 206. The Respondent — Purchaser could not have any further grievance after April 20I6 with respect to delay in handing over possession. The Respondent — Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession."
In accordance with the above legal position, the complainant is entitled to interest for the delay up to the date of receipt of O.C. or the date of offer of possession, whichever is later. In such case, both the said complainants shall be entitled to interest up to the receipt of O.C./C.C. or the offer of possession, whichever is later. Accordingly, the complainant's application is disposed of. 4. The opposite party shall, within 45 days of the order being uploaded, revise the demand as stated above and make available the necessary records to the complainant. If any dues are payable under the agreement, including government taxes and authority dues, the complainant's proportionate share shall be calculated, supported by proof of the payments made by the opposite party itself, and the complainant shall be informed in writing. After receiving the dues and the payable stamp duty, the registration shall be completed. If any interest is payable by the complainant for the delay, then only MCLRtH% per cent shall be payable on it.
2. The opposite party is directed to ensure payment, with interest at MCLR+ per cent on the amount deposited by the complainants, for the delayed period from the contractual date of possession in the case of Ms. Bhardwaj, i.e., from 20.:020:6, up to the date of receipt of O.C./C.C. or the date of offer of possession, whichever is later. It is further clarified that this interest amount shall be adjusted against the amount of the final payment. If the interest amount is more than the amount payable, it shall be refunded to the complainant as per rules. 3. Violation of this order shall be punishable under Section 63 of the Real Estate (Regulation and Development) Act, 20i6 and other relevant provisions. The order be uploaded on the portal. Section 48()(0) lays down that if the promoter fails to complete or is unable to give possession of an aprtment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable.
