U.P. Real Estate Regulatory Authority, Regional Office, Gautam Buddh Nagar Hearing Bench-04 Shri Rajiv Kumar, Chairperson [?] 1 2 5 6 9 420788974 42089759 Ashish WAT Jaykant Prasad Jitendra Mohan WRT Versus M.V. Infrastructures India Pvt. Ltd. Order 08.05.20i9 Three complaints have been instituted by complainant Shailendra Prasad and i6 other complainants against the respondents. The facts of all these complaints are the same and the evidence is also the same. All these complaints relate to Dwarka Heights. Therefore, they are being disposed of by one judgment. Complaint No. Ho 9204848554, Shailendra Prasad, shall be the lead case. Qu 2 The present complaint application has been instituted by the complainants against the respondent for recovery of the deposited amount. Some complainants have sought possession along with interest for the delayed period and some have filed cases before the D.R.T. In brief, the complainants state that they booked Unit B-4204 in the respondent's Dwarka Heights project and paid the respondent an amount of Rs. 58,32,000/— in installments from time to time, but the respondent failed to give possession within the contracted period. The unit was purchased under subvention, but the respondent is not paying the E.M.I. Therefore, the complainants requested return of the deposited amount along with interest. The complainants filed photocopies of the allotment letter, loan tripartite agreement and account statement in support of their submissions.
The Bench issued notices to the respondent. In response, the respondent's learned counsel, Mr. Siddharth Nandwani, appeared on 25.4.209 and stated that 80 percent of the project work had been completed and finishing work remained; Rs. 35 crore was required for the remaining work, and if the complainants paid the outstanding amount, the respondent would complete construction and give possession by March 2020. However, despite sufficient opportunity, no written statement was filed on behalf of the respondent. Both parties were heard and the file was perused.
It is undisputed that the complainants booked units in the respondent's project. No written statement has been filed on behalf of the respondent. A copy of the allotment letter has been filed on behalf of the complainants, paragraph 5.4 of which states that possession was to be given within 34 months together with 25 +6 months (grace period) after [?] was executed. The agreement was executed on 44.42.2045, making the latest date for delivery of possession 4.7.2048, but the respondent failed to give possession within this period. The complainants also stated that construction at the project had been stopped for a long time and that they had lodged a First Information Report against the respondent, on which the respondent stated that the money would be returned within one week, but even then the money was not returned. The date of commencement of the project recorded on the RERA website is 04.0.203, which is 6 years old, and the completion date is 34.03.2020. Wl yA
3 Since the completion date of the project on the RERA website is 37.03.2020, in the interest of justice, the complainants' demand for refund does not appear appropriate. In this regard, the observation made by the Hon'ble Supreme Court in Civil Appeal [?] 744/20:7, Chitra Sharma and others versus Union of India and others, is important: " 40. The figures........ which have been made available presently, following the opening of the web portal by the amicus curiae, indicate that 8% of the home buyers have sought a refund of their monies while 92% would evidently prefer possession of the homes which they have purchased. We cannot be unmindful of the interests of 92% of the home buyers many of whom would also have obtained loans to secure a home. They would have a legitimate grievance if the corpus of Rs 750 crores (together with accrued interest) is distributed to the home buyers who seek a refund." Similarly, among the responsibilities of the Authority for the development [?] of the real estate sector under Section 32 of the Real Estate Act, the following is also included: 32. The Authority shall in order to facilitate the growth and promotion of a healthy, transparent, efficient and competitive real estate sector make recommendations to the appropriate Government of the competent authority, as the case may be, on,— (a) protection of interest of the allottees, promoter and real estate agent; 6) any other issue that the Authority may think necessary for the
promotion of the real estate sector. It is clear from the above provisions that, to ensure the healthy development of the “real estate sector”, it is the responsibility of this Authority to take an appropriate decision while considering comprehensively the interests of all its [?] holders. The respondent's learned counsel appeared before the Bench on 25.4.2049 and stated that “80 percent of the work has been completed and Rs. 35 crore is required to complete the project. If the complainants pay the outstanding [?], the project will be completed and possession will be given by March 2020.” In a situation where the project is 80 percent complete and an amount is outstanding from the allottees, upon receiving which the respondent can complete the project, the complainants had invested for their home in the project and most of the project had already been completed by the respondent. In such circumstances, if the complainants take back their money from the project, this will not only obstruct completion of the project but will also delay the allottees who want to remain in the project. Therefore, in view of the above law laid down by the Hon'ble Supreme Court and the provisions of Section 32, it appears appropriate to give the respondent time until March 2020 to complete the project. Against delivery of possession in July 20i8, March 2020 cannot be described as “excessive delay”. Therefore, in the interest of justice, it is appropriate to harmonize the interests of both parties.
