CWP-21470-2026 (O&M) 1 172 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CWP-21470-2026 (O&M) Date of decision: 16.07.2026 M/S METAFAB ENGINEERS (INDIA) PVT. LTD. ....Petitioner Versus STATE OF HARYANA AND OTHERS ...Respondents CORAM: HON'BLE THE ACTING CHIEF JUSTICE HON'BLE MR. JUSTICE ROHIT KAPOOR ***** Present: Mr. Rishab Singla, Advocate for the petitioner. Mr. Sourabh Goel, Addl. A.G., Haryana. ***** ASHWANI KUMAR MISHRA, A.C.J. (Oral) 1. The order-in-original dated 01.12.2022 (Annexure P-4) impugned in this petition is primarily assailed on the ground that no reasons have been recorded justifying the passing of the order itself. It is submitted that reasons are the soul of the order, and in its absence, the order passed by the authority itself would be rendered lifeless. 2. Perusal of the order would indicate that it only contains the description of amount payable by the petitioner, without any determination with regard to liability of the petitioner to deposit such amount. 3. Learned State counsel, on the basis of instructions obtained, states that instead of keeping the matter pending, this petition can be disposed of with liberty to the respondents to pass a fresh order, after affording an opportunity of hearing to the petitioner. 4. In view of the fair stand taken by the respondents, we dispose of MOHIT GOYAL 2026.07.20 10:54 I attest to the accuracy and integrity of this document CWP-21470-2026 (O&M) 2
this petition with the observation that the authority concerned shall afford an opportunity of hearing to the petitioner, and thereafter proceed to pass a reasoned order, after considering the petitioner’s objections in the matter. In order to facilitate such appropriate consideration, we set aside the order impugned in the present petition dated 01.12.2022 (Annexure P-4), as also the order passed in appeal dated 11.12.2025 (Annexure P-7).
