3 18-08-2026 Heard Mr. Sanjay Kumar, learned Advocate for the petitioner and Mr. Gyan Shankar, learned Advocate for the Bihar School Examination Board, which is the main contesting respondent. The State is represented through Mr. Satya Vrat, learned Advocate. 2. The petitioner is seeking a direction upon the Bihar Patna High Court CWJC No.7318 of 2024(3) dt.18-08-2026 2/4 School Examination Board (hereinafter referred to as, “BSEB”) to constitute a Managing Committee of Sant Kabir Mahanth Ram Dayal Das College, Ram Lakhan Nagar, Bidupur Bazar, Vaishali at Hajipur (hereinafter referred to as, “College”) under his Chairmanship, in the capacity of donor member and allow him to manage the affairs of the College. 3. It is contended that earlier one Acharya Mahanth Ram Dayal Das Ji Maharaj was the trustee of Kabirpanthi Math, Bidupur, Vaishali who had donated the land and building of the College and subsequent thereof, the petitioner was appointed as Mahanth of Kabirpanthi Math, Bidupur, Vaishali. After nomination of the petitioner as Mahanth/Chief Trustee of Kabirpanthi Math, Bidupur, Vaishali a meeting of the teacher and non-teaching employees was organized and a proposal was passed to constitute a Managing Committee of the College. The aforesaid proposal was sent to the Director, Academic of the Board on 13.01.2023. However, till date, no final decision has been taken.
4. A counter affidavit has been filed on behalf of the respondent Board and submission has been made that as per the deed with regard to donation of the land for the College, in question, the name of Acharya Mahanth Ram Dayal Das Patna High Court CWJC No.7318 of 2024(3) dt.18-08-2026 3/4 recorded as Lekhadhari and the land has been donated in the name of State Government. The petitioner being Mathadhish of Kabirpanthi, Bidupur, Vaishali claims to be nominated as Chairman of Managing Committee. However, the same is not legally admissible in terms with Bihar School Examination Board, Affiliation Regulation, 2011 as amended 2013. 5. Learned Advocate for the petitioner, at this juncture, interjected and submitted that since the petitioner has nominated as the Mahanth of the Kabirpanthi, Bidupur, Vaishali and there is a proposal in his favour, the same is required to be looked into and duly considered by the Director, Academic, BSEB.
6. In view of the aforesaid facts, especially the proposal for constitution of Managing Committee was sent long back in the year 2023, this Court direct the respondent no. 6, The Director (Academic), Bihar School Examination Board, (Higher Secondary), Patna to look into the matter and take a final decision upon the proposal sent by the College, the copy of which is placed on record as Annexure-P/2, and bring to its logical conclusion, in accordance with law, if no final decision has been taken as yet on such proposal, preferably within a period of twelve weeks’ from the date of receipt/production of a Patna High Court CWJC No.7318 of 2024(3) dt.18-08-2026 4/4 copy of this order. 7.