In this regard, it is noteworthy that the Hon'ble High Court, in the petition Neelkamal Realtors Suburban Pvt. Ltd. and others versus Union of India, held that: Section 4(2)()(0 enables the promoter to revise the date of completion of project and hand over possession. The provisions of RERA, however, do not rewrite the clause of completion or handing over possession in agreement for sale. Section 4(2)()(c) enables the promoter to give fresh time line independent of the time period stipulated in the agreements for sale entered into between him and the allottees so that he is not visited with penal consequences laid down under RERA. In othe words, by giving opertunity to the promoter to prescribe fresh time line under Section 4(2)()(c), he is not absolved of the liability under the agreement for sale.
Section 8(7)(b) lays down that if the promoter fails to complete or is unable to give possession of an aprtment due to discontinuance of his business as a developer on account of suspension or revocation of the registration under the Act or for any other reason, he is liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice in this behalf including compensation. If the allottee does not intent to withdraw from the project he shall be paid by the promoter interest for every month's delay till handing over of the possession,. The requirement to pay interest is not a penalty as the payment of interest is compensatory in nature in the light of the delay suffered by the allottee who has paid for his apartment but has not received possession of it. The obligation imposed on the promoter to pay interest till such time as the apartment is handed over to him is not unreasonable. The interest is merely compensation for use of money. Therefore, in light of the above judgment, it is clear that under the provisions of U.P. RERA, interest on the delay and principal amount is payable according to the agreement between the promoter and the buyer, because the promoters have used the said amount. ( H
5 It is also noteworthy that an agreement has been executed between the parties and signed by both parties, from which it may be determined that both parties accept the terms of the agreement. According to the agreement, during the period of delay in the project, an amount is provided at the rate of 5 rupees per square foot per month, under which the complainants are entitled to receive the amount, although the complainants have also objected that the said amount is extremely low and that, according to the provisions of RERA, the amount should be paid at the same rate at which the amount was received by the respondent. In this regard, the Hon'ble High Court, Mumbai, also held in the above case law that: For the reasons already indicated, aforesaid decisions are not applicable to the facts of the present case. | have already indicated that the provisions of RERA are prospective in nature. The penalty under Sections 78, 38, 59, 60, 64, 63 and 64 is to be levied on account of contravention of provisions of RERA, prospectively and not retrospectively.
Therefore, in light of the above judgment, it is clear that the penalty provided under the provisions of U.P. RERA should not be retrospective but prospective. In such a situation, before RERA came into effect (dated 4.5.2046), payment should be made according to the agreement, and after RERA came into effect, from 4.5.206, the complainant is entitled to receive interest according to the provisions of RERA on the amount deposited for the delayed period. In a case where no agreement has been executed between the parties, the complainant shall be entitled to interest on the deposited amount in accordance with the provisions of RERA. As regards the applicable rate of interest, the State Government notified on 47.40.2048, under the Real Estate (Regulation and Development) Act 20i6, the Real Estate (Regulation and Development) (Agreement for Sale/Lease) Rules 20i8. In the annexed model sale/lease deed, paragraph 9 defines “Events of default”, and paragraph 9 (ii) F provides for the allottee in the event of default by the promoter that: The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:
The same rate is also prescribed in paragraph ofiii) 4 in the event of default by the allottees. In view of the above provision, it appears just to refund the allottee's money with interest at the rate of cir percent; it is also clarified that, after the date 4.5.2046, if there is any delay in payment of any amount due from the allottee, the respondent may recover interest only at the rate of MciRH percent. As regards the period of interest, the respondent stated that possession would be given by November 2049. In this regard, the Hon'ble Supreme Court in Civil Appeal to 6649-50 /20i8, Supertech Limited versus Rajni Goyal, held that: " the period of Interest should close on April 206 when the Full Occupancy Certificate was obtained as per the admission of the Respondent ~ Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant — Builder had obtained the Completion Certificate as late as April 20l6. The Respondent — Purchaser could not have any further grievance after April 20l6 with respect to delay in handing over possession. The Respondent — Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession. " According to the above case law, the complainant is entitled to interest for delay until the date the O.C. is received or possession is offered, whichever is later. In such circumstances, the complainants shall be entitled to interest only until the date the O.C. is received.
7 As regards payment of compensation, the same falls within the jurisdiction of the Adjudicating Officer. Therefore, no order can be passed by the Authority on this point. In view of all the facts, the complainants' application is disposed of accordingly and the respondent is ordered as follows: 1. The respondent is directed to complete the units of the complainants and make them available by 34.3.2020, and also ensure payment, according to the agreement, of interest at the rate of MCLR+H percent from the contracted period, namely from 7.7.208, until the date of receiving the O.C./C.C. or the date of offering possession, whichever is later. This interest amount shall be adjusted in the final amount payable. If the interest amount exceeds the amount payable, it shall be returned to the complainant as per law. 2. If the respondent fails to give possession by 34.3.2020, it shall ensure payment, in two [?], of the amount deposited by the complainant together with MCLR+H percent interest from the date of deposit until the date of payment, and the amount shall be returned to the other complainants according to the amounts paid by them. The respondent shall ensure payment of 50 percent of this amount within 45 days after 34.3.2020 and the remaining 50 percent before 34.42.2020 or within the period until resale of the unit, whichever is earlier.
