Mr. A.S. Khosa, Advocate for the petitioner in CRM-M-36050-2026. Mr. Akash Yadav, AAG Punjab. *** SHALINI SINGH NAGPAL J. 1. Vide these petition(s) under Section 482 Bharatiya Nagarik Suraksha Sanhita, 2023, petitioner(s) seek regular bail in case arising out of FIR No. 482 dated 24.11.2025 under Sections 21-B/27-A/61/85 Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Faridkot, District Faridkot. Offence under Section 29, 61 and 85 NDPS Act were added in the FIR during investigation. This is the first petition seeking AJAY GOSWAMIregular bail on behalf of petitioner-Mahinder Singh and second petition on 2026.09.11 11:00 I attest to the accuracy and integrity of this document 2 CRM-M-41348-2026 (O&M) and CRM-M-36050-2026 behalf of petitioner-Kulwant Singh @ Bhoma. First petition on behalf of petitioner-Kulwant Singh @ Bhoma was dismissed as withdrawn on 07.04.2026.
2. It is alleged that on 23.11.2025, at about 11.00 PM, police party headed by ASI Jagsir Singh was patrolling in the area of Grain Market, Faridkot, when petitioner-Kulwant Singh @ Bhoma was seen holding a kit bag. On seeing the police party, he threw the polythene bag on the ground. He was apprehended and on search of the polythene bag, 50 grams of heroin was recovered. The kit bag carried by the petitioner was checked, which led to recovery of a computerized scale and Indian currency notes amounting to ₹5,50,000/-. On the basis of disclosure statement made by Kulwant Singh @ Bhoma, Mahinder Singh son of Chiman Singh was nominated as accused but no recovery was effected from his possession. 3. Learned counsel(s) for the petitioner(s) submit that petitioner-Kulwant Singh @ Bhoma was in custody w.e.f. 24.11.2025 while petitioner-Mahinder Singh was in custody w.e.f. 08.04.2026. Investigation against both the petitioners was complete. Quantity of contraband recovered from petitioner-Kulwant Singh @ Bhoma was non-commercial. Trial was likely to ₹ take long. It was further argued that the amount of 5,50,000/- was not drug money. Further, the call detail records projected between the petitioners was also not incriminating as both the accused were cousins. Therefore, petitioner(s) deserved to be enlarged on regular bail.
4. Learned State counsel has files status report and opposed the prayer(s) for regular bail arguing that apart from recovery of 50 grams of heroin from petitioner-Kulwant Singh @ Bhoma, computerized weighing ₹ scale, mobile phone and drug money of 5,50,000/- was recovered from his AJAY GOSWAMI 2026.09.11 11:00 I attest to the accuracy and integrity of this document 3 CRM-M-41348-2026 (O&M) and CRM-M-36050-2026 possession, he disclosed that on the previous occasion, he along with co-accused Mahinder Singh, sold 500 grams heroin. The allegations against them were serious and they did not deserve to be enlarged on regular bail. 5. Antecedents of petitioner Kulwant Singh @ Bhoma are clean.
Petitioner Kulwant Singh is in judicial custody in the case w.e.f. 24.11.2025, while petitioner Mahinder Singh is confined since 08.04.2026. Considering the fact that quantity of contraband allegedly recovered from petitioner-Kulwant Singh @ Bhoma is 50 grams herion and is non-commercial in nature; that co-accused Mahinder Singh has been nominated on disclosure statement of Kulwant Singh @ Bhoma; that investigation in the case is complete and trial would take long to conclude and in view of the well settled principle of criminal jurisprudence that “bail is the rule and jail an exception”, but without a comment on merits, the petitions are allowed. Petitioners are ordered to be released on regular bail subject to the satisfaction of learned trial Court/Chief Judicial Magistrate/Illaqa Magistrate. 6. Pending CRM(s), if any, also stand disposed of. 7. A photocopy of this order be placed on the file of other connected case.
