Margani Nagamunnima. …Petitioner/ Accused And The State of Telangana, Rep.byt its Public Prosecutor, High Court for the State of Telangana, Hyderabad. … Respondent Complainant O R D E R This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/Accused seeking to enlarge him on bail in connection with Crime No.516 of 2026 of Jeedimetla Police Station, Quthbullapur, Cyberabad. The offence alleged against the petitioner is punishable under Section 69 of the BNS. 2. During the said 2 SKS,J crlp_9703_2026
period, he met her family. The petitioner repeatedly promised that he would marry her and based on his assurance, she trusted him and continued the relationship. It is stated that relying on promise of marriage, the victim consented to a physical relationship with him. They first became physically intimate at her residence in the month of May, 2024. During the relationship, the accused took financial assistance from her and obtained money, phonepay, credit cards, cash, gold ornaments, gifts, mobile phones, silver etc. He also obtained loans on her name, resulting in financial loss to her upto Rs.1,50,000/- and misused her business and used her money approximately 40 to 44 lakhs, gold around 4 tulas. Despite repeated requests, the petitioner and his family threatened her with suicide threats and false implications. It is stated that she came to know that on 21.09.2025 she saw that the petitioner is with another woman and she has CCTV footages and other evidence showing that he was in continuous contact and communication with her and her family was also aware of their relationship and he refused to marry. He also used to abused her and damaging her mental peace and on 3 SKS,J crlp_9703_2026
27.05.2026 she went to speak with him, but he abused and he came to her sister’s house and created nuisance by shouting at her family members. Hence, she requested the police to take necessary action against the complaint. Basing on the same, police registered a case for the aforesaid offence. 3. Heard Sri Bhavaraju Sai Vikas, learned counsel for the petitioner/Accused and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State. 4. The contention of learned counsel for the petitioner is that the petitioner is innocent of the offence alleged against him; that whatever relationship between the petitioner and the victim is a voluntary one; that even according to the petitioner, the victim introduced her family members to the petitioner; that the allegation of misappropriation of amount taken by the petitioner is already paid to the victim and there is no loss to the victim and that the petitioner has been in judicial custody since 11.06.2026; that material part of the investigation is completed and hence, he requested the Court to grant regular bail to the petitioner. 4 SKS,J crlp_9703_2026
5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence alleged against the petitioner is heinous and grievous in nature and investigation is not yet completed; that the statement of victim under Section 183 of the BNSS is still pending; that there is a threat to the victim in the hands of the petitioner and hence, he prays this Court to dismiss the petition. 6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 11.06.2026. As seen from the record, the relationship between the parties is a consented one which is from April, 2024. In her complaint, though she stated that in September, 2025 she saw that the petitioner is with another woman, no complaint is lodged at that point of time. Considering the fact that L.Ws.1 to 13 were already examined, nature of allegation, period of incarceration and progress in investigation, this Court is inclined to grant bail to the petitioner-accused subject to the following conditions: 5 SKS,J crlp_9703_2026 (i) The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned VIII Additional Metropolitan Magistrate at Medchal, Cyberabad, Medchal District.
(ii) On such release, the petitioner-accused shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. (iii) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 7. Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 06.07.2026 YVL
