[2] Briefly statting, the marriage between the petitioner and respondent wass solemnized on 221.11.2021; out of their wedlockk, a girl child namely, Aishpreet,, was born on 277.12.2023; on account of mattrimonial discord between thee parties, the aboove mentioned divorce petitionn came to be preferred at thee instance of resppondent-husband. Thereafter, thhe present application seekingg its transfer camee to be filed by the petitioner-wifee.
[3] Learned coounsel for the petitioner, inter allia, contends that the petitioner--wife has also filled maintenance application beearing MNT No. 125/538/20266 before the Courtt of learned Principal Judge, Faamily Court, Rupnagar. Anotherr complaint under Sections 18, 19, 20 and 22 off the Protection of Women fromm Domestic Violennce Act, was also filed by the petitioner at Rupnagarr TEJWINDER SINGH 2026.07.06 17:06 I agree to specified portions of this document 2 TA-475-2026 Accordingly, a prayer is made for transfer of the above mentioned divorce petition filed at the instance of respondent-husband from Family Court, Zira to Family Court, Rupnagar. [4] Despite service, no one has chosen to appear on behalf of respondent. [5] I have heard learned counsel for the petitioner and gone through the paper-book. [6] In the present case, admittedly, the petitioner-wife has filed a maintenance application bearing No. MNT/125/538/2026 titled “Sandeep Kaur and Anr. Vs. Parwinder Singh” before the Court of learned Principal Judge, Family Court, Rupnagar and a complaint bearing No. COMA/896/2026 titled “Sandeep Kaur Vs. Parvinder Singh and Ors.” [7] As per the averments made in the present transfer application, the distance between Zira and Rupnagar is approximately 200 kilometres and the petitioner-wife having no independent source of income would be suffering a great deal of inconvenience in travelling on each date of hearing along with her minor daughter.
[8] Furthermore, the Hon’ble Supreme Court in its decision rendered in “Manjula Singh Chouhan Versus Vishal singh Chouhan”, reported as 2019 (13) SCC 660 held that, in the interest of both the parties, all connected matrimonial proceedings should ordinarily be heard by the same Court and, accordingly, allowed the transfer application therein. [9] Considering the aforesaid facts and circumstances, in the humble opinion of this Court, it would be in the interest of both the parties that all their cases be heard together by the same Court. Consequently the transfer application is allowed and the divorce petition under Section 13 of the Hindu Marriage Act i.e. DMC/23/2026, titled “Parwinder Singh Vs. Sandeep Kaur”, filed by the respondent-husband, stands transferred from the Family Court, Zira, to the Court of competent jurisdiction at Family Court, Rupnagar.
