The present Writ Petition inter alia challenging the order dated 12.06.2026 so issued by Opp. Party No.3 under Annexure-2. Vide the said order, Petitioner has been put under transfer from LAC, Kalyanpur, Delang to the office of SDVO, Puri. 3.1. It is contended that pursuant to order dated 12.06.2026, Petitioner was relieved from Delang vide order dated 20.06.2026 under Annexure-3. Petitioner thereafter remained on leave by submitting leave application under Annexure-4. Not only that Petitioner also made an application before Opp. Party No.3 with a prayer to cancel the order of transfer so passed on 12.06.2026 under Annexure-2. Page 1 of 3. 3.2. However, vide another order passed on 30.06.2026 under Annexure-6 by the self-same Opp. Party No.3, Petitioner is now being transferred and posted as Attendant LAC, Baharana, Nimapada.
3.3. It is contended that since Petitioner was originally transferred to the office of SDVO, Puri and in consideration of the application, while modifying the said order, Petitioner should have been allowed to continue at Delang instead of transferring him to LAC, Baharana, Nimapada. It is accordingly contended that the impugned order passed on 30.06.2026 under Annexure-6, needs interference of this Court. 4. Learned Addl. Govt. Advocate on the other hand contended that initially vide order dated 12.06.2026 under Annexure-2, Petitioner when was transferred and posted as Chowkidar in the office of SDVO, Puri, Petitioner challenging such order of transfer, made a grievance before Opp. Party No.3 under Annexure-5. In consideration of the same, Petitioner vide order dated 30.06.2026 under Annexure-6 has now been transferred and posted as Attendant in LAC, Baharana, Nimapada. 5. It is accordingly contended that since on consideration of the Petitioner’s grievance so made under Annexure-5, Petitioner’s grievance was considered and he was transferred and posted as an Attendant in LAC, Baharana, Nimapada, no interference is called for. 5.1. It is further contended that Petitioner stands relieved from LAC, Delang vide order dated 20.06.2026 under Annexure-3. 6. Having heard learned counsel for the Parties and considering the submission made, it is found that Petitioner vide order dated 12.06.2026 under Annexure-2 when was transferred and posted to Page 2 of 3.
SDVO, Puri as Chowkidar, Petitioner raised a grievance to the effect that since he is holding the post of Attendant, he cannot be transferred and posted as Chowkidar under Annexure-5. 6.1. In consideration of such grievance Petitioner vide order dated 30.06.2026 under Annexure-6 has been transferred and posted as Attendant in LAC, Baharana, Nimapada. 6.2. In view of the same, it is the view of this Court that since in consideration of the Petitioner’s grievance, Petitioner has been transferred and posted as an Attendant vide order dated 30.06.2026, it is the view of this Court that Petitioner’s grievance has been duly considered. 6.3. However, if Petitioner is aggrieved by the order dated 30.06.2026 under Annexure-6, he is permitted to make a fresh grievance before Opp. Party No.3. It is observed that if any such application is moved by 24th July, 2026, Opp. Party No.3 shall take a lawful decision on the same by 31st July, 2026. Since it is not disputed that Petitioner has already been relieved from LAC, Delang vide order dated 20.06.2026, till 31st July, 2026, no coercive action be taken against the Petitioner. 7. Accordingly, the Writ Petition stands disposed of.
