CWP-23447-2026 1 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 118 CWP-23447-2026 (O&M) Date of decision: 13.08.2026 Parveen Saroha ....Petitioner Versus State of Haryana and others ....Respondents CORAM: HON'BLE MR. JUSTICE HARPREET SINGH BRAR Present: Ms. Navdeep Kaur Gill, Advocate for Mr. Rohit Mittal, Advocate for the petitioner. Mr. Rahul Dev Singh, Addl. A.G., Haryana. HARPREET SINGH BRAR J. (Oral) 1. Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent/Department to correct the service book of the petitioner wherein the date of joining of the petitioner has been mentioned as 13.09.2023 instead of 06.12.2017. Further prayer has been made to direct the respondent/Department to decide the representation dated 10.07.2026 (Annexure P-11) submitted by the petitioner. 2. Learned counsel for the petitioner has, inter alia, contended that the petitioner was eligible for the post of Assistant Professor and had applied and participated in the selection process pursuant to Advertisement No.10/2016 (Annexure P-1). declared on 13.02.2017, however, the petitioner was not selected whereas the candidates with lesser marks were appointed and certain other candidates who were not eligible were selected. The candidates selected in the same process were appointed on 06.12.2017, subject to the outcome of pending writ petitions. Thereafter, the petitioner challenged the selection of the ineligible candidates before this Court in CWP No.18708 of 2017, which was allowed on 07.11.2022 and their selection was set-aside. Subsequently, the petitioner was issued the provisional appointment letter dated 08.09.2023 and joined on 13.09.2023. The petitioner then requested notional pay fixation and seniority from 06.12.2017. Thereafter, the subsequent writ petition filed by the petitioner i.e. CWP No.7250 of 2025, was disposed of by this Court on 18.03.2025 with a direction to decide his representation. Thereafter, the respondents granted him notional benefits from 06.12.2017, while actual financial benefits were granted from 13.09.2023 and notional increments were also granted. However, the petitioner’s HRMS/service record still shows his date of joining as 13.09.2023 and does not reflect the notional appointment from 06.12.2017. Learned counsel for the petitioner has further submitted that this action of the respondent/Department is affecting the petitioner’s service experience particularly for the purposes of online transfer policy. Feeling aggrieved, the petitioner submitted a representation dated 10.07.2026 seeking correction of his service record, but no action has been taken thereon till date.
MOHD YAKUB 2026.08.14 10:00 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court, Chandigarh. CWP-23447-2026 3 2.1. Learned counsel for the petitioner, at this stage, submits that he would be satisfied if the representation (Annexure P-11) of the petitioner is decided by respondent No.2 by passing a speaking order in a time bound manner. 3. Learned State counsel, appearing on advance notice, submits that he has no objection, in case a direction is issued to the respondent No.2 for time-bound consideration and decision of the representation (Annexure P-11) of the petitioner by passing a speaking order. 4. Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.2 is directed to consider the representation (Annexure P-11) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.2. 5. Disposed of, accordingly.
