IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMC No.2419 of 2026 Lizarani Kumbhar ..... Petitioner Represented by Adv. - Suryakanta Dwibedi -versus- State of Odisha ..... Opposite Party Represented by Adv. - Mr. J.K.Ray, A.S.C. CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 29.07.2026 Order No. 01. 1. This matter is taken up through Hybrid mode. 2. Heard learned counsel for the Petitioner as well as the learned counsel for the State. Perused the CRLMC application as well as the prayer made therein. 3. By filing the present CRLMC application under Section 482 of the Cr.P.C., the accused in 2(a)CC Case No.169 of 2025, which was disposed of by the learned J.M.F.C., G. Udayagiri, has approached this Court for a direction to the learned trial court for early consideration and disposal of M.C. No.6 of 2026. 4. Learned counsel for the Petitioner, at the outset, contended that the Petitioner is the owner of the vehicle which was the subject matter in 2(a)CC Case No.169 of 2025. He further contended that in the said trial the accused persons have been acquitted by the learned trial court by virtue of the judgment Page 1 of 3.
dated 08.05.2025, at Annexure-1 to the CRLMC application. He further contended that after the accused persons were acquitted, the Petitioner being the owner of the vehicle moved an application for release of the vehicle in his favour by filing M.C. No.6 of 2026. The sole grievance of the Petitioner in the present CRLMC application is that although he has filed such application for release of the vehicle which was seized in connection with the abovenoted 2(a)CC Case, such application has not been considered as of now by the learned trial court. Being aggrieved by such inaction of the learned trial court, the Petitioner has approached this Court for a direction to the learned trial court to dispose of such application at the earliest. 5. Learned counsel for the State on the other hand contended that taking into consideration the nature of the relief sought for in the present application, he will have no objection if this Court directs the learned trial court for early disposal of such application.
6. Having regard to the submissions made by the learned counsels appearing for both sides, on a careful examination of the background facts, further taking note of the limited nature of the prayer, this Court deems it proper to dispose of the CRLMC application at the stage of admission by directing the learned trial court to consider and dispose of the application of the Petitioner bearing M.C. No.6 of 2026, if the same is still pending, as expeditiously as possible, preferably within a period of eight weeks from the date of communication of a copy of today’s order. Page 2 of 3. 7. With the aforesaid observations and directions, the CRLMC application stands disposed of.
