IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.10124 of 2026 DATE: 17.07.2026 BETWEEN: Dhagarpu Krupa Mani. …..petitioner/CCL And The State of Telangana, Rep. by Public Prosecutor, High Court for the State of Telangana, at Hyderabad. …..Respondent ORDER This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is CCL in Crime No.289 of 2025 before the IS Sadan Police Station, registered for the offence punishable under Section 305 of BNS. 2
2. Brief facts of the case are that on 06.11.2025 at about 10:45 hours, a Telugu written complaint was received from Sri Rangineni Abhilash stating that he has been running Vijayalakshmi Kirana and General Store at Saraswati Nagar, I.S. Sadan, Hyderabad, for the past several years. It is alleged that on 05.11.2025 at about 10:30 PM, he closed his shop and went home, and on the next day i.e., 06.11.2025 at about 5:30 AM, he was informed by his worker that the shutter lock of the shop had been broken and the shutter was found open. Upon reaching the shop and verifying, he found that the lock was broken and cash of about Rs.400/- was missing from the counter. It was further reported that a nearby shop, namely a milk shop, was also broken into and cash of about Rs.800/-was stolen, thereby indicating that unknown persons had committed theft in both premises. Based on the said complaint, a case in Crime No.289 of 2025 was registered for the alleged offence, and the investigation was taken up. 3. Heard Sri M. Mahesh, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State. 3
4. Learned counsel for the petitioner submitted that the petitioner/CCL has been falsely implicated in the above crime and has not committed any offence as alleged. It is further submitted that the petitioner is a juvenile and is the only earning member of his family, and due to his continued detention, the family is facing hardship. It is also submitted that the petitioner was arrested on 14.11.2025 and since then he is in judicial custody. The investigation is already completed and nothing remains except filing of charge sheet. He further submits that the petitioner is ready to abide by any conditions imposed by this Court. Therefore, he prayed to enlarge the petitioner on bail. 5. Learned Additional Public Prosecutor appearing for respondent–State opposed the submissions made by learned counsel for the petitioner and contended that the petitioner is involved in offences of similar nature and if released on bail, there is every likelihood of repeating such offences and tampering with prosecution evidence. Therefore, he prayed for dismissal of the petition. 6. Having regard to the rival submissions made, and on perusing the material placed on record, it is noted that the 4
petitioner is in jail from 14.11.2025. At this stage, it is pertinent to note that though learned Additional Public Prosecutor contended that petitioner is a habitual offender and if released on bail, she will repeat the illegal acts, whereas, it is specific plea of learned counsel for petitioner that petitioner is a juvenile who is under observation since 14.11.2025. Therefore, considering the period of incarceration of petitioner, her age, and the nature of allegations, this Court is of the opinion that it is a fit case to grant bail to the petitioner, subject to the compliance of following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each and shall also furnish two parental bonds by her parents/guardians, all to the satisfaction of the V Additional Chief Judicial Magistrate Court, Nampally, Hyderabad. ii. The petitioner shall appear before the concerned SHO at 11:00 a.m. on every Monday for a period of eight (8) weeks or till 5 filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently Section 480(3) of the BNSS). 7. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 17.07.2026 PT 6
