3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He further states that the petitioner is in custody since 04.06.2024; despite the final report having been submitted and charges have been framed as far back as on 07.11.2024, not even a single witness out of 25 quoted witnesses has been examined. He further submits that under the circumstances, the trial is not likely to be concluded in the near future. Learned counsel further submits that the injury attributed to the petitioner was a simple injury and co-accused Vishal, who was alleged to have given a datar blow on the nose of the complainant has been granted regular bail by a coordinate Bench vide order dated 30.04.2025 passed in CRM-M-21597-2025. Per 4. contra, learned counsel representing the State of Punjab has opposed the bail petition. He, however, on the basis of custody certificate filed in Court today states that the petitioner is undergoing incarceration for the last 2 years and 25 days. It has also been pointed out that there are two other cases registered against the petitioner, the details of which have been given in the custody certificate. Out of the two cases, in one, the petitioner is on trial whereas, in the other case, he is on a production warrant. VIKAS CHANDER 2026.07.02 17.23 I attest to the accuracy and integrity of this document CRM-M-31459-2026 -3- 5. I have considered the submissions made by learned counsel for the parties.
6. It is a matter of grave concern that the petitioner is in custody for the last more than 2 years and despite charges having been framed as far back as in November 2024, not even a single witness has been examined. The right to speedy trial is a valuable right and the delay in conclusion of trial certainly prejudices such right of an accused. Still further, the allegation against the petitioner is of having given a simply injury to the complainant though with a datar. Co-accused Vishal, who was alleged to have given a datar blow on the nose of the complainant, has been released on regular bail by a coordinate Bench vide order dated 30.04.2025 passed in CRM-M-21597-2025. The case of the petitioner is on a better footing than that of the said Vishal. 7. Keeping in view the totality of the facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.
