IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL Nos. 6146 & 6161 of 2026 CNR Nos. ODHC010417412026 & ODHC010417602026 Surendra Rout … Petitioners (In BLAPL No. 6146 of 2026) Sukant @ Sukanta Kumar Moharnana (In BLAPL No. 6161 of 2026) Mr. M.Padhy, Advocate in both the BLAPSs -versus- State of Odisha … Opposite Party Mr. M.R. Patra, Addl. PP CORAM: JUSTICE G. SATAPATHY ORDER(ORAL) 07.08.2026Order No. 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Khuntuni PS Case No. 269 of 2025 corresponding to Special Case No. 05 of 2025 pending in the file of learned Addl. District & Sessions Judge-cum-Special Judge, Athagarh for commission of offence punishable U/S.20(b)(ii)(C) of the NDPS Act, on the main allegation of transporting 16Kgs 150Grams of Contraband Ganja in a Tata ACE vehicle bearing Registration No.ODO5G-1650. Page 1 of 3 4. Heard, Mr. Manoranjan Padhy, learned counsel for the petitioners and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record.
5. Admittedly, the petitioners have been granted liberty in BLAPL Nos.4427 of 2026 & BLAPL No.1216 of 2026 to renew their prayer for bail after examination of some witnesses and in the meantime, 03 witnesses have been examined, but trial is yet to be concluded and there are 24 charge sheeted witnesses and, therefore, the trial would take some time. Further, the quantity of Contraband Ganja allegedly seized from the petitioners is not coming within the purview of commercial quantity and thereby, the provision of Sec. 37 of NDPS Act is not attracted against the petitioners. In such view of the matter and taking into account the custody period of the petitioners, this Court without expressing any view on merits, admits the petitioners to bail. 6. Hence, these two bail applications of the petitioners namely Surendra Rout (in BLAPL No.6146 of 2026) and Sukant @ Sukanta Kumar Moharana (in BLAPL No.6161 of 2026) are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) each with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case Page 2 of 3 on such terms and conditions as deem fit and proper by it.
7. Accordingly, these BLAPL Nos. 6146 & 6161 of 2026 stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
