IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.3386 of 2026 Dhirendranath Baral @ Papu … Petitioner Ms. D. Mohapatra, Advocate -versus- State of Odisha … Opposite Party Mr. T.K. Acharya, Addl. PP CORAM: JUSTICE G. SATAPATHY ORDER(ORAL): 13.07.2026Order No. 05. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Talabania PS Case No.49 of 2026 corresponding to GR Case No.225 of 2026 pending in the file of learned SDJM, Puri for commission of offences punishable U/Ss.109(1)/ 324(5)/ 308(4)/ 351(3)/3(5)/111(2)/114(4)/61(2)(a)/49 of BNS r/w Section 25 of Arms Act and Sec. 9(b) of the Explosives Act and Sections 3/4/6 of ES Act, on the main allegation of throwing bombs to the shop of the informant. 2. Heard, Ms. Deepali Mohapatra, learned counsel for the petitioner and Mr. T.K. Acharya, learned Additional Public Prosecutor in the matter and perused the record including the affidavit as filed by learned counsel for the Petitioner.
3. Admittedly, the Petitioner is having serious criminal antecedents in 50 criminal cases, but it is contended by Ms. Mohapatra that the Petitioner has been acquitted in 12 cases leaving behind 38 cases still pending. Further, the bail application of the Petitioner has been rejected in BLAPL No. 2679 of 2026 which arises out of Baliapanda PS Case No. 35 of 2026 for commission of offences punishable U/Ss. 109/ 324(5)/ 308(4)/ 351(3)/ 3(5)/ 111(2)/ 111(4)/ 49(2)(a) of the BNS r/w Section 25 of the Arms Act and Section 9(b) of Page 1 of 2 the Explosives Act and Sections 3/4/6 of ES Act. Besides, this Court has in fact granted bail to the Petitioner in BLAPL No. 6067 of 2025 and in BLAPL No. 3831 of 2025, but subject to the following condition:- “(iv) the petitioner shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10AM to 12 Noon for six(06) months from the actual date of release from the custody or till conclusion of the trial, whichever is earlier.”
4. The Petitioner by way of an affidavit apprises this Court that although he has complied the condition in Puri Town PS Case No. 320 of 2024, but inadvertently he has failed to comply such direction in Baliapanda PS Case No. 162 of 2024 and he was subsequently acquitted there from. In view of the aforesaid facts and situation and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the failure of the Petitioner to comply the condition as imposed by this Court for grant of bail, this Court is not inclined to grant bail to the Petitioner at this stage. 5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the learned Court in seisin over the matter. (G.
