IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.5278 of 2026 Salman Pal @ Salman Palo … Petitioner Mr. B.P. Das, Advocate -versus- State of Orissa … Opposite Party Mr. S.C. Pradhan, Addl. PP CORAM: JUSTICE G. SATAPATHY ORDER(ORAL):09.07.2026Order No. 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Padmapur PS Case No.152 of 2025 corresponding to TR Case No. 71 of 2025 pending in the Court of learned Addl. Sessions Judge-Cum-Special Judge, Gunupur, for commission of offence punishable U/S.20(b)(ii)(C) of the NDPS Act, on the main allegation of supplying 22Kgs of Contraband Ganja to co-accused persons. 3. Heard, Mr. Biraja Prasanna Das, learned counsel for the petitioner and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the matter and perused the record. Mr. Das by producing the copy of the judgment submits that the petitioner is not having any criminal antecedent since he has been acquitted in TR Case No.73 of 2021 arising out of Gudari PS Case No.45 of 2021. 4. Admittedly, the petitioner was neither apprehended from the spot nor was he found in conscious possession of any contraband article and in the meantime, Page 1 of 2
charge-sheet has already been submitted, however, the trial is yet to commence and there are 07 charge-sheeted witnesses and, therefore, the trial would take some time. Besides, it is claimed that the petitioner is not having any criminal antecedent. In the fitness of the things and taking into account the materials placed on record and keeping in view the mode and manner of implication of the present petitioner, this Court considers that the petitioner has satisfied the conditions of Sec.37 of NDPS Act. 5. For the reason stated hereinabove and taking into account the pre-trial detention of the petitioner in custody since 14.11.2025, this Court without expressing any view on merit admits the petitioner to bail. 6. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 7. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. Signature Not Verified (G.
