Thee instant petition has been filed by the petitioner under Sectionn 482 of Bharatiyaa Nagarik Suraksha Sanhita, 20223 (for short “BNSS”) for grantt of regular bail iin case arising out of FIR No. 20 dated 23.01.2026 registeredd under Sections 3318(4), 336(2), 336(3), 340(2) and 61(2) of Bharatiya Nyayaa Sanhita, 2023 (ffor short “BNS”) at Police Sttation Canal Colony, Bathinda,, District Bathindaa. 2. Thee aforementioned FIR has beenn registered on the basis of aa written complainnt submitted by the complainantt Jasvir Yadav, an employee off CNH Industrial Capital India Private Limited aalleging therein that the presentt petitioner alongwwith his brother Harpreet Singh had availed 02 loan facilities inn the sum of Rs.88,53,972/- and Rs.8,85,774/- reespectively for the purpose off purchase of tracttors. They had submitted documments of their identity proof likee PAN card, aadhaar card etc. to avail the loan faccilities. The petitioner was alsoo made a co-appliccant in the loan availed by the accused Harpreet Singh. Afterr availing the loann amount, the petitioner and thee co-accused did not deposit thee instalments thereeof. On making inquiries, it hadd transpired that on the basis off false documents of identification i.e. PAN carrd and aadhar card by wronglyy showing their aaddress, they had availed loan facilities from other financiall institutions also and had cheated them. They aalso misappropriated the tractorss purchased after availing the loan amount. AAll this was done by them inn connivance with co-accused Varinderjit Singh, aan official of the company of thee complainant.
3. Afteer registration of FIR, investi gation proceedings have beenn initiated and aree underway. Apprehending his arrest, the petitioner moved ann application for ggrant of anticipatory bail which hhas been dismissed by the Courtt of Learned Addittional Sessions Judge, Bathinda vide order dated 07.02.2026. 4. It iss argued by learned counsel forr the petitioner that he has beenn falsely implicateed in this case. No amount of loan was ever disbursed by thee complainant to hhim at any point of time. No doocument was ever submitted byy him to avail anyy loan. The case is based on doocumentary evidence and all thee AMIT SHARMA 2026.07.08 09:59 I attest to the accuracy and integrity of this order/judgment. CRM-M-10450--2026 (O&M) 3 requisite documeents are already with the investtigating agency. He is ready too join investigatioon. His custodial interrogationn is not required. Neither anyy recovery is to bee effected from him. It is, thereefore, argued that he deserves too be extended beneefit of bail.
5. Per contra, learned State counsel asssisted by learned counsel for thee complainant whoo has also placed on record certaain documents and while relyingg upon the status report has vehemently argued that the allegations against thee petitioner are serrious and specific in nature. TThe complainant and his brotherr had availed loaan facilities from the compan y of the complainant therebyy executing documments undertaking to repay the saame in instalments but not evenn a single instalmeent had been paid. Documents oof their identity had been forged.. During scrutiny of those documents variations inn the date of birth as mentionedd in the aadhar caard and PAN card were found. Other discrepancies were alsoo noticed. It was revealed that forged KYC doccuments had been furnished inn connivance with one official of the financial insttitution. The allegations that thee petitioner did noot avail any loan facility are pprima facie false as the tractorr purchased on thhe basis of the said loan had been got issued by him andd photograph Annnexure R1 showed this fact. LLearned State counsel has alsoo placed on recorrd Annexure R2 which is GS T invoice issued by Gurkirpaa Automobiles reggarding sale of tractor as on 04.003.2025. The documents of loann have also been p laced on record by the learned ccounsel for the complainant. Hiss custodial interroogation is required for condducting proper and thoroughh investigation. Thhere is no exceptional or extra-oordinary ground for grant of pre--

It is, therefore, arrgued that the petition does nott deserve to be alloowed. 6. Thiss Court has heard the rival submmissions made by learned counsell for the parties at considerable length.
7. Thee petitioner is alleged to have duuped the complainant by availingg loan facility on the basis of forged documennts and has not deposited anyy instalment thereeafter. The allegations primaa facie make out a case forr commission of ssubject offences by the petitioneer. The allegations against himm are serious in nnature. The case is at its nasce nt stage. It is well settled thatt anticipatory bail to an accused can be granted inn exceptional circumstances onlyy as a person coucched in comparative safety of pree-arrest bail would certainly nott disclose all the fafacts within his knowledge. In caase custodial interrogation of thee petitioner is dennied to the Investigating Agencyy, that shall leave many glaringg loopholes and gaaps, thereby adversely effectingg the investigation. The Court iss also required to see that an order of anticipatoryy bail does not operate as inroadd in the normal leegal procedure of criminal casees by the trial Court. It is welll settled propositioon of law that the powers for ggrant of pre-arrest bail are to bee exercised by the Court in extra-ordinary and exc eptional circumstances and withh great caution whhile taking into consideration the nature of the accusation and thee sentence which the conviction may entail. In the instant case, no suchh exceptional or exxtra-ordinary circumstance is, hoowever, made out from the pleass as taken by the petitioner. For the purpose of cconducting thorough and properr investigation cuustodial interrogation of the p etitioner is must. Taking intoo
