IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 8382 of 2026 Trinath Patra …. Petitioner Mr. B.K. Pardhi, Advocate -versus- State of Odisha …. Opposite Party Mr. U.C. Jena, ASC CORAM: JUSTICE V. NARASINGH ORDER 27.07.2026 Order No. 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with Spl. G.R. Case No.10 of 2026 pending on the file of learned Addl. Sessions Judge, Karanjia of Mayurbhanj arising out of Raruan P.S. Case No.111 of 2026 for commission of offences punishable under Section 20(b)(ii)(B), 25 & 29 of NDPS Act. 3. It is submitted by the learned counsel for the Petitioner that the basis of implication is on account of the co-accused statement and since another co-accused Jatindra Giri has since been released on pre-arrest bail by order dated 01.07.2026 in ABLAPL No.7226 of 2026, on the ground of parity, the Petitioner may be protected by pre-arrest bail. Page 1 of 2 4. Learned counsel for the State opposes the prayer for pre-arrest bail. 5. It is submitted that though the contraband is to the tune of 6.030Kg (ganja), the Petitioner is not similarly circumstanced with the co-accused who has since been released on pre-arrest bail since the allegation against the Petitioner is that he was the pillion rider where other co-accused who has released was the owner of the vehicle.
6. Considering the rival submission, the role ascribed to the Petitioner and the basis of implication, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature. 7. If it comes to the fore that the Petitioner has any such criminal antecedent, this order shall not be given effect to. 8. It is needless to state that the Petitioner shall cooperate with the ongoing investigation. 9. Accordingly, the ABLAPL stands disposed of. (V.
