CRM-M-30760-2026 -1- 213/2 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-30760-2026 Date of Decision: 09.07.2026 Baljeet Kaur alias Baljit Kaur …Petitioner vs. State of Haryana …Respondent Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. Vikas Bishnoi, Advocate for the petitioner. Mr. Rajiv Sidhu, Sr. DAG, Haryana. *** N.S.Shekhawat J. (Oral) 1. The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (Section 439 of Cr.P.C.) with a prayer to grant regular bail to her in case FIR No.412 dated 21.11.2025 registered under Section 15 of NDPS Act, 1985 but during investigation Section 15 of NDPS Act has been deleted and Section 15(b) of NDPS Act has been added, at Police Station Sadar Fatehabad, District Fatehabad. 2. Learned counsel for the petitioner contends that in the present case, the petitioner was wrongly arrested by the police without any evidence against her. Even she has been falsely involved in the past also because of her criminal antecedents and no recovery was effected from her. He further submits that even during the search and seizure, the mandatory provisions of NDPS Act were not followed by the police and the petitioner deserves to be enlarged on bail. Apart from that, the petitioner is aged about 76 years and deserves HEMLATA 2026.07.13 16:54 I attest to the accuracy and integrity of this document CRM-M-30760-2026 -2-
sympathetic consideration by this Court. The petitioner was arrested on 21.11.2025 and is in custody for the last more than 07 months. Even though, the petitioner was involved in eight more FIRs, but she is on bail in all the cases. 3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and she does not deserve the concession of bail by this Court. He further submits that the petitioner is a hardened criminal and is involved in eight other cases. 4. I have heard the learned counsel for the parties and perused the record. 5. In the present case, the recovery of 14 kgs of poppy husk was effected by the police from the petitioner and her co-accused, which is non-commercial in nature. Even the rigors of Section 37 of NDPS Act may not strictly apply to the facts of the present case. Apart from that, the petitioner is stated to be in custody for the last more than 07 months and challan has already been presented against her. 6. Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to her furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned, subject to the following conditions:-
