IN THE HIGH COURT OF ORISSA AT CUTTACK CMP No.1102 of 2026 Sarada Prasad Choudhury ..... Petitioner Represented by Adv. - Debasis Tripathy -versus- Rabindra Nath Choudhury and ..... Opposite Parties others Represented by Adv. - CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 13.07.2026 Order No. 01. 1. This matter is taken up through Hybrid mode. 2. Heard learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein. 3. Learned counsel for the Petitioner at the outset contended that the Petitioner in C.S. No.259 of 2018, pending in the Court of learned Civil Judge (Senior Division), Kujanga, has approached this Court with a prayer for early disposal of the above noted suit. 4. Taking into consideration the submission made by the learned counsel for the Petitioner, on a careful examination of the documents filed along with the CMP application, and on a close scrutiny of the factual background of the present case, and keeping in view the fact Page 1 of 2.
that the suit is of the year 2018, this Court is not inclined to pass any specific direction fixing any time limit for disposal of the suit. The refusal of this Court to interfere and to grant the relief prayed for in the present CMP application is based on the fact that there are many cases pending before the Civil Courts in the State of Odisha. However, while disposing of the present CMP application, this Court grants liberty to the Petitioner to move the learned trial Court for early disposal of the suit. The learned trial Court, subject to convenience as well as the pendency of suits, shall do well to pass necessary orders thereon and, if possible, make every endeavor to dispose of the suit as expeditiously as possible. The parties are directed to cooperate with the learned trial Court and not to take any unnecessary adjournments. 5. With the aforesaid observation/direction, the CMP application stands disposed of.
