IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.5577 of 2026 Jashobanta Seth … Petitioner Mr. J. Sahu, Advocate -versus- State of Odisha … Opposite Party Mr. T.K. Acharya, Addl. PP CORAM: JUSTICE G. SATAPATHY ORDER(ORAL): 30.07.2026Order No. 1 01. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Buden P.S. Case No. 45 of 2025 corresponding to C.T. Case No. 10 of 2026 (G.R. Case No. 541 of 2025) pending in the file of learned Addl. Sessions Judge, Padampur, for commission of offences punishable U/Ss. 103(1)/3(5) of BNS, on the main allegation of committing murder of Pintu Majhi by assaulting him. 2. In the course of hearing, Mr. Jagabandhu Sahu, learned counsel for the petitioner submits that there is no eye witness to the occurrence, but the only circumstance against him is the last seen theory, which is in fact not established by the prosecution and the informant having already been examined and the petitioner being in custody since long, he may kindly be granted bail. 2.1. On the other hand, Mr. T.K. Acharya, learned Addl. PP by placing the statement of witness Mano Kamati and Bela Kamati submits that not only these two witnesses have seen the petitioner assaulting the Page 1 of 2
deceased, but also the deceased was found dead subsequently and the postmortem report of the deceased clearly indicates that the death was proximate to the time when the petitioner was assaulting the deceased. Accordingly, Mr. Acharya prays to reject the bail application of the petitioner. 3. After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for committing murder of the deceased, but in the meantime nine witnesses have already been examined, however, the witnesses Mano Kamati and Bela Kamati are yet to be examined. In the aforesaid facts and circumstances and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the materials placed on record, this Court is not inclined to grant bail to the petitioner at this stage. 4. Hence the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the Court in seisin over the matter for reference. (G.
