The complaint and the remand report clearly indicates that the deceased was having disputes with A2 – M. Sai Krishna and there was no active involvement of the petitioners -A6, A7, A8, A9, A10, A12, A14, A17 and A18. A bare reading of the remand report categorically reveals that the deceased was also having dispute with A3 - Deepak and A5 -Ramkumar but not with the 3 BRMR,J
Crl.P.Nos.12418, 11335, 11269, 11219, 11604, 11481, 11726, 11321 and 11215 of 2026 petitioners, mere participation in a party does not amount to an offence unless and until the petitioners - A6, A7, A8, A9, A10, A12, A14, A17 and A18 have participated in the crime. It is further submitted that the entire investigation is completed and prayed to enlarge the petitioners - A6, A7, A8, A9, A10, A12, A14, A17 and A18 on bail. 3. Learned Additional Public Prosecutor submits that during the party all the accused persons i.e., A1 to A20 consumed alcohol, enjoyed the music played thereon. In this sequence initially there was a quarrel raised between A1 – Akula Lokesh and the deceased-G.Ramu over petty issues. After half an hour deceased - G.Ramu, A2 – M.Sai Krishna also got into drunken condition. Later at about 12.30 a.m., A1 to A20 again gathered near the swimming pool continued drinking, pushing one another, in intoxicated condition disputes arose between them. Deceased - G.Ramu was again involved in the quarrel with A2-Sai Krishna and A1 – Akula Lokesh caught hold of his shirt collar. A3 – Deepak, A4-Vineeth, A5-Ramkumar and A6-Dheeraj were shouting to ‘beat the deceased – G.Ramu to death’. The petitioners - A6, A7, A8, A9, A10, A12, A14, A17 and A18 have not made out any case for grant of bail and prayed to dismiss the same. 4. G.Anjaiah has lodged a complaint on 14.06.2026 before the P.S. Choutuppal about the manner in which his son G.Ramu died. Basing 4 BRMR,J
Crl.P.Nos.12418, 11335, 11269, 11219, 11604, 11481, 11726, 11321 and 11215 of 2026 on the said report, P.S.choutuppal has registered FIR.No.331 of 2026 on the same day under Section 103 r/w Section 3(5) of BNS. 5. Remand case diary dated 16.06.2026 goes to show that A1 to A20 were arrested and remanded to judicial custody. Remand report further goes to show that the prosecution has examined almost 15 witnesses apart from examining two police officers. 6. It is to be noted here that A1 and A2 were enlarged on bail in Criminal M.P.No.312 of 2026, A3 was enlarged on bail in Criminal M.P.No.314 of 2026 and A5 was also enlarged on bail in Criminal M.P.No.313 of 2026 by the learned I Additional District and Sessions Judge, Bhongir vide orders dated 01.08.2026. Petitioners are A6, A7, A8, A9, A10, A12, A14, A17 and A18. Even as per the remand case diary there is an allegation against A1 and A2 about the manner in which the quarrel has taken place between the deceased – G.Ramu with that of A1 - Akula Lokesh and A2-M.Sai Krishna. As A1 and A2 are enlarged on bail by the learned Sessions Court stated supra and investigation is at the fag end, detaining the petitioners - A6, A7, A8, A9, A10, A12, A14, A17 and A18 further in judicial custody will not serve the purpose for the prosecution.