3. If any loan has been taken from a bank for purchasing this unit, the bank's amount shall be returned first, after which the remaining amount shall be paid to the complainant. 4. One copy of the order shall be kept on each related file and the amount and interest shall be calculated in every case according to the principles laid down in this order. 5. A copy of this order shall be sent to the Secretary, RERA for monthly monitoring of the progress of the project. 6. Violation of this order shall be punishable under Section-63 of the U.P. Real Estate (Regulation and Development) Act, 20i6 and other relevant provisions. The order be uploaded on the portal. <,५५- 3८ ० (Rajiv Kumar) (Chairperson) U.P.
They would have a legitimate grievance if the corpus of Rs 750 crores (together with accrued interest) is distributed to the home buyers who seek a refund." The Authority shall in order to facilitate the growth and promotion of a healthy, transparent, efficient and competitive real estate sector make recommendations to the appropriate Government of the competent authority, as the case may be, on,— (a) protection of interest of the allottees, promoter and real estate agent; 6) any other issue that the Authority may think necessary for the promotion of the real estate sector.
आदि बनाम यूनियन ऑफ इंडिया की याचिका में माननीय उच्च न्यायालय द्वारा यह अभिनिर्धारित किया गया है कि :- Section 4(2)()(0) enables the promoter to revise the date of completion of project and hand over possession. The provisions of RERA, however, do not rewrite the clause of completion or handing over possession in agreement for sale. Section 4(2)(4)(c) enables the promoter to give fresh time line independent of the time period stipulated in the agreements for sale entered into between him and the allottees so that he is not visited with penal consequences laid down under RERA.
इस सम्बंध में उल्लेखनीय है कि माननीय उच्च न्यायालय मुम्बई द्वारा उपरोक्त विधि व्यवस्था में यह भी अभिनिर्धारित किया गया है कि :- For the reasons already indicated, aforesaid decisions are not applicable to the facts of the present case. | have already indicated that the provisions of RERA are prospective in nature. The penalty under Sections 8, 38, 59, 60, 64, 63 and 64 is to be levied on account of contravention of provisions of RERA, prospectively and not retrospectively.
इसमें संलग्नक के रूप में दिये गये विकय /पटटा विलेख के प्रारूप के प्रस्तर 9 में प्रमोटर्स के डिफाल्ट प्रकरण a (Events of default) परिभाषित है, जिसमें wea 9 (ii) F प्रमोटर के डिफाल्टर होने की स्थिति में आवंटी हेतु प्राविधानित है कि:- The Allottee shall have the option of terminating the Agreement in which case the Promoter shall be liable to refund the entire money paid by the Allottee under any head whatsoever towards the purchase of the apartment, along with interest at the rate equal to MCLR (Marginal Cost of Lending Rate) on home loan of State Bank of India +% unless provided otherwise under the Rules. within forty-five days of receiving the termination notice:
उक्त प्राविधान को दृष्टिगत रखते हुए आवंटी को cir प्रतिशत की ब्याज दर पर ब्याज सहित धनवापसी किया जाना न्यायोचित प्रतीत होता है, साथ ही यह भी स्पष्ट किया जाता है कि विपक्षी भी दिनांक 4.5.2046 के पश्चात यदि आवंटी की किसी देय धनराशि में विलंब है, तो McLR+ प्रतिशत की दर से ही ब्याज वसूल कर सकेगा | जहां तक ब्याज की अवधि का प्रश्न है, तो विपक्षी की ओर से कहा गया कि वह नवम्बर 2049 तक कब्जा दे दिया जायेगा, इस सम्बंध में सिविल अपील do 6649-50 /20i8 सुपरटेक लिमिटेड बनाम रजनी गोयल में माननीय उच्चतम न्यायालय द्वारा अभिनिर्धारित किया गया है कि :- " the period of Interest should close on April 206 when the Full Occupancy Certificate was obtained as per the admission of the Respondent ~ Purchaser herself in Para 4(j) of the Consumer Complaint, wherein she has admitted that the Appellant — Builder had obtained the Completion Certificate as late as April 20I6. The Respondent — Purchaser could not have any further grievance after April 20l6 with respect to delay in handing over possession. The Respondent - Purchaser ought not to be allowed to reap the benefits of her own delay in taking possession.
