she stated that due to some reasons she divorced her husband in the year 2024 and she is staying with her parents. She has been working as a Sales girl in a shop. On 31.01.2026 she got acquaintance with the petitioner, who is working in the adjacent shop. While talking on 02.02.2026, he proposed her and said he would marry her. She informed him that she was already married and divorced and she has a son. Even after knowing all those, he told her he will marry her. Believing his words and on 23.03.2023 and 20.05.2026, the petitioner took her to hotel and had physical relationship with her multiple times. After some time, when the complainant asked him when they would get married, he said his mother would not agree and refused to marry her. When she called to the mother of the petitioner, she abused her badly. Hence, she requested the police to take necessary action on the said complaint. Basing on the same, police registered a case for the aforesaid offences. 3. Heard Sri Aashir.M.Khan, learned counsel for the petitioner/accused and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State. 3 SKS,J crlp_10794_2026
4. The contention of learned counsel for the petitioner is that the petitioner is innocent of the said allegations; that the petitioner has been in judicial custody from 22.05.2026; that the petitioner is aged about 22 years; that the victim is a married person and having one male child; that there is no such promise made by the petitioner and he has been falsely implicated in this case; that entire investigation is already completed and hence, he requested this Court to grant regular bail to the petitioner. 5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence committed by the petitioner is serious and heinous in nature; that investigation is not yet completed; requisition for recording the statement of victim under Section 183 of the BNSS is pending, as such the petitioner is not entitled for grant of bail. 6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 22.05.2026. As seen from the record, L.Ws.1 to 12 were examined. Except recording the statement of victim under 4 SKS,J crlp_10794_2026 Section 183 of the BNSS, material part of the investigation is completed. Considering the nature of allegations and period of incarceration, this Court is inclined to grant bail to the petitioner-accused subject to the following conditions:
(i) The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned IV Additional Metropolitan Magistrate-cum-IV Additional Junior Civil Judge at L.B.Nagar, Hyderabad. (iii) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 7. Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 14.07.2026 YVL
