IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HON’BLE SRI JUSTICE B.R.MADHUSUDHAN RAO CRIMINAL REVISION CASE No.741 of 2026 DATE: 28.07.2026 BETWEEN: TGSRTC Tandur depot, Rep By its Depot Manager, Sri Praveen Kumar …..Revision Petitioner/Owner And The State of Telangana, Through P.S. Chevella, Rep by Public Prosecutor, High Court at Hyderabad. …..Respondent/Complainant ORDER This Criminal Revision Case is filed seeking to set aside the Order dated 14.07.2026 passed in Crl.M.P.No.216 of 2026 in Crime No.481 of 2026 by the learned Judicial Magistrate of First Class Rangareddy District, At Chevella. 2. Heard Sri R. Anurag, learned Standing counsel for TSRTC appearing for the revision petitioner as well as Sri D. 2 Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.
3. Learned counsel for the petitioner submits that the learned trial Court erred in imposing the condition directing the petitioner to furnish Rs.20,00,000/- surety is arbitrary and unwarranted, for imposition of such excessive and exorbitant amounts of surety as condition is unwarranted and unnecessary burden to the petitioner-corporation. The presence of the property can be secured through a simple undertaking and therefore insisting for surety is not necessary. The learned trial Court failed to appreciate that the petitioner is a Government-owned Road Transport Corporation engaged in providing essential public transport services to the general public. The learned trial Court erred in imposing condition No.2 in Crl.M.P.No.216 of 2026 dated 14.07.2026 and prayed to relax the said condition. 4. Learned Additional Public Prosecutor on written instructions would submit that the approximate value of bus is around Rs.30,00,000/-, condition cannot be relaxed. 3 5. Learned counsel for the petitioner in support of his contention placed reliance in the case of The Managing Director Vs. The State of Telangana1. 6. Petitioner has filed Crl.M.P.No.216 of 2026 seeking interim custody of TGSRTC Bus bearing Registration No.TG 09 Z 8119, which was seized by Chevella Police in connection with Crime No.481 of 2026. The learned trial Court after hearing the counsels has allowed the application with conditions. Condition No.2 is important which reads as under:
“(ii) On compliance of condition (i) above, the Investigating Officer shall release the vehicle on interim custody to the Petitioner/Owner, on the Petitioner executing a personal bond for Rs.20,00,000/- with one surety for like sum.” 7. Petitioner is a Government-owned Road Transport Corporation engaged in providing essential public transport services to the general public. 8. In the similar set of facts in Crl.Rc.No.581 of 2026 dated 15.06.2026, this Court has reduced the personal bond 1 Crl.R.C.No.581 of 2026 dated 15.06.2026 of the High Court for the State of Telangana at Hyderabad. 4 amount from Rs.10,00,000/- to Rs.1,00,000/- with one surety. 9. Since condition No.2 states that the petitioner shall execute a personal bond for Rs.20,00,000/- with one surety for like sum, the same is reduced to Rs.2,00,000/- with one surety. 10. Accordingly, the Criminal Revision Case is allowed. Petitioner is directed to furnish a personal bond for Rs.2,00,000/- with one surety for a like sum before the learned trial Court within a period of Fifteen (15) days from the date of receipt of a copy of this order. Miscellaneous applications, if any pending, shall stand closed. __________________________ B.R.MADHUSUDHAN RAO, J Date: 28.07.2026 TU 5 34 THE HON’BLE SRI JUSTICE B.R.MADHUSUDHAN RAO CRIMINAL REVISION CASE No.741 of 2026 Date: 28.07.2026 TU
