(Oral)​ ​1.​ ​Prayer​​made​​in​​the​​present​​petition​​is​​for​​directing​​the​​respondents​​to​ ​grant​ ​0.5​ ​marks​ ​of​ ​experience​ ​to​ ​the​ ​petitioner​ ​for​ ​working​ ​in​ ​an​ ​ISO​ ​certified​ ​company as Junior Engineer.​

​2.​ ​Learned​​State​​counsel​​while​​referring​​to​​para​​5​​&​​7​​of​​the​​short​​reply​ ​filed​​by​​Haryana​​Staff​​Selection​​Commission​​dated​​22.11.2023​​submits​​that​​as​​per​ ​advertisement,​​the​​said​​marks​​could​​have​​been​​granted​​only​​if​​the​​candidate​​would​ ​have worked in any of the authorities mentioned therein which read thus : -​ ​“5.​ ​That​​the​​main​​contention​​of​​the​​petitioner​​in​​the​​present​ ​writ​ ​petition​ ​is​ ​to​ ​grant​ ​0.5​ ​marks​ ​for​ ​experience​ ​to​ ​the​ ​petitioner​​for​​working​​in​​ISO​​Certified​​company​​Junior​​System​ ​Engineer​ ​as​​described​​in​​the​​notification​​dated​​05.07.2019​​i.e.​ ​Annexure​​P-1.​​In​​this​​regard​​it​​is​​submitted​​that​​the​​petitioner’s​ ​experience​​certificate​​cannot​​be​​taken​​into​​consideration,​​as​​the​ ​same​​is​​not​​in​​accordance​​with​​the​​terms​​and​​conditions​​of​​the​ ​advertisement.​​The​​relevant​​part​​of​​the​​terms​​and​​conditions​​of​ ​the​ ​advertisement​ ​for​ ​the​ ​post​ ​in​ ​question​ ​is​ ​reproduced​ ​as​ ​under:​ PARVEEN KUMAR 2026.07.29 16:32 I attest to the accuracy and integrity of this order/judgment. ​CWP-9948-2021 (O&M)​ ​-​2​-​ ​At​ ​page​ ​no.31​ ​of​ ​the​ ​Advt.11/2019​ ​it​ ​was​ ​clearly​ ​mentioned under the head Experience that:-​ ​“​d. Experience:​

​One​ ​–half​ ​(=0.5)​ ​mark​ ​for​ ​each​ ​year​ ​or​ ​part​ ​thereof​ ​exceeding​​six​​month​​of​​experience,​​out​​of​​a​​maximum​​of​​sixteen​ ​years,​ ​on​ ​the​ ​same​ ​or​ ​a​ ​higher​ ​post​ ​in​ ​any​ ​Department/Board/Corporation/Company/Statutory​ ​Body/​ ​Commission/Authority​ ​of​ ​Government​ ​of​ ​Haryana.​ ​No​ ​marks​ ​shall be awarded for any period less than six months.​ ​(A maximum of 8 marks)​”​ ​xxx​ ​xxx​ ​xxx​ ​7.​ ​That​​the​​Present​​writ​​petition​​came​​up​​for​​hearing​​before​ ​the​ ​Hon’ble​ ​High​ ​Court​ ​and​ ​the​ ​Hon’ble​ ​High​ ​court​ ​was​ ​pleased​ ​to​ ​pass​ ​the​ ​interim​ ​order​ ​dated​ ​19.05.2021​ ​which​ ​is​ ​reproduced as under:-​ ​“Petitioner-Pradeep​ ​Singh,​ ​stated​ ​to​ ​be​ ​aged​ ​28​ ​years​ ​has​​filed​​the​​present​​writ​​petition​​inter​​alia​​with​​a​​prayer​ ​for​​directing​​the​​respondent​​to​​grant​​one​​half​​(0.5​​marks)​ ​for​ ​experience​ ​to​ ​the​ ​petitioner​ ​for​ ​working​ ​in​ ​ISO​ ​Certified​​company​​as​​Junior​​Engineer​​as​​described​​in​​the​ ​notification​ ​dated​ ​05.07.2019​ ​as​ ​(Annexure​ ​P-1)​ ​and​ ​further relief as mentioned in the present writ petition.​ ​Notice of motion.​ ​On​ ​asking​ ​of​ ​the​ ​Court,​ ​Ms.​ ​Palika​ ​Monga,​ ​DAG,​ ​Haryana​​accepts​​notice​​on​​behalf​​of​​the​​State.​​Let​​reply​ ​be​​filed​​within​​two​​weeks​​prior​​to​​the​​date​​fixed​​with​​an​ ​advance​​copy​​to​​the​​counsel​​for​​the​​petitioner.​​Adjourned​ ​to 27.07.2021.”​

​In​​this​​regard,​​it​​is​​pertinent​​to​​mention​​here​​that​​the​​petitioner​ ​had​​produced​​experience​​certificate​​dated​​10.01.2019​​issued​​by​ ​Statcon​ ​Electronics​ ​India​ ​Limited​ ​A-34,​ ​Sector-59,​ ​Gautam​ ​Budh​​Nagar,​​Noida-201301​​for​​working​​as​​“Junior​​Engineer”.​ ​It​ ​is​ ​pertinent​ ​to​ ​mention​ ​here​ ​that​ ​the​ ​aforesaid​ ​experience​ ​certificate​​dated​​10.01.2019​​is​​not​​in​​accordance​​with​​the​​terms​ ​and​ ​conditions​ ​of​ ​the​ ​advertisement​ ​viz.​ ​the​ ​experience​ ​certificate​ ​is​ ​required​ ​to​ ​be​ ​from​ ​any​ ​Department/Board/Corporation/Company/StatutoryBody/Com​ ​mission /Authority of Government of Haryana.​ ​Therefore,​ ​the​ ​experience​ ​marks​ ​were​ ​rightly​​not​ ​awarded​​to​​the​​petitioner​​and​​he​​was​​considered​​in​​the​​waiting​ ​list for the post in question.”​ ​3.​ ​There​ ​was​​neither​​any​​counter​​to​​the​​above,​​nor​​learned​​counsel​​for​ PARVEEN KUMAR​the​​petitioner,​​despite​​best​​efforts,​​was​​able​​to,​​during​​the​​course​​of​​hearing,​​dispel​ 2026.07.29 16:32 I attest to the accuracy and integrity of this order/judgment. ​CWP-9948-2021 (O&M)​ ​-​3​-​ ​the​​same​​or​​carve​​out​​a​​case​​in​​his​​favor,​​thus​​the​​experience​​was​​not​​in​​accordance​ ​with the requirements mentioned in the advertisement​.​ ​4.​ ​In view of the above, the present petition is hereby dismissed.​ ​(​AMAN CHAUDHARY​​)​ ​JUDGE​ ​July 27, 2026​ ​Paritosh Kumar​
