NARASINGH ORDER 29.07.2026 Order No. 03. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.262 of 2026 pending on the file of the learned S.D.J.M., Bhadrak arising out of Sabrang P.S. Case No.33 of 2026 pending on the file of the learned Court in seisin for commission of offences punishable under Sections 318(4)/ 316(2)/ 3(5) of BNS. 3. It is submitted by the learned counsel for the Petitioner that the Petitioner has been arrayed as an accused because he is the younger brother of the principal accused Deepak Mahapatra. 4. It is stated that in the meanwhile the said accused person who was taken into custody has since been released on bail and referring to the substratum of the allegations, it is submitted that the Petitioner Page 1 of 2 induced the Informant to make investment in stocks assuring him high returns. 5. Learned counsel for the State opposes the prayer for pre-arrest bail. 6. Taking into account the nature of allegations, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation. 8. Accordingly, the ABLAPL stands disposed of. (V.
